RFQ 19PE5026Q0006 - Janitor Services for INL (G-08)

Answers to questions against the solicitation 19PE5026Q0006

1. Question: Our firm is an LLC in the United States. Further, the company owner also has a Peruvian equivalent, Clean Concept SAC, which was established in 2021 and has been doing business in Peru since then. In this case, would you recommend sending our quotation under our US firm or Peruvian firm, or would it not make a difference, for that matter?

Answer: Section 3 of the solicitation requires offerors to demonstrate their ability to perform, including evidence of an established business with a permanent address and telephone listing in Lima, Peru, as well as relevant local experience and resources (Section 3, A.2(2), (4), (5)). Submitting your quotation under the Peruvian firm (Clean Concept SAC) may better satisfy these requirements, as it demonstrates local presence, experience, and compliance with Peruvian regulations. However, both US and Peruvian firms are eligible to submit, but the Peruvian entity may be more competitive for local performance criteria.

2. Question: We understand that, according to clause 1.1 of the RFQ, value-added tax is priced separately, and according to page 30, there is a 2% tax withholding for foreign companies, unless exempted. If we bid under our LLC company, would we be exempt from the 2% tax? Apart from this, are there any other additional taxes that we should consider, whether bidding as an SAC or LLC? Would the contract be subject to any other US or Peruvian tax regulations?

Answer: If you bid under your US LLC, you may be subject to a 2% tax withholding on payments as required by FAR 52.229-12, unless you qualify for an exemption and submit IRS Form W-14; your business should be aware of such exemption and ensure proper documentation (Section 5, p.

77). Value-added tax (VAT) is always priced separately and applies per Peruvian law (Section 1.1, p. 5). If you bid as a Peruvian SAC, local Peruvian tax regulations, including VAT and any other applicable local taxes, will apply. All offerors must comply with relevant US and Peruvian tax laws as applicable to their business status and location

3. Question: What are the wage requirements for this contract? Do prevailing wages, or any other form of US wage determination, apply? Is the contract subject to any wage requirements based on Peruvian law?

Answer: Prevailing US wage determinations do not apply. The contractor must comply with Peruvian labor law and wage requirements (see Section1/

8.2 of the solicitation)

4. Question: Can the cleaners be of Peruvian nationality and reside in Peru?

Do cleaners have to be US citizens?

Answer: Cleaners may be Peruvian nationals residing in Peru. There is no requirement for cleaners to be US citizens (see Section 1.5, 4.4)

5. Question: Is subcontracting allowed for this contract? In other words, is the main awarded contractor allowed subcontract to subcontract some of its operations?

Answer: Subcontracting is allowed, provided the prime contractor remains responsible for all contract requirements (see FAR 52.244-6, inserted the solicitation)

6. Question: Can you please break down all the different types of insurance requirements? Our understanding is that we must provide evidence of the company's liability insurance and obtain DBA insurance. Is there any Peruvian insurance requirement, or does the DBA premium cover that?

Answer: Required insurance includes general liability, workers’ compensation (as applicable), and any insurances required by Peruvian law, such as the SCTR (Sp. Seguro Complementario de Trabajo de Riesgo). DBA insurance is not required for this contract (see Section 3, 52.228-4, 52.228-5)

7. Question: When referring to water bottles and dispensers in section 2.7, is the contractor expected to provide the containers themselves and refill the containers, or just to replace and clean empty containers?

Answer: The Government will provide the water bottles and dispensers. The contractor is responsible for replacing empty water bottles and cleaning the dispensers, including trays where water can collect and dusting the rear coils, to ensure proper hygiene and maintenance.

8. Question: For sections 2.6, 2.8, 2.9, 2.10, 2.11, 2.12, and 2.13, what is the required frequency of cleaning for the referenced tasks?

Answer: Please refer to section 8.0

9. Question: For areas that require daily window cleaning, is it only interior cleaning?

Answer: Interior and exterior cleaning

10. Question: Section 2.18 on page 8 states that deodorizer recharge is to be done monthly, while page 17 under "Other Duties to be Performed" states every 15 days. What is the correct frequency of this task?

Answer: Currently we have a main recharge performed by a subcontractor, and they leave product for another recharge which is done by our cleaning operators 15 days after. That’s why this has been included in their duties.

11. Question: Can you please provide more details on section 2.14? What type of vehicles are these? Is only exterior cleaning required? Must not all 6 vehicles be washed on the same day? Any other information you have regarding the cleaning of these vehicles is also appreciated.

Answer: These are six vehicles (two Toyota Hilux Pickup, one Chevrolet Express Van, one Chevrolet Silverado Truck, one Chevrolet Colorado Pickup and one Toyota Fortuner SUV) we require that cleaning operators wash the cars externally and internally. See sector 8.0 of Section I

12. Question: In addition to cleaning materials, are consumables also expected to be provided by the contractor and to be included in the pricing quotation?

Answer: Yes, the contractor must provide all cleaning materials and consumables (e.g., paper towels, soap, deodorizers) as listed in the SOW and include them in the price (see Section 1, sector 4.0, Materials and Equipment)

13. Question: May you please provide both the allocated monthly budget and total yearly budget for this contract, both for the base 12-month contract and the 1-year renewal option, as separate amounts?

Answer: The solicitation does not disclose the allocated budget. Offerors must propose their own pricing. The government will award the lowest-priced, technically acceptable offer (see Section 1.3, 4.0)

14. Question: Will a lift be provided for the biannual cleaning of the hangar's walls and windows?

Answer: No

15. Question: What are the dimensions of the hangar's walls to be cleaned, including height and perimeter of all the walls?

Answer: 650 m2 approx..

Answer; Yes, the expected lead time for this new clearance should be 5 days.

17. Question: In addition to the industrial vacuum cleaners, will high-power materials such as those that may be needed for powerwashing purposes be provided?

Answer: Yes

18. Question: According to DOSAR 652.242-73, which exact licenses and permits are required for this contract in addition to workers' compensation insurance and DBA? What local permits would be required?

Answer: Contractors must obtain all licenses and permits required by Peruvian law, including business registration and any local labor/safety permits (see DOSAR 652.242-73, Section 8.0), DBA insurance is not applicable to this contract.

19. Question: Pages 4 & 5 only have a pricing table for the standard services (a) and total sum (b). To clarify, do temporary additional services refer specifically to the bi-yearly cleaning items? If so, how should we price these? Should it be separated by hangar window and wall cleaning, and deep carpet cleaning of the offices, or all in one lump sum?

Answer: All in one lump sum

20. Question: What is the current janitorial company?

Answer: Famall Group S.A.C, under PO19PE5025P0337

21. Question: Will the Government accept insurance coverage issued by a U.S.-based insurer, or must all required insurance be issued locally?

Answer: The solicitation does not provide for automatic price adjustments due to changes in the statutory Minimum Living Wage (Remuneración Mínima Vital – RMV) during contract performance. The contract is awarded at a firm-fixed price for the period of performance. Any request for price adjustment due to regulatory changes would require review and approval by the Contracting Officer and must be supported by relevant documentation.

Contractors are responsible for complying with all local labor laws, including wage regulations (see Section 8.2)

24. Question: With regard to the personnel assigned to perform the services, is compensation required to be based strictly on the statutory Minimum Living Wage, or may offerors propose wages above this minimum at their discretion?

Answer: Offerors are required to comply with all local labor laws, including paying at least the statutory Minimum Living Wage (Remuneración Mínima Vital – RMV). However, offerors may propose wages above this minimum at their discretion, provided all other contract requirements are met (see Section 8.2)
