Interconnection arrangements means arrangements governing the physical connection of two or more networks to allow the use of another's network to hand off traffic where it is ultimately delivered (e.g., connection of a customer of telephone provider A to a customer of telephone company B) or sharing data and other information resources.

52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)

The Government will award a single firm-fixed price IDIQ contract resulting from this solicitation to the responsible quoter whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The evaluation and award are being conducted in accordance with FAR Part 12, Acquisition of Commercial Items, and FAR Subpart 13.5, Simplified Procedures for Certain Commercial Products and Commercial Services.

The Government will utilize a Comparative evaluation process that 1) Compares one quote to another in a uniform and fair manner; 2) Determines which quote best meets the Government needs in terms of technical, past performance and pricing factors. The Government reserves the right not to award to the lowest price quoter.

Quoters that take exception to the terms and conditions of this RFQ may not be considered for award.

The following factors will be used to evaluate the quotation:

Factor 1 – Technical Approach Factor 2 – Past Performance Factor 3 – Price

FACTOR 1: TECHNICAL

Quotes will be first evaluated to determine if the quoter has provided all of the required document(s) listed in the Addendum to 52.212-1, Technical. Quotes that do not include the required documents will be considered unacceptable and ineligible for award.

The Government will evaluate the Technical Submission as acceptable (pass) or unacceptable (fail).

Pass: The quote contains all of the required Technical information indicated in the solicitation, the information submitted does not conflict with the requirements of the Specifications herein that meet or exceed the Government's requirements. The Government will evaluate the quotes to determine whether or not: (1) the quoters capability statement clearly demonstrates an understanding of the requirement; (2) the quoter possesses the required licenses, permit, and registrations or an adequate plan to obtain them before contract award; (3) Proof of registration with the Albo Nazionale Gestori Ambientali - Albo Gestori Ambientali – Sezione Campania. These evaluations will indicate whether or not the quote clearly meets the minimum requirements of the solicitation and has the ability to perform the contract IAW the PWS.

Fail: The quote does not contain all of the required Technical Submission information indicated in the solicitation, and/or the information submitted conflicts with the requirements of the Specifications herein, and/or the proposed items do not meet the Government's requirements.

Note: If the Contracting Officer determines that a vendor's technical submission is unacceptable, that vendor's entire submittal may be determined to be technically unacceptable and may no longer be considered for further competition or award.

FACTOR 2: PAST PERFORMANCE

Past Performance will be evaluated to determine the degree of the Quoter’s reliability and to assess the performance risk associated to this acquisition. Past Performance information will be evaluated as Acceptable or Unacceptable as follows:

Acceptable - Based on the quoter’s performance record, the Government has a reasonable expectation that the quoter will successfully perform the required effort, or the quoter’s performance record is unknown.

Unacceptable - Based on the quoter’s performance record, the Government has no reasonable expectation that the quoter will be able to successfully perform the required effort.

To be eligible for award, the Past Performance shall be Acceptable.

In evaluating past performance the Government may contact some or all of the references provided by the Quoter and may contact other sources of information (including other government personnel associated with the contracts cited), and including but not limited to customers on other contracts the Quoter may have performed, and including electronic databases such as Contractor Performance Assessment Reporting System (CPARS) and the Past Performance Information Retrieval System (PPIRS).

The Government reserves the right to determine the relevancy of such information and to verify statements and representations made in a Quoter’s quote.

In the case of a quoter without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the quoter may not be evaluated favorably or unfavorably on past performance. Therefore, the quoter shall be determined to have unknown past performance. In the context of acceptability/unacceptability, unknown shall be considered acceptable.

FACTOR 3: PRICE

Price Quotes will be evaluated in accordance with FAR 13.106-3. The quoted prices will be analyzed for completeness and a fair and reasonable determination.

A. Completeness: All information/data required by the solicitation has been submitted. In the event the unit price(s) and extended price(s) are ambiguous, the government shall use the indicated unit price(s) for evaluation purposes.

B. Reasonableness: Prices are fully justified, supported and considered fair and reasonable under current market conditions.

For award purposes, the Government will select the quote which best meets its needs considering price and technical capability in determining the best value; and therefore may not award to the lowest price if a higher priced quote is determined to provide the best value.
