FAR Provision 52.212-1, Instructions to Offerors – Commercial Items (September 2023) applies to this acquisition and the following addendum applies: The Government will award a contract resulting from the solicitation to the responsible offeror whose offer conforming to the solicitation will be the most advantageous to the Government.

Evaluation and Award Criteria The Government will review all quotes for compliance with the RFQ, to include compliance with all instructions, provisions and clauses, and submission dates.

The compliant quotes will then be evaluated using a Lowest Price Technically Acceptable (LPTA) approach in accordance with the following factors:

• Factor 1: Technical

• Factor 2: Price

Technical Acceptability: The Government will evaluate quotes for technical acceptability in the following way:

Verification that quotes include the correct quantity, part number and description/configuration and meets the salient characteristics listed in Attachment 1 – Specifications.

Definition: Acceptable or Unacceptable.

• Acceptable is defined as the quote clearly meets the requirements of the solicitation (in terms of quantity, part number and description).

• Unacceptable is defined as the quote does not clearly meet the requirements of the solicitation (in terms of quantity, part number and description).

AWARD PROCESS:

The Government will first review all quotes for compliance and then order the Offerors from lowest to highest total price.

The lowest priced quote will then be evaluated for Factor 1, Technical Acceptability on acceptable/unacceptable basis. If the lowest priced quote is deemed technically acceptable the evaluation will stop and award will be made. If the lowest priced quote is deemed technically unacceptable no further consideration will be given to that offeror and the next lowest priced quote will then be evaluated, the Government will continue the evaluation process until reaching a technically acceptable quote. Quotes that are technically unacceptable are un-awardable. The Government reserves the right to award without exchanges. Prior to award, the quoted price of the lowest priced technically acceptable offer will not be evaluated for fairness and reasonableness in accordance FAR 8.404(d) - "Supplies offered on the schedule are listed at fixed prices, GSA has already determined the prices of supplies and fixed-price services, and rates for services offered at hourly rates, under schedule contracts to be fair and reasonable. Therefore, ordering activities are not required to make a separate determination of fair and reasonable pricing, except for a price evaluation as required by 8.405-1. By placing an order against a schedule contract using the procedures in 8.405, the ordering activity has concluded that the order represents the best value."

Conversations: The government intends to award a delivery order without conversations with respective vendors. The Government, however, reserves the right to conduct conversations if deemed in its best interest of the Government.

The Government may conduct conversations with one, some, none, or all Vendors at its discretion.

The lowest priced responsible Offeror who is technically acceptable will receive the award. The award will be made to that Offeror without further consideration to any other Offerors.

Note: The vendor acknowledges that should the quote terms and conditions and/or agreement conflict with mandatory provisions of the Federal Acquisition Regulation (FAR) and other Federal law applicable to commercial acquisitions, to the extent of such conflict the FAR and Federal law govern and conflicting vendor terms and conditions and/or agreement are unenforceable and are not considered incorporated into any resultant contract. All FAR clauses in the basic GSA 2GIT schedule are applicable to this solicitation and subject delivery order.
