Introduction—

The mission of the USDA Forest Service (FS) is to sustain the health, diversity, and productivity of the Nation's forests and grasslands to meet the needs of present and future generations. To achieve this the Colville National Forest aims to treat 2,000 acres of invasive plants. This project supports the Colville National Forest Land Management Plan objective to treat 2,000 acres of invasive plants per year. This project will take place on The Newport-Sullivan Lake Ranger District.

Objective—

The objective of this purchase order is to prevent the spread of invasive plants by creating areas free of undesirable plants on the Colville National Forest. The treatment areas include Forest Service roads right of ways, berms on entry way of closed maintenance level 1 (ML-1) roads, and dispersed campground sites located within the Slate Planning area of the Colville National Forest to meet the Forest’s objectives of treating 2,000 acres of invasive plants per year.

Scope of Work—

The purpose of this solicitation is to secure services including all labor, equipment, supervision, transportation, operating supplies, and incidentals necessary for treating invasive plants with herbicides on specific areas on the Colville National Forest. Contractor shall use approved herbicides to treat and kill all invasive plants listed under Attachment 2 – 2024 Washington State Noxious Weed List. All weed control measures shall comply with all herbicide labels and the applicable laws and regulations of the State of Washington as well as the Colville National Forest Forest-wide Invasive Plant Treatment Final Environmental Impact Statement, USDA Forest Service and the 2005 Record of Decision for the Pacific Northwest Region Invasive Plants EIS and the terms, specifications, conditions, and provisions.

Background—

Invasive species (including non-native plants, animals, insects, and pathogens in aquatic and terrestrial habitats) do not threaten the capability of the Forest to provide for the desired conditions described throughout the Colville Land Management Plan. Impacts of invasive species are minimized through an integrated approach that emphasizes prevention, early detection, and timely treatment and includes cooperative management with neighbors within affected watersheds. In cooperation with partners, proactive invasive response plans are prepared, or existing plans reviewed to facilitate rapid response to new invasions.

Type of Contract Contemplated—

A single performance-based, firm-fixed-price (FFP), purchase order will be awarded.

(vii) Date(s) and Place(s) of Delivery and Acceptance/Location

The application environments are located within the east planning zone of the Colville National Forest, on the Newport-Sullivan Lake Ranger District. Areas identified or designated by the Forest Service may be accessible by motorized vehicles or inaccessible with motorized vehicles which may require back-pack spraying.

Authorized Working Days—

Work shall be conducted Monday through Thursday to avoid conflict with the public using the National Forest for recreation opportunities. Treatments will not be conducted during Federally recognized holidays (https://www.opm.gov/policy-data-oversight/pay-leave/federal-holidays/).

Technical Requirements/Tasks

A Daily Spray Report, which includes the “Pesticide Application Records” form and map of application areas, shall be completed by the Contractor. The report will include:

Road numbers, township, range and section(s) where work was completed.

Name of campgrounds, trailheads, dispersed campsites and rock source pit/quarry.

GPS information will be required and recorded in (Universal Transverse Mercator) UTM

NAD 83 projection.

The Contractor shall record GPS locations of plants/treatment areas and submit the records with the location, species, and approximate population density to the Government. The Contractor shall also provide the government with a final report including a map showing the locations of all plants/treatment sites and surveyed sites within 30 days following the completion of treatment.

Approved herbicides shall be applied at the rate recommended on the label or as determined by the 2005 Record of Decision for the Pacific Northwest Region Invasive Plant Program Preventing and Managing Invasive Plants EIS. The Contractor shall also use surfactants spreading agent as per label requirements.

The Contractor shall treat invasive plants by spot/broadcast spray of herbicides with truck and/or ATV/UTV mounted boom units. In addition, the use of backpack spray units where suitable.

Washing of Equipment—

Pollutants such as fuels, lubricants, bitumen, raw sewage, and other harmful materials shall not be discharged on the ground; into or nearby rivers, streams, or impoundments; or into natural or man-made channels. The Contractor shall wash all equipment except for hauling vehicles prior to entering National Forest Land. Remove all soil which could contain invasive plant seeds.

Remove grease and oil from drive mechanisms which would be discharged into the stream when equipment is operating. Prior to transporting equipment to the site, assure that the equipment's hydraulic, lubrication, and fuel systems are free from leaks.

The contractor shall furnish all materials, equipment, labor, supervision, transportation, operating supplies, and incidentals necessary to safely apply herbicides. Application shall be in accordance with the contract specifications, terms, conditions specified on the herbicide label(s), and State of Washington rules and regulations.

The Contractor shall always have an on-site supervisor with the crew when performing work.

The supervisor shall have a current Washington State Commercial Pesticide Applicator's license.

The Contractor shall provide skilled crew members having production experience on this specific type of work described in this contract.

The Contractor shall comply with all applicable OSHA, manufacturer's directions, Washington state and federal requirements for handling herbicide, including storage, transportation, and application.

The type and amount of equipment, supplies (including spill kits), and personnel needed to accomplish the contract work is the responsibility of the Contractor.

All herbicide equipment shall be properly calibrated and inspected by the Contractor. All nozzles shall be kept clean during operation.

The Contractor shall post “Safety Data Sheets" (SDS), on site and made available to workers.

These sheets provide information relating to physical and chemical data, fire or reactivity data, specific health hazard information, spill or leak procedures, instructions for worker hygiene, and special precautions. For more information, reference Special Contract Requirements.

The Contractor shall transport the minimum quantities of herbicide to the field.

The Contractor shall transport and store equipment and chemicals following all state and federal regulations.

The Contractor shall report to the Contracting Officer (CO)/Contracting Officer’s Representative (COR) any details of all exposure incidents, accidents, and worker health complaints, if any occurred.

The Contractor shall provide tools, transportation, and sufficient workforce to complete the contract in the specified time. The Contractor shall also have at all times of contract performance, a properly designated representative that understands and speaks fluent English.

The Quality Control Plan (QCP) must demonstrate how the Contractor will assure quality meets the requirements and specifications of the contract. It shall describe:

• How quality will be monitored to assure the performance standards are met.

• The supervision of crew and work; and

• Personnel that will be performing the quality control.

The Contractor shall keep the COR informed of their progress on a weekly basis. Reports shall be available for inspection by the COR/Government Technical Monitor (GTM) at any time and at a minimum submitted weekly.

Government Quality Assurance Surveillance Plan (QASP)—

The Contractor shall identify the quality control inspection system it will use to ensure that contract specifications will be achieved. At no time shall the contractor rely upon Government inspections to provide notification of unsatisfactory performance. The Contractor shall produce written inspection records in a format and at times and places satisfactory to the CO.

Inspection records shall be made available upon request of the CO and be maintained until the date of contract closure. The CO may observe the Contractor's inspection at any time and shall otherwise have unlimited access to the inspection data.

Government Inspections—

The Government will, at its convenience, make periodic inspections of the work to assure itself of contract compliance and to perform Quality Assurance Inspections to determine and confirm that the Contractor is performing quality control in accordance with its QCP and that Contractor monitoring results in quality performance of contract objectives.

The Government reserves the right to inspect all equipment, material, and supplies prior to starting work for suitability; the decision of the CO as to acceptability shall be final.

Once Application Records are received by the Government, the COR/GTM will visit a few randomly selected spray sites to confirm that pesticides have been properly applied. The following items will be inspected at randomly selected spray sites properly filled out Application Record forms and evidence that pesticides have been applied properly such as dye and/or wilting plants. Contractors will be required to: rework an area at their cost when inspection indicates no herbicides were applied and redo forms not filled out correctly.

The Government will do a visual inspection to make sure the Contractor is in compliance with the specifications and proceeding satisfactory.

Acceptance: Acceptance of the work under the contract will be made after steps have been taken and the CO has made the determination of satisfactory compliance with the specifications.

For acceptance purposes, complete application records or visual inspection shall be satisfactorily completed before acceptance will be made. Acceptance will not be made for segments broken by unacceptable portions of work.

Rework: When inspections indicate that the performance objectives were not met, the work will be deemed unsatisfactory and payment will not be made until the Contractor has assured the Government that its Quality Control measures have corrected the deficiencies. Inspections after rework will be made in the same manner as the first inspection. The cost to the government for inspections necessitated by the rework will be deducted from any payments to the Contractor.

Mixing Standards—

Surfactants spreading agent shall be used in all applications as per label requirements.

Carrier: Water shall be used as a carrier.

Herbicide loading and mixing operations will not occur within 150-feet of any open water source. Equipment cleaning shall be done more than 300-feet from water or private land.

Applicators will mix only those quantities of herbicides that can reasonably be used in a day.

All empty containers will be triple rinsed, be punctured, and disposed of. Disposal of herbicide containers shall be done at approved sites and in accordance with local, state and federal regulations.

Spraying Standards—

Spray drift shall be minimized.

No herbicide application shall take place within 50 feet of streams or wetlands or as label directs around riparian areas.

The Contractor shall minimize damage to non-target vegetation.

The Contractor shall treat all target species with the appropriate herbicide at a rate of application that does not exceed label direction.

Contractor’s activity will not contribute to measurable or noticeable erosion, extensive or localized soil disturbance, or long-term physical damage to desirable vegetation.

The Contractor shall obtain and monitor local weather forecast for the proposed treatment area prior to applying herbicides. Weather conditions will be monitored so that applications comply with label recommendations. Spraying activities shall not occur if precipitation is expected (NOAA weather forecast) within 4 to 6 hours.

Buffer strips may be designated by the Government during operations to protect certain areas where no application of herbicide shall occur. Designation may be verbally, with flagging or identified on maps depending on area being protected. Locations of buffer strips and how they will be identified will be discussed as needed.

Herbicide application operations shall not occur when any one of the following conditions exist in a treatment area:

• Frost, snow, or ice covers brush or target plants.

• Foliage of target plants is wet.

• When wind speeds are more than 10 miles per hour.

Herbicide Application Guidelines (General Application)—

Post all herbicide treated areas with signs provided by Forest Service. Areas that are designated as a special public concern at the pre-work meeting, shall be signed two (2) days prior to treatment.

Work Standards—

The contractor shall exercise care in work methods to prevent unnecessary damage to Non- Target species. Non-Target species is any vegetation that is not listed as a target species.

Mortality and herbicide effects on these species should be less than 10 percent of the individuals encountered within the sites.

All work under this contract shall be performed in a skillful and workmanlike manner. The CO may, in writing, require the Contractor to remove from work any employee the CO deems incompetent, careless, or otherwise objectionable for theft, possession and/or removal of materials, supplies, equipment, or any Government-owned property, or for unsatisfactory performance.

The Contractor shall be responsible for maintaining satisfactory standards of employee competency, conduct, appearance, and integrity, and shall be responsible for taking such disciplinary action with respect to their employees as may be necessary.

The Contractor shall provide appropriate safety equipment for employees. Employees shall be trained in how to use safety equipment, e.g. eyewash bottles.

The contractor shall mark the end of roads and tracks, also isolated populations with white flagging with the initials of the applicator and date with a permanent marker.

Inspection—

A Forest Service inspector will inspect work done. The inspector may be present part time or full time with the applicators. GPS track records and application records will be examined to determine completeness. Accuracy will be determined by visual inspection of treated invasive plants. Target species should show evidence of curling leaves, wilting, discolor etc. Deductions may occur for less than 90% plants treated, incomplete records, or failure to achieve contract requirements.

Government-Furnished Property (GFP)—

The Government will provide the following items listed below in Table 2 of Government property to the Contractor for use in the performance of this contract. This property shall be used and maintained by the Contractor and returned to the COR when the project is completed and accepted.

Access Behind Locked Gates

Some areas may be behind Forest Road closures (locked gates). The Government will provide access through locked gates unless walk-ins. Keys are required to be returned prior to final payment.

Will be posted in treated ‘day areas’, picnic areas, campgrounds, or occupied dispersed camp sites, trailheads near treatment sites and Gravel pit/quarry entrance.

2. Camping permit must be posted or displayed on site (window of camp unit).

3. Firewood may be cut only for camp use.

4. The campsite will not encroach beyond the boundaries designated by the Forest Service. No camp area shall be located within 200 feet of any open water (lake, stream, pond, etc.). No camping shall be permitted within developed recreation sites or along primary recreation roads unless permitted by district recreation specialist.

5. The campsite shall have a clean appearance at all times.

6. Upon abandonment, termination, revocation, or cancellation of this permit, the permittee shall remove within 10 calendar days all structures and improvements except those owned by the United States, and shall restore the site, unless otherwise agreed upon in writing or in this permit.

If the permittee fails to remove all structures or improvements within the 10 calendar days, they shall become the property of the United States, but that will not relieve the permittee of liability for the cost of their removal and restoration of the site.

7. Unless otherwise designated by the Contracting Officer or Sale Administrator, the use of this area is not exclusive and may be granted to other Permittees or recreating public. Disorderly conduct is not permitted.

8. Damaging or removing any natural feature or other property of the Forest Service is prohibited.

9. Servicing of equipment in the campsite is not permitted, unless the campsite is within the project area.

10. Toilet facilities adequate for the capacity of the camp, at not less than a 1: 15 ratio, shall be provided and supplied with adequate toilet paper. Such facilities shall be maintained in a sanitary condition. The toilet must contained and pumped based on use. It must be placed away from streams.

11. Per special forest order, animal resistant containers (vehicle or RV fulfills requirement) shall be provided by the permittee and used for the storage of all food, beverages and attractants as well as garbage when camp is left unattended and at night when sleeping. Human, pet and livestock food (except baled or cubed hay without additives) and garbage shall be stored in animal resistant containers. Burnable attractants (such as food leftovers or bacon grease, etc.) shall not be buried, discarded or burned in an open campfire. Proper storage means attractants are stored: 1) in a hard-sided vehicle; 2) in a bear-resistant food storage locker or garbage can, if provided; 3) in a container certified by the Interagency Grizzly Bear Committee as bear-resistant (approved coolers must be padlocked) or 4) hung at least 10 feet high and 4 feet from any vertical support.

12. Fly-tight, rodent-tight, animal resistant and cleanable containers shall be provided and used for the storage of garbage. Such containers shall be kept clean and emptied when full. All garbage and refuse resulting from this use, including waste materials, garbage, and rubbish of all kinds, shall be disposed of in approved County dump sites unless otherwise agreed in writing.

13. No waste water may be dumped on the ground. (Waste water is all domestic used water other than from toilets.). All trailers will be self-contained and their facilities will be utilized.

14. The permittee shall take all reasonable precautions to prevent and suppress forest fires. No material shall be disposed of by burning in open fires during the closed season established by law or regulation without a written permit from the Forest Service.

15. The permittee must comply with the following fire regulations:

A. A shovel, axe or Pulaski, 10-quart pail, which is full of water for immediate use, and a fire extinguisher with an Underwriters Laboratory (UL) rating of at least 5:BC are required during the fire season.

B. All fire rings or outside fireplaces will be approved by a Forest Service representative.

The area will be cleared down to mineral soil for a distance of one foot outside of the ring and it will not have any overhanging material. Fire rings will be dismantled and material dispersed prior to leaving the site.

C. All generators and other internal combustion engines will be equipped with USFS-approved spark arresters and/or factory designed muffler and exhaust system in good working order. They will be located in a cleared area with same requirements as in B.

D. All fuel storage areas will be approved by a Forest Service representative and be at least 50 feet from flammables.

16. Any violation of these conditions constitutes a Breach of Contract, and may result in revocation of camping approval.

17. The Forest Service reserves the right to terminate this permit at any time.

FIRE PROTECTION AND SUPPRESSION

1. Fire Period and Closed Season

Specific fire prevention measures are listed below and shall be effective for the period April 1 to October 31 of each year. The Forest Service may change the dates of said period by advance written notice if justified by unusual weather or other conditions. Required tools and equipment shall be kept currently in serviceable condition and immediately available for initial attack on fires.

2. Fire Plan

Before starting any operations on the project, the Contractor, Permittee, Licensee, or Purchaser, hereinafter referred to as the “Contractor”, shall prepare a fire plan in cooperation with the Contracting Officer providing for the prevention and control of fires in the project area.

The Contractor shall certify compliance with fire protection and suppression requirements before beginning operations during the fire period and closed season, and shall update such certification when operations change.

3. Substitute Measures

The Contracting Officer may by written notice authorize substitute measures or equipment or may waive specific requirements during periods of low fire danger.

4. Emergency Measures

The Forest Service may require emergency measures, including the necessary shutting down of equipment or portions of operations in the project area during periods of fire emergency created by hazardous climatic conditions.

5. Fire Control

The Contractor shall, independently and in cooperation with the Forest Service, take all reasonable action to prevent and suppress fires in the project area. Independent initial action shall be prompt and shall include the use of all personnel and equipment available in the project area.

For the purpose of fighting forest fires on or in the vicinity of the project which are not caused by the Contractor's operations, the Contractor shall place employees and equipment temporarily at the disposal of the Forest Service. Any individual hired by the Forest Service will be employed in
