Purchase Request Number: N/A
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION (OTFAOC)
LIMITED SOURCES JUSTIFICATION
Justification for OTFAOC Number: JA11-052
Upon the basis of the following justification, I, as Procuring Activity Competition Advocate, hereby approve the use of other than full and open competition of the proposed contractual actions pursuant to the statutory authority of Title III of the Federal Property and Administrative, Services Act of 1949 (41 U.S.C. 251, et seq.) and Title 40 U.S.C. 501, Services for Executive Agencies. The regulatory authority that applies to the requirement is FAR Part 8.405-6 (a) (2), brand name.
JUSTIFICATION
1. REQUIRING AGENCY AND CONTRACTING OFFICE:
Requiring Activity: Defense Information Systems Agency (DISA)
Computing Services, GS451 5600 Columbia Pike Falls Church VA 22041-2705
Contracting Activity: Defense Information Technology Contracting Organization (DITCO) Scott Field Office IT Software – PL8321 Scott AFB, IL 62225-5406
2. NATURE/DESCRIPTION OF ACTION:
a. A Class Justification and Approval (J&A) is required to procure brand name proprietary Commercial Off-The-Shelf (COTS) Microsoft Exchange 2010 software products (listed in paragraph 3) and maintenance to support the Enterprise Email requirement for the United States (US) Army. The Defense Information Systems Agency (DISA) Computing Services Directorate (CSD) is tasked to provide a single email solution to be offered to their Department of Defense (DoD) customers.
b. The recommendation is to solicit quotes from Microsoft, the Original Equipment Manufacturer (OEM) and their authorized resellers against the DoD Enterprise Software Initiative (ESI) Blanket Purchase Agreement (BPA). The delivery orders will be firm-fixed-price for a period of performance of one year from the date of award. The estimated value for the class J&A is $2.2M. The orders will have central site management.
3. DESCRIPTION OF SUPPLIES/SERVICES:
a. The DISA Chief Information Officer (CIO) is implementing the DoD Enterprise Email Project that requires a Microsoft Exchange 2010 Enterprise Email system on the NIPR Net and to deploy the service in an Enterprise Application and Services Forest (EASF). The EASF is a Global Address List (GAL) that acts as a directory service within the Microsoft Exchange system. This feature allows digital certificates generated by the Microsoft Exchange Servers to automatically be published in the Global Address Book. The Army will be able to publish to GAL their externally generated Public Key Infrastructure (PKI )certificates that are used for secure e-mail.
b. The solution is designed to initially support 1,400,000 Army users and is scalable to support the 4.5M DoD user personas, which are actual user accounts and other defined entities such as group email addresses which are required by Exchange. The US Army is the first customer with 1.4M users, which requires the use of Microsoft software. The DoD currently uses older versions of Microsoft Outlook for email functionality, but would like to upgrade to the latest version of the software, as well as consolidate the servers and software currently implemented around the world.
c. Enterprise Email will provide a single email solution to be offered to the DoD customers with DISA CSD acting as the email service provider. The Microsoft products required to support Enterprise Email will be implemented in iterations supporting a subset of the total 1.4M user base. The Microsoft products required for the enterprise e-mail solution are groupings of hardware and software that are referred to or designated as a POD. Only DISA’s Defense Enterprise Computing Centers (DECCs) will be designated as a POD. There will be up to sixteen (16) POD sites within DISA’s DECC architecture. All Army sites will be designated as Mini-PODs. Approximately eleven (11) Mini-Pod sites will be added in across the Army’s information architecture. The amount of sites to be implemented are subject to change based on service implementation issues. POD or Mini-Pod sites will be located in both CONUS and OCONUS locations. The attached document outlines the sites and the estimated cost associated for each site.
The following list of Microsoft products are required for either a POD or a Mini-POD and are available on the DoD ESI BPA. The quantity of products required will be driven by the size of the POD or Mini-Pod.

4. IDENTIFICATION OF STATUTORY AUTHORITY:
Only one responsible source and no other supplies or services will satisfy agency requirements in accordance with FAR 8.405-6(a)(2); the acquisition requires the brand name product be procured. Microsoft Corporation software is proprietary and is only available from either Microsoft Corporation or authorized resellers of the brand name product. No other vendor or distributor can legally obtain access to the software nor make duplicate copies since it is protected by copyright and patent laws.
5. DEMONSTRATION OF CONTRACTOR’S UNIQUE QUALIFICATIONS:
a. Microsoft is the only software available that works with DISA’s current email system. The Microsoft suite of software for Exchange 2010 enables users full mailbox, calendar, and public folder support, including compatibility with other Microsoft native tools, as well as functionality with security and monitoring. No other known software can provide this solution within DISA’s architecture. CSD provides a secure and rapidly scalable solution to meet emergent surges that has full archival and backup features that commercial solutions lack. Moving to an external DISA solution is also not an option as security would not be maintained.
b. Microsoft software is required because it contains all of the following and no other software can meet the Agencies needs.
1) Federal Information Processing (FIPs) 140-2 certification for cryptographic module for data in transit and data at rest.
2) National Information Assurance Partnership (NIAP) Common Criteria certification at Evaluation Assurance Level 3 (EAL3) or greater as managed by NSA. This requires items to be “Methodically Tested and Checked” to become authorized on the Certified Products List.
(http://www.nsa.gov/ia/business_research/partnerships_with_industry/niap_and_cots_product_e valuations.shtml)
3) Joint Interoperability Test Command (JITC) Public Key Infrastructure ( PKI) /Public Key Enablement (PKE) Interoperability testing
4) STIG compliant per Letter of Instruction GS4-LOI 07-04
6. BEST VALUE DETERMINATION:
By placing an order against a schedule contract using the procedures in 8.405, DITCO has concluded that the order represents the best value (as defined in FAR 2.101) and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government's needs. Although GSA has already negotiated fair and reasonable pricing, the Contracting Officer will make a determination and finding that the prices are fair and reasonable based on solicited quotes received, comparison of negotiated prices, and a comparison of the Independent Government Cost Estimate (IGCE). Discounts from DoD ESI BPA pricing which has previously been determined to provide the Government with pricing advantages will be sought prior to award. Additional discounts will be sought.
7. MARKET RESEARCH:
a. Market research was conducted by Marie Billett for the CSD Enterprise Services Center group starting in 2009 through the summer of 2010. The methods used for the market research included historical information, Internet, other Government users, and vendor sites.
b. The first step taken in conducting market research in support of the Enterprise email requirement was to determine if other than Microsoft products would meet the Government’s requirement. Market research determined that no other software product was available that works with DISA’s current email system. The Microsoft suite of software for Exchange 2010 enables users full mailbox, calendar, and public folder support, including compatibility with other Microsoft native tools, as well as functionality with security and monitoring. No other known software can provide this solution within DISA’s architecture.
c. Once the determination was made that no other software product would meet the Government’s requirement the research focused on procuring the product. Information was gathered from vendor websites, previous acquisitions, and the GSA E-Library. The market research revealed that the Microsoft Exchange 2010 software is available from DoD ESI BPA holders. Authorized Microsoft resellers holding a DoD ESI BPA include CDW-G, Dell, GovConnection, GTSI, HP, Insight, SoftChoice, Softmart, and SHI.
8. ANY OTHER SUPPORTING FACTS.
DISA CSD is acting as the e-mail service provider host for all of DoD to obtain a single consolidated email solution. The implementation of this project is being funded by the initial email solution customer, which is the Army.
The Army’s investment cost for 800,000 Microsoft CORE Client Access Licenses (CALs) required for Exchange access at $14.6M will be lost if these CALs can’t be reutilized for this project. Therefore, spending $2.2M for additional software is the most cost effective solution for the architecture expansion. There is no other viable alternative to Microsoft at this time for scalability and security reasons. It is the most cost beneficial software to utilize for this solution given the initial investments already made by DoD customers for Exchange CORE CALs and Exchange licenses already purchased and available for transfer to DISA CSD.
9. ACTIONS TAKEN TO REMOVE BARRIERS TO COMPEITION:
In an effort to obtain competition of the Microsoft products we encourage and support soliciting quotes from the resellers of Microsoft products on the DoD ESI BPA. The only requirement is that the vendor be an authorized reseller of the Microsoft products on the DoD ESI BPA. To satisfy this requirement, a Request for Quote will be posted on the GSA E-buy Website for each purchase against this J&A. The Government will continue to search the marketplace. If the Government determines that Microsoft is no longer required, then the Government will seek competition for the required functionality. If similar requirements arise every effort will be made to compete it to the maximum extent practicable.
Prior to initiating this request for a Class J&A, a brand name J&A was approved to procure Microsoft 2010 for DECC Oklahoma and DECC Columbus. The procurement was competed amongst the DoD ESI BPA Microsoft resellers. The award was made to Insight Public Sector, Inc, a large business, against their DoD ESI BPA N00104 N00104-02-A-ZE82, delivery order KH12, for a total amount of $509,444.12. The Period of performance is 07 December 2010 through 06 December 2011.
