LIMITED SOURCE JUSTIFICATION

Upon the basis of the following justification, I, as Contracting Officer, hereby approve this limited sources justification in accordance with FAR 8.405-6(b)(1), items peculiar to one manufacturer. The acquisitions referenced herein are conducted under the authority of the Multiple Award Schedule Program.

JUSTIFICATION

1. REQUIRING AGENCY AND CONTRACTING OFFICE:

a. Requiring Agency:

DISA/ESD, ES25

Defense Enterprise Computing Centers (DECC) Oklahoma City 8705 Industrial Blvd.

Tinker AFB, OK 73145-3352

b. Contracting Agency:

DISA/DITCO, PL8321

2300 East Drive Scott AFB, IL 62225-5406

2. NATURE/DESCRIPTION OF ACTION(S):

a. The nature of this new requirement is to procure proprietary Microsoft Commercial-Off-The-Shelf (COTS) software, which includes Structured Query Language (SQL) Server Enterprise for development and SQL Server Enterprise, both including the first year of maintenance. This purchase will be awarded as a firm-fixed price delivery order against a Department of Defense (DoD) Enterprise Software Initiative (ESI) Blanket Purchase Agreement (BPA) from an authorized reseller of the Original Equipment Manufacturer (OEM).

b. The period of performance (PoP) is for twelve months beginning on 29 September 2012 through 28 September 2013. The applicable North American Industry Classification System (NAICS) code is 511210. The procurement is using FY 2012 Defense Working Capital Funds (DWCF) provided on Military Interdepartmental Purchase Requests (MIPR) DHQCSD12MPC0717.

3. DESCRIPTION OF SUPPLIES/SERVICES:

a. The software requested under this initiative is selected based on planned web hosting environment within the Air Force’s (AF’s) Secure Technology Application eXecution (STAX) testing and development phase. The mission partner’s environment will be hosted both at DECC Montgomery, AL, and Oklahoma City, OK.

b. A description of the requested products is below:

Microsoft Product
QTY
E32-00974- SQL Server Enterprise for Development
300
7JQ-00356 - SQL Server Enterprise
56

4. IDENTIFICATION OF STATUTORY AUTHORITY and DEMONSTRATION OF CONTRACTOR’S UNIQUE QUALIFICATIONS:

a. The limited source authority is FAR 8.405-6(b)(1), items peculiar to one manufacturer. The software covered in this justification is proprietary and is only available from either the OEM, and/or authorized resellers of the COTS software. No other vendors or distributors can legally obtain access to the software nor make duplicate copies since copyrights and patent laws protect it.

b. Microsoft Corporation owns all proprietary rights to the source code. As an enterprise service offering, STAX has specific features and components that comprise the platform itself and it has features such as database type that can be ordered for customer specific requirements. As the STAX product is scaled to increase existing activity and services to support a larger customer base, specific platform components will need to be ordered that cannot change without impacting the system type accreditation or service delivery capability. DISA requires the name brand for all STAX components and features because of their unique qualities and inter-relationships that support implementation and accreditation of the STAX product offering. If the STAX program office were to procure other brands of these types of materials, it would introduce unacceptable levels of risk with interoperability, information assurance capability, configuration management and service stability that impact the realization of DoD’s Information Technology (IT) efficiencies. In this acquisition, the Microsoft software supports a customer ordered configuration that requires the SQL Server database option in the STAX service. This in turn is needed to enable the customer to develop and host their application in all STAX environments (development, test, pre-production and production). Without the specific component, the customer will not be able to appropriately develop their application. No other competitors’ products are acceptable. Since there are authorized resellers, the intent is to solicit quotes from the DoD ESI BPA resellers.

c. For this particular mission partner, they are standing up an application called the Contractor Manpower Reporting Application (CMRA), mandated by Congress to track all contractor manpower hours throughout the DOD. DISA STAX has been chosen as their hosting location, and must be available to meet their 30 September 2012 deadline. The AF is recommending to OSD that this become the hosting solution for the CMRA "purple" version to be deployed within the next year. As such, the application, and STAX by association, has DISA Director level visibility due to the congressional oversight and mandate.

d. The requested Microsoft components are currently part of the AF CMRA development team architecture and must be installed as a part of the STAX service delivery. The AF program office has chosen Microsoft .NET architecture and needs the Microsoft SQL Server database functions to deliver the application capability. STAX must provide the customer selected optional database service and developer licenses to support the ongoing system development and production hosting support.

e. No other commercially available products are capable of integrating with the STAX Microsoft platform.

5. BEST VALUE DETERMINATION:

The Contracting Officer will determine the prices are fair and reasonable based on solicited quotes received, comparison of negotiated prices, and a comparison of the Independent Government Cost Estimate. Although GSA has already negotiated fair and reasonable pricing, the Contracting Officer will seek additional discounts from DoD ESI BPA prior to award. A determination will be made by the Contracting Officer that the order represents the best value, as defined in FAR 2.101, to the Government and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.
