About this file
This document is a Justification for Other Than Full and Open Competition (JOFOC) that supports up to an additional 3 months of services for the Environmental Protection Agency's (EPA) Engines and Vehicles - Compliance Information System (EV-CIS) under a new delivery order from the previous Alliant GWAC contract. The EPA is seeking to sole-source this 3-month bridge contract to the incumbent provider, General Dynamics Information Technology, Inc., to prevent a lapse in critical services while the follow-on contract is negotiated and awarded. The JOFOC cites the incumbent's unique qualifications and access to information required to successfully perform the work, which includes software development, code maintenance, and help desk support for the EV-CIS system that supports EPA compliance with the Clean Air Act, Energy Policy and Conservation Act, and Motor Vehicle Information and Cost Savings Act. The total estimated value of this 3-month bridge contract is $750,000.

UNITED STATES ENVIRONMENTAL PROTECTION AGENCY
Washington, DC 20460
OFFICE OF
ACQUISITION
SOLUTIONS
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
Upon the basis of the following justification, I, as Contracting Officer, hereby recommend the use of other than full and open competition for the proposed contractual action pursuant to the authority of Federal Acquisition Regulation (FAR) Subpart 6.302-1 “Only one responsible Source.”
l. Agency and Contracting Activity:
Contracting Office:
United States Environmental Protection Agency (EPA) Office of Acquisition Solutions (OAS) 1300 Pennsylvania Ave NW Washington, DC 20004
Project Office:
Office of Transportation and Air Quality (OTAQ) Compliance Division 2000 Traverwood Drive Ann Arbor, MI 48105
2. Nature/Description of Action(s):
This justification for other than full and open competition (JOFOC) supports up to an additional 3 months of services that will fall under a new award from previous delivery task order, 47QTCK18D0003/68HERH24F0267 to provide EPA’s Engines and Vehicles – Compliance Information System (EV-CIS) as described in the Statement of Objectives (SOO). This delivery is associated with an Alliant GWAC contract that states the following:
“The term for each Order placed under the Basic Contract shall be specified in the individual Order.
Under no circumstances may an Order be placed under the Basic Contract if the Basic Contract has expired, or has been terminated or cancelled by the Government. No Orders may exceed ten (10) years, inclusive of options, from the date that the Order is placed; however, no Orders may extend more than five (5) years after the expiration of the Basic Contract. Order options, if included at initial issuance of the Order, may be exercised after the expiration date of the Basic Contract. Notwithstanding anything to the contrary above, a multi-year Order placed under the Basic Contract must be consistent with FAR Subpart 17.1 and any applicable funding restrictions.”
The Alliant GWAC contract ordering period ended on April 30, 2024, and all task orders were to be completed by April 30, 2024. A bridge was put in place of the existing GWAC expiration that ends October 31, 2024.
This will result in a new delivery order to the new Alliant 2 GWAC (47QTCK18D0003) for up to three (3) months in services on a sole source basis. The purpose of this document is to justify the need to issue an award for three (3) months to prevent a lapse in services of essential tasks while the new contract is negotiated and awarded. Currently the Agency is in the process of processing the follow-on requirement.
3. Description of Supplies/Services:
During this Extension, General Dynamics Information Technology, Inc. shall continue to provide EPA Information Technology Services support for the Engines and Vehicles Compliance Information System (EV-CIS) of the Compliance Division (CD), Data Analysis and Information Center (DAIC), Office of Transportation and Air Quality (OTAQ) located in Washington D.C., in accordance with the current contract SOO and associated Attachments. The Task Order, 47QTCK18D0003/68HERH24F0267 provides Information Technology Services support to the Engines and Vehicles Compliance Programs of the Office of Transportation and Air Quality. These services include, but are not limited to, software development, code maintenance, software technology innovation, and help desk services, with an emphasis on Agile software practices.
Continued contractual support is required to maintain ongoing activities under the requirements of the Clean Air Act. These activities will ensure the manufacturer’s continued compliance with regulations concerning motor vehicles and engine emissions and fuel economy performance.
Proposed Contractor:
General Dynamics Information Technology, Inc.
Attn: Riley Spradlin 3150 Fairview Park Dr Ste 100 Falls Church VA 220424504
4. Identification of Statutory Authority:
The basis for this recommendation is FAR Subpart 6.302-1 only one responsible source and no other supplies or services will satisfy agency requirements. This document contains sufficient facts and rationale to justify the use of FAR 6.302-1 as the authority for this action.
5. Demonstration of Contractor's Unique Qualifications:
No other contractor has access to the information about each task that General Dynamics Information Technology, Inc. performed during this order's last Option Period. Awarding this contract to any other contractor would lead to unacceptable delays and duplication of costs. No other contractor is in the position to begin performance in a timely manner to provide adequate services for this short period of performance. It is in the best interest of the government to put this order extension in place and approve the bridge JOFOC to avoid a lapse of these critical services until a follow-on order can be negotiated and awarded. Specifically, General Dynamics Information Technology, Inc. has the unique qualifications required by this Task Order.
These necessary services provide information technology services to support to CD’s Engines and Vehicles Compliance Information System (EV-CIS). The U.S. Environmental Protection Agency's Office of Transportation and Air Quality (OTAQ), Compliance Division (CD), is responsible for developing, implementing, and determining manufacturer’s compliance with regulations concerning motor vehicle and engine emissions and fuel economy performance. Laws governing these regulations include Title II of the Clean Air Act (CAA), the Energy Policy and Conservation Act (EPCA), and the Motor Vehicle Information and Cost Savings Act (MVICSA). General Dynamics Information Technology, Inc. is uniquely positioned with requisite labor expertise and personnel access to successfully perform the work required by providing support for critical Agency information technology services such as consulting, architecture planning, code development, code maintenance, end user support, and task order management. General Dynamics directly supports EPA’s efforts related to 40 CFR Part 86, the Clear Air Act, and OTAQ’s Engines and Vehicles - Compliance Information System (EV-CIS). EV-CIS is required to support the implementation of the above stated regulations.
General Dynamics Information Technology, Inc. additionally, presents the least risk in obtaining these services to support program implementation and compliance assistance activities. This includes tracking and maintaining incoming requests from stakeholders, managing the helpdesk and assisting with outreach and implementation of systems, new activities to support the development and application of creative, innovative solutions that enhance evaluation, oversight, of the EPA’s Compliance Information System and implementation of the above stated regulations.
Without Contractor support, EPA will be in non-compliance with 40 CFR Part 86 and Title II of the Clean Air Act (CAA), the Energy Policy and Conservation Act (EPCA), and the Motor Vehicle Information and Cost Savings Act (MVICSA). OTAQ’s Engines and Vehicles - Compliance Information System (EV-CIS) supports the implementation of the above stated regulations.
Government-wide Point of Entry (GPE)/SAM.gov Announcement/Potential Sources:
A notice of intent to issue a sole source award will be publicized to the Government point of entry (GPE) as required by Subpart 5.2.
6. Determination of Fair and Reasonable Cost:
The anticipated cost to the Government is determined to be fair and reasonable by the Contracting Officer for these three (3) months. The proposed not-to-exceed value for the new order is $750,000.00. The rates and cost estimates for the current extension were the same as the delivery order 47QTCK18D0003/68HERH24F0267, which were deemed fair and reasonable during the current order extension.
7. Description of Market Research:
Market research was conducted by posting an RFI on GSA eBuy to see if any small business can do the work. We’ve received 2 responses that were from the incumbent and another Large Business. It was determined that although we were seeking small business that the two large whom submitted their capability statement did not fit the ask. No additional market research was conducted for this three (3) month JOFOC/extension request for the reasons of mission-critical work as stated in item 5 in this justification.
Based on the information found in item 5 of this document, it is not reasonable to believe that any other contractor could take over and provide the EPA’s Engines and Vehicles - Compliance Information System (EV-CIS) services required in the three (3) month extension. Therefore, a sole source delivery order under the new Alliant 2 GWAC is the only responsible way to meet this critical EPA requirement.
8. Any Other Supporting Facts:
None at this time.
9. Listing of Interested Sources:
No additional sources are known.
10. Actions Taken to Remove Barriers to Competition:
An Advanced Acquisition Planning (APP) package, beginning the process of a follow-on order award, has been initiated by the program office and forwarded to the Office Acquisition Solutions (OAS) Headquarters Acquisition Division (HQAD). The Request for Quote (RFQ) is being drafted, and the solicitation is projected to be posted by the end of October 2024.
This (3) three-month bridge contract of services under the new Alliant 2 GWAC will provide for EPA’s Engines and Vehicles - Compliance Information System (EV-CIS) in Washington, DC, as described in the order’s SOO, should allow HQAD sufficient time to award a follow-on order in accordance with the FAR.
11. Statement of Delivery Requirements:
This three (3) month extension will extend the order from November 1, 2024, to January 31, 2024.
12. Total Estimated Dollar Value of the Acquisition Covered by this J&A:
The total Time and Materials (T&M) are not to exceed the value of the current order of 1,540,424.03. The total estimated value of this three (3) month extension for the new delivery order from November 1, 2024, to January 31, 2024, is $750,000.00. The total value of the new order will be $750,000.00.
