1.0 INTRODUCTION

The Federal Trade Commission (FTC)’s mission is to protect consumers by preventing anticompetitive, deceptive, and unfair business practices, enhancing informed consumer choice and public understanding of the competitive process, and accomplishing this without unduly burdening legitimate business activity.

The Office of International Affairs (OIA) leads and coordinates the FTC’s work in international antitrust, consumer protection, and international technical assistance projects.

OIA works with competition and consumer protection agencies around the world to promote cooperation and convergence toward best practices, building a strong network of cooperative relationships with its counterparts abroad. OIA works closely with foreign law enforcement agencies on investigations and cases that affect U.S. consumers through arrangement and agreements with consumer protection enforcement agencies in foreign countries, and through multilateral organizations.

Additionally, OIA actively assists developing countries in their transition to market-based economies and their development of competition and consumer protection agencies. OIA provides advice to such agencies and, in partnership with the Antitrust Division of the Department of Justice, operates a technical assistance program which includes placing experienced attorneys and economists as resident advisors to conduct short-term training workshops, provide on-the-job training, and help develop the investigative and analytical skills of the local agency staff.

7.0 SUBMISSION CONTENT

In response to this solicitation, offerors shall submit a technical quote that details their approaches and solution(s) to the Statement of Work (SOW) tasks. The technical quote shall not merely paraphrase the

SOW.

The Offeror shall provide a technical response divided into sections indicated below for the technical evaluation criteria. The quote shall demonstrate that the offeror’s plan to accomplish the effort is logical, clear, feasible, and practical, including recognition of potential difficulties in performance, appropriateness, and soundness of quoted solution(s) that are to be part of the narrative.

Arrange the volumes as follows:

7.1 VOLUME ONE – TECHNICAL

Volume One includes:

1) Executive Summary / Technical Approach

2) Staffing Plan

3) Corporate Experience

7.1.1 EXECUTIVE SUMMARY / TECHNICAL APPROACH

In the Executive Summary, the offeror should summarize its grasp of the unique requirements and opportunities of this solicitation. While the solicitation includes traditional operations and maintenance activities, the primary focus is on the offeror’s ability not simply to conduct business as usual, but to apply their particular skills and experience to increased efficiencies, streamlined processes.

The offeror shall demonstrate its technical approach in performing the tasks outlined in the SOW – this includes a discussion of the background, objectives, and required tasks; the offeror should demonstrate an understanding of the processes and procedures required to provide technical assistance program support services for the Ukraine project as well as logistical support services in relation to housing, utilities, and transportation.

7.1.2 STAFFING PLAN

The FTC will evaluate the staffing plan based on the following considerations:

1) The extent to which the offeror identifies Key Personnel in the Staffing Plan with appropriate education, skills, experience, certifications, and other qualifications needed to increase the likelihood of successful performance and the ability to meet all of the requirements in the statement of work.

2) Resumes shall be included for Key Personnel. Letters of intent shall be provided for any Key personnel not currently employed by the offeror.

7.1.3 CORPORATE EXPERIENCE

The offeror shall provide information of past or other current experience with similar requirements to facilitate the Government’s consideration of the corporate experience as the prime contractor.

The Government is most interested in examples of actual results of the prime contractor in its familiarity with issues and methods applied to support programs such as the FTCs Overseas

Technical Assistance Program Support Services – Ukraine Project, especially with respect to housing, utilities, and transportation, as described in the SOW. The offeror shall describe how each contract is similar to this work, and shall provide sufficient information related to past or current support services described in the SOW.

The Government is also interested in examples of the prime contractor in managing staffing efforts similar to the FTC/OIA or the United States Agency for International Development (USAID), with its employees and subcontractors in federal and/or commercial space. The prime contractor shall provide at least one example of its experience (its own experience, not the experience of any proposed subcontractors).

The Government is more interested in the quality and similarity of the corporate experience examples to the requirement than the quantity of examples. The Offeror shall include the name and contact information of a reference that can substantiate the real example of real work and real results. The information shall be sufficiently detailed so that the evaluators can determine whether the example(s) demonstrates the prime contractor’s experience.

Note: The Government will not contact the reference to obtain details lacking from the offeror’s response.

7.2 VOLUME TWO – COST/PRICE

Offerors are required to submit pricing for all three (3) years (base and option periods); “out-year” option pricing can be expressed as a percentage escalation.

Evaluation of options will not obligate the FTC to exercise the options. The FTC may reject a quote as non-responsive if it is materially unbalanced as to cost for the base year requirement in relationship to the option years. A quote is unbalanced when it is based on costs significantly less for some work and significantly overstated for other work, or the costs do not reflect market value. For the government to determine reasonableness of the price quoted for each audit element, the labor categories, rates and labor hour mix.

7.2.1 PRICING TABLE

The following pricing tables should be used when submitting your price quote. There should be one set of charts for each year of the contract (unless out years are expressed as an escalation percentage). See attachment “11.2 – Price Table”.

8.0 BASIS FOR AWARD

The basis for the resultant award will be “best value.” The FTC will make an award to the responsible offeror whose offer is fully responsive to the FTC’s needs and requirements and is most advantageous to the FTC (i.e., that which represents the best value to the FTC), price and other factors considered.

8.1 EVALUATION FACTORS FOR AWARD

The FTC will evaluate potential risk to itself and its operations. The FTC will also consider technical and performance risk, based upon the offeror’s evaluated technical submission during the evaluation.

The Government will evaluate its level of confidence in the ability of the offeror to perform the requirements stated in the SOW and RFQ utilizing the following considerations:

1) Prior contracts (“reference contracts”) where the offeror served in the role of a prime contractor that will demonstrate the offeror’s ability to perform the activities specified in the SOW.

2) Type, size and complexity of its previous experience compared to the type, size and complexity of the requirements specified in the SOW.

8.1.1 General Criteria

To be considered eligible for award, submissions shall meet the following general conditions:

1. The offeror's submission is determined to be minimally "acceptable;"

2. The offeror's proposed unit prices are determined to be “fair and reasonable;”

3. The offeror's submission complies with the requirements of law, regulation and conditions set forth in the statement of work, request for quote, or otherwise required by law; and

4. The offeror is determined to be "responsible," as defined in Federal Acquisition Regulation

(FAR) Subpart 9.1, meets all standards contained therein, and is otherwise eligible for receiving award.

The offeror’s proposed technical volume will be evaluated for the soundness, quality, and feasibility, as defined below, of achieving the required tasks outlined in the Statement of Work.

1) Soundness - The submission will be evaluated based upon the extent to which the technical approach demonstrates a clear understanding of the steps and capabilities necessary to accomplish the required tasks to include problem solving, flexibility, and capacity to address and overcome uncertainties.

2) Quality - The submission will be evaluated based upon the extent to which successful performance is contingent upon proven methods and techniques, and the extent the offeror’s methods and approach are expected to result in successful completion of the required tasks.

3) Probability - The submission will be evaluated based upon the extent to which requirements have been addressed.

8.1.2 Order of Importance of Evaluation Factors

Evaluation factors in order of descending importance are:

Factor 1: Technical

Factor 2: Price/Cost
