This procurement is for the purchase of Military Chemical Agents (OC Spray). Contractors bear the burden of ensuring that quotes (and any authorized amendments) reach the designated individuals provided above on time and in the form of an e-mail in order to be considered for award. All pages of the quote must reach the designated officials above before the deadline specified in this solicitation. The contractor bears the risk of non-receipt of electronically transmitted quotations and should confirm receipt.

The U. S. Government intends to award a Firm Fixed Price purchase order to the successful offeror of this RFQ. All quotes must comply as follows:

a) All quotes shall be evaluated based on technical acceptability, delivery capabilities, price, and past performance. A quote that is so lacking in information, that a proper evaluation would require elaborate explanation, may be deemed unacceptable.

b) Quotes must confirm that the offered items are in accordance with the Salient Characteristics as outlined within this RFQ.

c) The offeror shall submit a quotation that includes all prices for the listed items and the delivery dates for each item.

Contract Authority: The Government will solicit and award a call using Simplified Acquisition Procedures, in accordance with FAR part 12 and FAR part 13. As a result of this authority, certain requirements for soliciting, awarding, and notifying quoters are streamlined. In accordance with FAR 12.102(c), when a policy in another part is inconsistent with FAR Part 12, Part 12 shall take precedence.

The Contractor shall quote the requested items as detailed below in United States Dollars (USD).

Payment terms of the resulting purchase order will be NET 30 Days via Electronic Transfer of Funds (EFT).

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(i) Technical Acceptability;

(ii) Delivery;

(iii) Price;

(iv) Past performance.

(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
