FEDERAL BUREAU OF INVESTIGATION
FINANCE DIVISION | PROCUREMENT SECTION
JUSTIFICATION
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION IN ACCORDANCE WITH
AUTHORITY 41 U.S.C. 3304 (A) (1)
Requisition Number: DJF-17-0700-PR-0005102
Date: 01/13/2017
Estimated Contract Dollar Value: $143,479.80
1. Identification of the agency and contracting activity.
The U.S. Department of Justice, Federal Bureau of Investigation, Science and Technology
Contracts Unit, has prepared this justification for other than full and open competition for the upgrades and modifications to the FBI’s four (4) existing Teledyne Seabotix Remote Operated
Vehicles (ROV) on behalf of the Evidence Response Team Unit, Laboratory Division.
2. The nature and/or description of the action being approved, i.e., sole source, limited competition, establishment of a new source, etc.
The proposed contract will be a one time, firm fixed price, sole source contract to Teledyne
Seabotix, Inc., 2877 Historic Decatur Road, Suite 100, San Diego, CA, 92106.
3. A description of the supplies or services required to meet the agency’s needs.
The Underwater Search and Evidence Response Team (USERT) currently maintains four ROVs in the field, one at each of the following locations, New York, Los Angeles, Miami, and
Washington Field Office. This is a new requirement for FY 2017. These upgrades and improvements will enhance the search and recovery capabilities of the USERT program’s four field ROVs. This upgrade will equip all four ROVs with a rear facing camera, an Altimeter, and a grabber arm. These upgrades and improvements will enhance the search capability; more accurately track the location of the ROV, and allow for the recovery of evidence, which divers cannot reach.
As currently configured the ROVs do not have a rear facing camera, an altimeter, or a grabber arm. The rear facing camera will help the pilots avoid getting the ROV fouled in unseen obstacles, and give the pilot a 360 degree view around the ROV. The altimeter will allow the pilot to know the exact location of the ROV from the seafloor and will greatly enhance the
ROV’s pilot accuracy when using the ROV to search. The altimeter will also provide an exact

The grabber arm and attachments will allow the ROV to recover evidence that a diver would not be otherwise able to recover due to depth or environmental conditions. These modifications will enhance the ability of the ROV to conduct searches and increase the ROV’s lifting capability in recovery operations.
This modification will allow the USERT to accomplish its mission of conducting forensic searches to locate, document and recover evidence underwater in support of local, state, federal, tribal and international investigations.
4. The statutory authority permitting other than full and open competition.
The statutory authority permitting other than full and open competition is 41 U.S.C. 3304(a)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1entitled, “Only
One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”
5. Demonstrate the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority.
Teledyne Seabotix is the only vendor that can conduct this type of upgrade and modification as they are the builder of the original ROV. The requested upgrades will need to operate with the
ROV main computer, console and video software. Since the original existing system was designed by Seabotix they are the only company able to make the upgrades compatible with the ROVs.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.
The FBI will publicize this requirement on the Federal Business Opportunities website. This announcement will give the opportunity for other vendors to demonstrate their ability to meet the FBI’s specific needs through a submission of technical capabilities and cost information.
7. The anticipated dollar value of the proposed acquisition, including options if applicable, and a determination by the Contracting Officer that the anticipated cost to the
Government will be fair and reasonable.
Before awarding a contract, the Contracting Officer will perform a price analysis in accordance with FAR 15-804-2 (a)-(e).
8. A description of the market research conducted and the results.
Market research was conducted by contacting industry experts and conducting internet research.
It was determined that Seabotix is the only vendor that can perform the required upgrades to maintain compatibility to operate the ROV main computer, console and video software as they are the manufacturer of existing ROV’s.
9. Any other facts supporting the use of other than full and open competition.

A synopsis will be posted on the Federal Business Opportunities website requesting that parties express their interest in writing to the Contracting Officer.
11. A statement of any actions the agency may take to remove or overcome any barriers to competition, if subsequent acquisitions are anticipated.
USERT will continue to monitor the market for vendors capable of conducting this upgrade and modification.
