INTRODUCTION

1. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, in conjunction with FAR Part 13.5, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested and a written solicitation will not be issued.

2. Solicitation number is NA-AJ5720-22-00390 and is being issued as a Request for Quote (RFQ).

3. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2022-05, effective 03/07/2022.

4. The associated NAICS code is 22115.

5. Responses are due by 9:00 AM EST, August 8, 2022 via email to Emi Sato (emi.sato@noaa.gov) and copy Megan Whipple (megan.whipple@noaa.gov). There will be no exception to the time and date on which responses are due, unless determined otherwise by the Contracting Officer. The quote must be valid for at least 90 days from the date of submission.

PART I – STATEMENT OF WORK

1. STATEMENT OF WORK

A) BACKGROUND AND OBJECTIVES: The mission of the National Oceanic and Atmospheric Administration (NOAA) is to understand and predict changes in climate, weather, oceans, and coasts; to share knowledge and information with others; and to conserve and manage coastal and marine ecosystems and resources. To accomplish its mission, NOAA has established over 700 facility site locations supporting a variety of activities and operations conducted by NOAA personnel across the United States and its territories.

The Office of the Chief Administrative Officer (OCAO) is a major staff office within NOAA with management functions in four major programmatic areas: (1) administrative programs, (2) facilities programs; (3) safety and security programs; and (4) assets. OCAO is chiefly responsible for NOAA-wide technical, programmatic guidance, and staff support to NOAA in the areas of Real Property Management, Logistics Management, Facilities Operations, Civil Rights and Equal Employment Opportunity, and Directives and Administrative Programs.

The Safety and Environmental Compliance Office (SECO) establishes NOAA policy and provides guidance, and oversight in the areas of Environmental Compliance; Safety and Occupational Health; and Energy Management and Sustainability to ensure compliance with regulatory, internal, and other requirements and to drive toward continuous improvement in Safety, Occupational Health, Environment, and Sustainability performance.

NOAA is required to meet certain clean energy and renewable electricity consumption targets. Since NOAA does not have the ability to produce (on-site) the required clean energy and renewable electricity targets, NOAA will purchase Renewable Energy Certificates (RECs), also known as Renewable Energy Credits. The estimated quantity to be purchased is 14,713 MWh or 10% of the FY 2021 consumption which is about 147,129 MWh.

B) SCOPE: The vendor shall provide RECs that meet the requirements as outlined in Federal Renewable Energy Certificate Guide (dated June 16, 2016; published by the Office of Federal Sustainability Council on Environmental Quality). Accordingly, per Section 4 of the Guide, the requirements below are to be met for the RECs provided:

1. Renewable Resource – Electricity must have been generated by solar or wind only.

2. REC Vintage – As consistent with EPA’s Green Power Partnership, electricity must have been produced within a set period before and after the end of a fiscal year for its RECs to be counted toward that fiscal year. Note: For the purposes of this purchase for FY 2022, the electricity associated with the REC must be produced between April 1, 2021, and January 1, 2023.”

3. Placed in Service Date – The renewable generator (e.g., the wind farm or solar array) associated with a purchased REC (bundled with electricity or separate) must have been placed in service no more than 10 years prior to the fiscal year 2022 which is on or after October 1, 2011. Exceptions to this Placed in Service Date requirement are briefly discussed in Section 5.

4. Location – As consistent with EPA’s Green Power Partnership, the renewable generator must be located in the United States, Tribal Land, or U.S. Territories.

5. Bonus Credit:

Federal policy on renewable electricity, a bonus equivalent to doubling the amount of renewable electric energy used or purchased is available for any renewable electric energy that was generated on a Federal facility or on Federal or Tribal land and used at a Federal facility (as demonstrated by RECs, third-party audit, or agency records). Projects that convert renewable fuels, such as biomass, into useful electric energy will be considered on-site projects that can qualify for the bonus if the primary equipment for converting the fuel to usable energy is located on Federal or Indian lands, even if all or a portion of the fuel is delivered from non-Federal lands (see 42 U.S.C. §15852(c)). Note that RECs purchased from projects located on Federal or Tribal lands are not exempt from the Placed in Service Date requirement.

DELIVERY SCHEDULE: The new contract needs to be in place by August 15, 2022.

It is anticipated that a Firm Fixed Price (FFP) contract will result from this solicitation.

PART 2 – Inspection and Acceptance

The Government point of contact (POC) identified in PART 6 will perform inspection and acceptance of parts. Acceptance is communicated in writing, unless otherwise indicated by the Contracting Officer, within 30 days of receipt.

PART 3 – Deliveries or Performance

Satisfactory performance of this order shall be deemed to occur upon delivery of the parts described in PART 1 of this order.

Deliveries required by the contractor shall be made Free on Board (FOB) destination no later than August 15, 2022 to the addresses/addressees listed below.

Unless otherwise specified, deliveries shall be made to the Delivery Location specified above, Monday through Friday (excluding Federal Holidays, see PART 7) between the hours of 8:30 a.m. and 4:30 p.m.

local time only. Supplies or services scheduled for delivery on a Federal holiday shall be made the next business day.

The contractor shall give the Government POC 24 hours’ notice prior to delivery at Rachel.chang@noaa.gov.

b. Invoice Submission

The contractor shall submit an original invoice to Rachel.chang@noaa.gov, megan.whipple@noaa.gov, and emi.sato@noaa.gov.

To avoid delay in processing of payments, please submit all invoices directly to the Government POCs. The POC will certify and forward the invoices to the Finance Office together with a receiving report for payment.

Any invoice that does not include the required information listed below will be sent back to the contractor for revision.

An invoice shall include the following information in order to be considered a proper invoice:

Name and Address of the Contractor;

Invoice date and number;

Contract number, contract line item number and, if applicable, the order number;

Description, quantity, unit of measure, unit price and extended price of the items delivered;

Shipping number and date of shipment, including the bill of lading number and weight of shipment if shipped on government bill of lading;

Terms of any discount for prompt payment offered;

Name and address of official to whom payment is to be sent;

Name, title, and phone number of person to notify in event of defective invoice;

Taxpayer Identification Number (TIN);

Electronic Funds Transfer (EFT) banking information

Note: EFT information shall match the contractor’s registration in the System for Award Management (SAM).

PART 5 – Special Contract Requirements

b. NIST SP 800-53

The contractor shall ensure all data associated with this order is protected from unauthorized access, modification and misuse in accordance with NIST SP 800-53 guidance. The following website provides a copy of this guidance: http://csrc.nist.gov/publications/PubsSPs.html.

c. IT Security

The contractor shall ensure that media sanitization has taken place prior to disposal of any media.

The date and nature of such sanitization procedures should be recorded as required by MP-5 Media Sanitization of the Department of Commerce (DOC) Information Technology Security Policy and Procedures (ITSPP).

Per FAR 39.101(d), the contractor shall comply with the regulations involving NIST common security configuration checklists including Federal Desktop Core Configuration (FDCC) or United States Government Configuration Baseline (USGCB) initiative. The list of common security configurations can be found at http://checklists.nist.gov.

Pre-configured hardware must comply with FAR 39.101(c) regulations for adherence to the NIST SP 800-70 Rev. 3 common security configuration checklist program (https://nvd.nist.gov/ncp/repository).

New hardware must comply with FAR 4.1302 and be capable of being configured to utilize approved, per FAR 4.1302(b) PIV-compliant (https://www.idmanagement.gov/approved-products-list/) smart card authentication components.

In addition, new hardware shall be capable of implementing Internet Protocol Version 6 (IPv6) requirements as required by FAR part 11.002(g). The product must comply with applicable technical capabilities defined in the USGv6 Profile (NIST Special Publication (SP) 500-267) and the corresponding declarations of conformance defined in the USGv6 Test Program. To meet this requirement, vendors and suppliers of IP protocol technology must document their product’s support of the requested capabilities through the USGv6 test program (https://www-x.antd.nist.gov/usgv6/) using the USGv6 Suppliers Declaration of Conformity.

(1) The Comptroller General of the United States, or an authorized representative of the

Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor

Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the

Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
