Please read the enclosed document carefully.
Quotes must be received no later than the date and time specified on the face of the RFQ-DTD-FY2025-003 and in section D. Key Action Dates.
I. GENERAL INFORMATION
A. BACKGROUND AND PURPOSE
The Fish and Game Commission (Commission) requires the services of a Contractor to provide audio/visual (AV) support, audio and video production, live webcasting (live streaming via the Internet), and technical support for both in-person and virtual meetings; hosting of online audio and video records; and preparation of online and flash drive archive copies with closed-captioning.
The Commission staff hold at least six (6) commission meetings per year. Meetings may be held in-person at various locations around the State, may include a Zoom Webinar component (hybrid meeting), or may be held fully on Zoom.
The period of performance for this contract is approximately two years with the option for two (2) one (1) year extensions at the contracted price. The current budget allocation to support the services outlined in this document is $212,000.00.
B. AVAILABILITY
The selected contractor must be able to meet the requirements of this RFQ-DTD-FY2025-003 and be ready to begin work by May 15, 2026. If personnel offered by the selected contractor leave the contractor’s firm or are otherwise unable to participate in this contract, they must be replaced with comparably qualified employees who meet the minimum qualifications as stated within this RFQ. All replacement personnel are subject to approval by the State.
C. PERIOD OF PERFORMANCE
The term of this Agreement begins once the contract is fully executed, anticipated May 15, 2026 through May 14, 2028 with the option for the State to extend the term for up to two years with two (2) one (1) year extensions at the rates specified in Attachment 3 Cost Sheet that includes optional costs for optional extensions to the contract. The period of performance must be changed by a written Amendment to the Agreement, if CDFW exercises its option to extend services.
The contractor shall not be authorized to deliver or commence performance of services as described in the SOW until written approval has been obtained from all entities. No delivery or performance of service may commence prior to the execution of the Agreement.
D. KEY ACTION DATES
Listed below are the key action dates and times by which the actions must be taken or completed. If the State finds it necessary to change any of these dates, it will be accomplished via an addendum to this RFQ-DTD-FY2025-003.

| DARFUR CONTRACTING ACT CERTIFICATION |
Effective January 1, 2009, all Invitations for Bid (IFB) or Requests for Proposals (RFP) for goods or services must address the requirements of the Darfur Contracting Act of 2008 (Act). (Public Contract Code sections 10475, et seq.; Stats. 2008, Ch. 272). The Act was passed by the California Legislature and signed into law by the Governor to preclude State agencies generally from contracting with “scrutinized” companies that do business in the African nation of Sudan (of which the Darfur region is a part), for the reasons described in Public Contract Code section 10475.
A scrutinized company is a company doing business in Sudan as defined in Public Contract Code section 10476. Scrutinized companies are ineligible to, and cannot, bid on or submit a proposal for a contract with a State agency for goods or services. (Public Contract Code section 10477(a)).
Therefore, Public Contract Code section 10478 (a) requires a company that currently has (or within the previous three years has had) business activities or other operations outside of the United States to certify that it is not a “scrutinized” company when it submits a bid or proposal to a State agency. (See #1 on the Attachment).
A scrutinized company may still, however, submit a bid or proposal for a contract with a State agency for goods or services if the company first obtains permission from the Department of General Services (DGS) according to the criteria set forth in Public Contract Code section 10477(b).
The Darfur Contracting Act form can be located at:
https://www.documents.dgs.ca.gov/dgs/FMC/GS/PD/PD_1.pdf
DECLARATION FORMS
1. BIDDER DECLARATION (GSPD-05-105)
All Bidders must complete the Bidder Declaration form and include it with the bid response. When completing the declaration, Bidders must identify all subcontractors proposed for participation in the contract. Bidders awarded an Agreement are contractually obligated to use the subcontractors for the corresponding work identified, unless the State agrees to a substitution, and it is incorporated by amendment to the Agreement. The Bidder Declaration (GSPD-05-105) form can be located at:
https://www.documents.dgs.ca.gov/dgs/fmc/gs/pd/gspd05-105.pdf
2. DISABLED VETERAN BUSINESS ENTERPRISE DECLARATIONS (STD 843)
Bidders who have been certified by the State of California as a DVBE (or who are bidding rental equipment and have obtained the participation of Subcontractors certified by the State of California as a DVBE) must also submit a completed Disabled Veteran Business Enterprise Declaration form. All disabled veteran owners and disabled veteran managers of the DVBE(s) must sign the form(s). The completed form should be included with the bid response. The Disabled Veteran Business Enterprise Declarations (STD 843) can be located at:
https://www.documents.dgs.ca.gov/dgs/fmc/gs/pd/pd_843.pdf At the State’s option prior to award, Bidders may be required to submit additional written clarifying information. Failure to submit the requested written information as specified may be grounds for quote rejection.
DISABLED VETERAN BUSINESS ENTERPRISE (DVBE) PROGRAM REQUIREMENTS AND DVBE INCENTIVE:
For the purposes of this solicitation, the Disabled Veteran Business Enterprises (DVBE) participation requirement has been waived.
This solicitation provides an incentive for DVBE participation.
In accordance with Military and Veterans Code §999.5(a), an incentive will be given to all Bidders who exceed the three percent (3%) DVBE mandatory participation. For Contract award evaluation purposes only, the State shall apply the incentive amount based on the amount of DVBE participation obtained above the three percent (3%) requirement. The incentive is only given to those Bidders who are responsive to the DVBE program requirement and propose DVBE participation in the resulting Contract that exceeds the mandatory three percent (3%) requirement. If the Bidder is claiming a DVBE incentive, the Bidder must complete the Bidder Declaration GSPD-05-105 form (Attachment 14), the DVBE Declaration (STD 843) (Attachment 15) for each DVBE, and Bidding Preferences and Incentives (Attachment 20) if applicable, and submit with their Final bid. If the Bidder is not using subcontractors, the Bidder is still required to complete Attachment 14 Bidder Declaration GSPD-05-105 form, answering the applicable questions on the form and submit with final bid.
SMALL BUSINESS PREFERENCE:
§14835 et seq. of the California Government Code requires that a five percent (5%) preference be given to Bidders who qualify as a small business. The rules and regulations of this law, including the definition of a small business, or qualifying non-small business, are contained in Title 2, California Code of Regulations, §1896 et seq.
