DESCRIPTION/SPECIFICATIONS/WORK STATEMENT
Statement of Work for
Technical (Engineering) American Sign Language (ASL) Interpreter Services
1.0 Background: The Combat Capabilities Development Command Armament Center (DEVCOM-AC) Benet Laboratories requires
Interpreter services to enhance communications with a Hearing Impaired/Deaf employee.
2.0 Scope: The scope of work associated with this contract is to provide in-person technical interpreting ASL services on a weekly basis, two (2) visits per week, 3 hours per visit between one (1) Hearing Impaired/Deaf employee and his current Supervisor (or representative). The schedule will be a set schedule, however due to holidays and such there could be slight changes to it. The contractor will be informed in advance. The interpreter must be familiar with engineering terms. They will review tasks previously assigned to the Hearing Impaired/Deaf employee, answer any questions that have developed since the previous meeting and establish future tasks and associated goals and overall responsibilities. Other topics to discuss will include but not limited to basic chain of command operations within Benet Laboratories to include communications and other items appropriate for the Hearing Impaired/Deaf employees job description and overall responsibilities.
3.0 Performance Requirements: The contractor shall provide technical interpreting services to one hearing impaired employee at Benet Laboratories in Watervliet, NY. The contractor shall not perform any services unless specifically documented in this
Statement of Work.
4.0 Applicable Documents: N/A
5.0 Period of Performance: The period of performance shall be twelve (12) months from the date of contract award with an additional two (2) twelve (12) months option periods.
6.0 Place of Performance: The work shall be conducted at the following location:
6.1 Benet Laboratories, Watervliet Arsenal, Watervliet, NY
6.2 Travel: Travel is anticipated to the following locations: Watervliet Arsenal (1 person, two (2) times per week, three
(3) hours per visit.
7.0 Security Requirements:
7.1 The highest security classification level for this effort is UNCLASSIFIED.
7.2 All program specific data generated shall be marked DISTRIBUTION AUTHORIZED TO THE U. S. GOVERNMENT AGENCIES ONLY FOR
ADMINISTRATIVE AND OPERATIONAL USE. OTHER REQUESTS SHALL BE REFERRED TO DAVID GOLDSTEIN, TECHNICAL POINT OF CONTACT, BLDG 95, FCDD-ACW-

7.3 Non-Disclosure Agreement. A Certificate of Non-Disclosure shall be signed by all contractor employees working under this effort and returned to the COR immediately after task award and upon each subsequent new hire. The contractor shall not release any information or data without the approval of the Government Procuring Contracting Officer. Only U.S. Citizens are authorized to work on this effort. Non-Use and Non-Disclosure Agreement is required. (A001, DI-MGMT-82241)
7.4 Antiterrorism (AT) Level I Training: All contractor employees, including subcontractor employees, requiring access to Department of Defense installations, facilities, or controlled access areas shall complete AT Level I awareness training within 45 calendar days after contract start date or effective date of incorporation of this requirement into the contract, whichever applies and within 12 months prior to travel outside of the US, then annually thereafter. The contractor shall submit certificates of completion for each affected contractor employee and subcontractor employee to the COR (or to the contracting officer, if a COR is not assigned) within
14 calendar days after completion of training by all employees and subcontractor personnel. AT Level I awareness training is available at http://jkodirect.jten.mil/ (A010, DI-MGMT-81862).
7.5 Access and General Protection/Security Policy and Procedures: All contractor employees, including subcontractor employees, shall comply with all installation and facility access and local security policies and procedures (provided by the Government representative), and security/emergency management exercises. The contractor shall also provide all information required for background checks to meet installation access requirements to be accomplished by the installation Provost Marshal Office, Director of Emergency
Services, or Security Office. Contractor workforce must comply with all personal identity verification requirements (CFR clause 52.204-
9, Personal Identity Verification of Contract Personnel) as directed by DoD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in contractor security matters or processes. During FPCONs Charlie and Delta, services/installation access may be discontinued/postponed due to higher threat. Services will resume when FPCON level and or threat is reduced to an acceptable level as determined by the Installation Commander. Contractor personnel working on an installation are required to participate in the Installation Random Antiterrorism Measures Program as directed. Contractors may be subject to and must comply with vehicle searches, wearing of ID badges, etc. Failure to comply with policies and procedures could result in barred access onto the installation.
7.6 iWATCH (See Something, Say Something) Training: iWATCH (See Something, Say Something) Training. All contractor employees, including subcontractor employees, shall receive training and participate in the local iWATCH program (training standards provided by the requiring activity ATO). This locally developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the COR. This training shall be completed within 45 calendar days after contract start date or effective date of incorporation of this requirement into the contract, whichever applies, and then annually thereafter. The contractor shall submit certificates of completion for each affected contractor employee and subcontractor employee to the COR (or to the contracting officer, if a COR is not assigned) within 14 calendar days after completion of training by all employees and subcontractor personnel (A010, DI-MGMT-81862). 7.7 For contractors that do not require CAC, but require access to a DoD facility or installation: Contractor and all associated subcontractor employees shall comply with adjudication standards and procedures using the National Crime Information Center
Interstate Identification Index (NCIC-III) and Terrorist Screening Database (Army Directive 2014-05/AR 190-13); applicable installation, 5 36

facility and area commander installation and facility access and local security policies and procedures (provided by Government representative); or, at outside the continental United States (OCONUS) locations, in accordance with status-of-forces agreements and other theater regulations.

The contractor is subject to compliance with the CCDC Armaments Center Operations Security Plan, per AR 530-1 (or DoDM 5205.02-M),. This
SOP/Plan will specify the government's critical information, why it needs to be protected, where it is located, who is responsible for it, and how to protect it.
7.15 For Contracts That Require OPSEC Training. Per AR 530-1 (or DoDM 5205.02-M), new contractor employees, including subcontractor employees, must complete initial (Level I) OPSEC training within 30 calendar days of reporting for duty and must also complete annual OPSEC awareness training as provided by the appropriately designated OPSEC level II trained OPSEC Officer/Coordinator.

8.0 NON-UNITED STATES (US) CITIZEN EMPLOYEE REQUIREMENT
8.1 US citizens are authorized to work on this contract. Non-US citizens will not be allowed to perform work on contracts or subcontracts involving access (or possible access) to sensitive data, software, or equipment without prior approval from
Headquarters, Army Futures Command.
9.0 NON-PERSONAL SERVICES:
9.1 The Government shall neither supervise Contractor employees nor control the method by which the Contractor performs the required tasks. Such Contractor employees shall be accountable solely to the Contractor who, in turn is responsible to the
Government. Under no circumstances shall the Government assign tasks to, or prepare work schedules for, individual Contractor employees.
It shall be the responsibility of the Contractor to manage its employees and to guard against any actions that are of the nature of personal services or give the perception of personal services. If the Contractor believes that any actions constitute, or are perceived to constitute personal services, it shall be the Contractor's responsibility to notify the Procuring Contracting Officer (PCO) immediately.
9.2 Government - Contractor Relationships:
9.2.1 The Government and the contractor understand and agree that the services to be delivered under this contract by the contractor to the Government are non-personal services and the parties recognize and agree that no employer-employee or master-servant relationships exist or will exist under the contract between the Government and the contractor and/or between the Government and the contractor's employees. It is therefore in the best interest of the Government to afford the parties a full and complete understanding of their respective obligations.
a. Contractor personnel under this contract shall not:
(1) be placed in a position where they are appointed or employed by a Federal Officer, or are under the supervision, direction, or evaluation of a Federal Officer, Military or Civilian.
(2) be placed in a staff or policy making position.
(3) be placed in a position of command, supervision, administration, or control over DA
Military or Civilian personnel, or personnel of other contractors, or become a part of the Government organization.
(4) be used for the purpose of avoiding manpower ceilings or other personnel rules and regulations of DA or the Civil Service Commission.
(5) be used in administration or supervision of military procurement activities.
b. Employee Relationships
(1) The services to be performed under this contract do not require the contractor or its employees to exercise personal judgment and discretion on behalf of the Government, but rather the contractor's employees will act and exercise personal judgment and discretion on behalf of the contractor.

(2) Rules, regulations, directions, and requirements which are issued by command authorities under their responsibility for good order, administration, and security are applicable to all personnel who enter any Government installation, or who travel on Government transportation. This is not to be construed or interpreted to establish any degree of Government control which is inconsistent with a non-personal services contract.
9.2.2 Inherently Government Functions:
9.2.2.1 The Contractor shall not provide inherently governmental functions as defined in FAR 2.101 under this contract.
9.2.3 Combating Trafficking in Persons
9.2.3.1 The Contractor shall establish policies and procedures for ensuring its employees do not engage in or support trafficking in persons or use forced labor in the performance of this contract.

(a) Definitions. As used in this clause--
"Department of Defense Activity Address Code (DoDAAC)" is a six position code that uniquely identifies a unit, activity, or organization.
"Document type" means the type of payment request or receiving report available for creation in Wide Area WorkFlow (WAWF).
"Local processing office (LPO)" is the office responsible for payment certification when payment certification is done external to the entitlement system.
"Payment request" and "receiving report" are defined in the clause at 252.232-7003, Electronic Submission of Payment Requests and
Receiving Reports.
(b) Electronic invoicing. The WAWF system provides the method to electronically process vendor payment requests and receiving reports, as authorized by Defense Federal Acquisition Regulation Supplement (DFARS) 252.232-7003, Electronic Submission of Payment Requests and
Receiving Reports.
(c) WAWF access. To access WAWF, the Contractor shall--
(1) Have a designated electronic business point of contact in the System for Award Management at https://www.sam.gov ; and
(2) Be registered to use WAWF at https://wawf.eb.mil/ following the step-by-step procedures for self-registration available at this
Web site.
(d) WAWF training. The Contractor should follow the training instructions of the WAWF Web-Based Training Course and use the Practice
Training Site before submitting payment requests through WAWF. Both can be accessed by selecting the "Web Based Training" link on the
WAWF home page at https://wawf.eb.mil/ .
(e) WAWF methods of document submission. Document submissions may be via Web entry, Electronic Data Interchange, or File Transfer
Protocol.
(f) WAWF payment instructions. The Contractor shall use the following information when submitting payment requests and receiving reports in WAWF for this contract or task or delivery order:
(1) Document type. The Contractor shall submit payment requests using the following document type(s):
(i) For cost-type line items, including labor-hour or time-and-materials, submit a cost voucher.
(ii) For fixed price line items--
(A) That require shipment of a deliverable, submit the invoice and receiving report specified by the Contracting Officer.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractors directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR
Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may

(a) The Government may extend the term of this contract by written notice to the Contractor within-1-; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least -2- days before the contract expires. The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed -3-.

36 52.204-21 BASIC SAFEGUARDING OF COVERED CONTRACTOR INFORMATION SYSTEMS NOV/2021
(a) Definitions. As used in this clause--
"Covered contractor information system" means an information system that is owned or operated by a contractor that processes, stores, or transmits Federal contract information.
"Federal contract information" means information, not intended for public release, that is provided by or generated for the Government under a contract to develop or deliver a product or service to the Government, but not including information provided by the Government to the public (such as on public Web sites) or simple transactional information, such as necessary to process payments.
"Information" means any communication or representation of knowledge such as facts, data, or opinions, in any medium or form, including textual, numerical, graphic, cartographic, narrative, or audiovisual (Committee on National Security Systems Instruction (CNSSI) 4009).
"Information system" means a discrete set of information resources organized for the collection, processing, maintenance, use, sharing, dissemination, or disposition of information (44 U.S.C. 3502).
"Safeguarding" means measures or controls that are prescribed to protect information systems.
(b) Safeguarding requirements and procedures.
(1) The Contractor shall apply the following basic safeguarding requirements and procedures to protect covered contractor information systems.
