Contractor Invoices

Invoices shall be submitted in arrears; no advance payments will be authorized. Unless otherwise noted, contractors shall submit invoices for payment as follows:

A. If the work performance period cited in the individual contract is 30 days or less, the contractor shall submit an invoice to the government at the end of the performance period. No partial payments are authorized.

B. If the work performance period cited in the individual contract is greater than 30 days partial payments may be authorized on a monthly basis and upon acceptance of the work.

Upon contract closeout for contracts utilizing Simplified Acquisition Procedures (SAP) according to

FAR 13:

(a) If unobligated funds in the amount of $1000 or less remain on the contract, the Contracting Officer (CO) shall issue a unilateral modification for deobligation. The contractor will receive a copy of the modification but will not be required to provide a signature. The CO shall immediately proceed with contract closeout upon completion of the period of performance, receipt and acceptance of supplies or services, and final payment.

(b) If unobligated funds of more than $1000 remain on the contract, the CO shall issue a bilateral modification for deobligation. The contractor will receive a copy of the modification and will be required to provide a signature. (The CO may also request a Release of Claims be completed by the contractor, although not required for contract and orders using SAP procedures.) If the bilateral modification and Release of Claims are not returned to the CO within 60 days, the CO shall release the modification as unilateral and proceed with contract closeout upon completion of the period of performance, receipt and acceptance of supplies or services, and final payment.

452.236-74 Control of Erosion, Sedimentation, and Pollution (NOV 1996)

(a) Operations shall be scheduled and conducted to minimize erosion of soils and to prevent silting and muddying of streams, rivers, irrigation systems, and impoundments (lakes, reservoirs, etc.).

(b) Pollutants such as fuels, lubricants, bitumens, raw sewage, and other harmful materials shall not be discharged on the ground; into or nearby rivers, streams, or impoundments; or into natural or man-made channels. Wash water or waste from concrete or aggregate operations shall not be allowed to enter live streams prior to treatment by filtration, settling, or other means sufficient to reduce the sediment content to not more than that of the stream into which it is discharged.

(c) Mechanized equipment shall not be operated in flowing streams without written approval by the Contracting Officer.

452.237-74 Key Personnel (FEB 1988)

(a) The Contractor shall list key personnel per Statement of Work (SOW) 7.0 Contractor’s Key Personnel.

(b) During the first ninety (90) days of performance, the Contractor shall make no substitutions of key personnel unless the substitution is necessitated by illness, death, or termination of employment. The Contractor shall notify the Contracting Officer within 15 calendar days after the occurrence of any of these events and provide the information required by paragraph (c) below. After the initial 90-day period, the Contractor shall submit the information required by paragraph (c) to the Contracting Officer at least 15 days prior to making any permanent substitutions.

(c) The Contractor shall provide a detailed explanation of the circumstances necessitating the proposed substitutions, complete resumes for the proposed substitutes, and any additional information requested by the Contracting Officer. Proposed substitutes should have comparable qualifications to those of the persons being replaced. The Contracting Officer will notify the Contractor within 15 calendar days after receipt of all required information of the decision on substitutions. The contract will be modified to reflect any approved changes of key personnel.

Provide sufficient information so that the evaluators may make contact with anyone that can verify these experiences. All proposals will be evaluated based on the ability of contractor’s staff, identified to participate in the project, on the following criteria:

1) Demonstrated knowledge and experience in treatment techniques and identification of non-native invasive plant species as specified by the Statement of Work.

2) Demonstration of access to (or ability to purchase) necessary equipment to treat invasives at the intensities identified in the Statement of Work.

3) Demonstrated experience in identification of native plants species, in order to prevent off-target damage during treatments.

4) Demonstrated experience treating and identifying non-native invasive plants of the Central Hardwoods Region.

5) Demonstrated knowledge and experience in timber stand improvement treatments including cut stump herbicide application, particularly in Central Hardwood forests.

6) Demonstrated experience in identifying woody species of Central Hardwood forests in order to remove undesired mesic species.

7) Demonstrated use of using GPS or other equipment to ensure treatments do not occur across ownership boundaries and to track progress.

8) Submitted proposed workplan describing planned timings of treatments and reasoning.

Methodology – 2.5 Performance Confidence Assessment Rating Description

Substantial Confidence

Based on the offeror’s performance record, the government has a high expectation that the offeror will successfully perform the required effort.

Satisfactory Confidence

Based on the offeror’s performance record, the government has an expectation that the offeror will successfully perform the required effort.

Limited Confidence Based on the offeror’s performance record, the government has a low expectation that the offeror will successfully perform the required effort.

No Confidence Based on the offeror’s performance record, the government has no expectation that the offeror will be able to successfully perform the required effort.

Unknown Confidence No performance record is identifiable, or the offeror’s performance record is so sparse that no confidence assessment rating can be reasonably assigned.

Factor 3. Method to Accomplish Work The offeror shall include a description of how they intend to accomplish the work and stay on schedule. This should include a work plan of how personnel and equipment will be utilized and coordinated to complete the work and to satisfy the work requirements to achieve the final product.

Please include crew size, production rates, and ability to schedule work around specified treatment windows. Also, please include when you could start work on this contract. Contractor must also submit information regarding flexibility of a short notice start up with relation to weather conditions and/or col.

Methodology – 2.2 Adjectival Ratings Adjectival Rating Definition Exceptional Quote/Offer contains no deficiencies and fully addresses all aspects of the criteria and demonstrates an excellent approach/solution and understanding of the requirements. Many strengths exist, far outweighing any weaknesses. The highest quality of contract performance is anticipated with very low risk.

Very Good Quote/Offer contains no deficiencies; fully addresses all aspects of the criteria and demonstrates a very effective approach/solution and understanding of the requirements. Some weaknesses may exist;

however, the weaknesses, if any, are outweighed by strengths. A high quality of contract performance is anticipated with low risk.

Satisfactory Quote/Offer contains no deficiencies; addresses all aspects of the criteria and demonstrates an adequate approach/solution and understanding of the requirements. Strengths and weaknesses are offsetting or will have little or no impact on contract performance. A quality contract performance is anticipated with an acceptable amount of risk.

Marginal Quote/Offer may contain deficiencies; fails to address all of the criteria and does not demonstrate an adequate approach/solution or understanding of the requirements. One or more weaknesses exist which are not offset by strengths. Contract performance is anticipated with high risk.

Adjectival Rating Definition Unsatisfactory Quote/Offer contains many deficiencies and does not address all aspects of the criteria and/or does not present evidence demonstrating an adequate approach/solution and understanding of the requirements. Many weaknesses and/or omissions exist creating an unacceptable risk.

Factor 4. Price The Government will evaluate the Offeror’s firm fixed price quote for price reasonableness. Price reasonableness will be established by competition and determined primarily by comparison with other offers submitted. The proposed quote will also be compared with the Independent Government Cost Estimate (IGCE).

(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

52.217-5 Evaluation of Options. (July 1990)

Except when it is determined in accordance with FAR 17.206(b) not to be in the Government’s best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s).

Offerors or quoters are urged and expected to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of contract performance, to the extent that the information is reasonably obtainable. In no event shall failure to

Deficiency A material failure of a Quote/Offer to meet a Government requirement or a combination of significant weaknesses in a Quote/Offer increasing the risk of unsuccessful contract performance to an unacceptable level.
