A.5.3 The program office point of contact will act as the liaison to coordinate activities between the Contractor and Contracting Officer, as required, in the performance of the work under this contract. They have the authority to provide technical clarification of the contract requirements but do not have the authority to modify any contract provisions, including, without limitation, changing the scope of work, the cost/price thereof, or the performance delivery schedule(s). Technical clarification will be issued in writing within 5 (five) calendar days after verbal issuance.

B.2.1 FFP shall be provided for each item specified by the SF1449. Prices shall be submitted using Attachment A, Pricing Form.
B.2.2 The Government anticipates a Period of Performance (POP) as follows:
Base Period – 01 June 2024 – 31 May 2025 Option One – 01 June 2025 – 31 May 2026
B.2.3 The Government will initial award and fund only the Base Period. The exercise of the option period is at the sole discretion of the Government. The total duration of the contract shall not exceed two (2) years.
Section C – Statement of Requirement
Project Washington County USDA Farm Service Center, Nashville, IL Janitorial Service Contract
General Information C.1 Scope of Work The United States Department of Agriculture (USDA), Farm Service Agency (FSA), requires janitorial services.
The contractor shall supply all labor, time, materials, and supervision required to complete the services. Supplies to be provided include cleaning materials, soap, and paper products. This service will be needed for a period of one
(1) one-year base period with one (1) one-year option period.
C.1.1 Background The combined occupied space consists of approximately 3,244 square feet that includes reception area, office space, hallways, two restrooms, break room and conference room. The office is located at 424 E. Holzhauer Drive, Nashville, IL.
C.2 Non-Personal Services The Government shall neither supervise contractor employees nor control the method by which the Contractor performs the required tasks. Under no circumstances shall the Government assign tasks to, or prepare work schedules for, individual contractor employees, except for the site lead. It shall be the responsibility of the contractor to manage its employees and to guard against any actions that are of the nature of personal services or give the perception of personal services. If the contractor believes that any actions constitute, or are perceived to constitute personal services, it shall be the contractor's responsibility to notify the Contracting Officer in writing, immediately.

C.5 Deliverables/Schedule
• Work under the resulting order is performed at Government facilities. Normal agency workdays are Monday through Friday, except for Federal holidays. The regularly scheduled service days and time are to be coordinated with the FSA County Executive Direct, Sandra Frick, Nashville, IL.
• Weather and security closures by their nature usually arise without advance notice. As such, the
Government will notify the contractor as soon as possible once any closures have been announced.
• The service provider shall keep the buildings secure at all times. Buildings are not to be left unlocked at any time unless USDA employees are present. No unauthorized personnel will be allowed in the buildings during time of cleaning.
• The contractor must comply with the Farm Security and Rural Investment Act of 2002 (FSRIA), 7 U.S.C.
8102, the Food, Conservation and Energy Act of 2008 (FCEA), 7 U.S.C. 8102, the Federal Acquisition Regulation; Executive Order (EO) 13514, “Federal Leadership in Environmental, Energy, and Economic Performance,” dated October 5, 2009; EO 13423, “Strengthening Federal Environmental, Energy, and Transportation Management,” dated January 24, 2007, and Presidential Memorandum, “Driving Innovation and Creating Jobs in Rural America through Biobased and Sustainable Product Procurement,” dated February 2012 to provide biobased products.
• The contractor shall make careful selection of janitorial cleaning products and equipment to:
o Use products that are packaged ecologically.
o Use products and equipment considered beneficial and/or recycled products that are phosphate-free, non-corrosive, non-flammable, and fully biodegradable; and minimize the use of harsh chemicals and the release of irritating flames.

• The contractor shall maintain the space, in a clean condition and shall provide supplies and equipment for the term of the contract. The following schedule describes the level of services intended. Performance will be based on the Point of Contact’s (POC) evaluation of results, not the frequency or method of performance.

C.8 Security Requirements Successful federal background checks (criminal and financial) completed by each employee requiring access to the government facility. The contractor must supply names and contact information to the local FSA manager for any contractor employee who will be entering the building to provide services.
C.8.1 Identification of Contractor Employees The contractor’s workforce will be clearly identifiable by uniform, T-shirts with company name and/or logo, name tags, badges or other safeguard for security purposes required by the USDA.

E.1 Inspection and acceptance will be accomplished by the onsite technical point of contact. Deficiencies in quality will be presented to the Contractor within 24 hours of identification. Resolution of deficiencies will be coordinated with the onsite technical point of contact.

G.1 Invoices
G.1.1 Invoices shall be submitted monthly in accordance with the pricing specified by the resulting order.
Invoice shall reference the order number and the performance period being invoiced. The Government pays in arrears.
G.1.2 The “Submit-Invoice To” address for USDA orders is the Department of Treasury’s Invoice Processing Platform (IPP). The contractor must follow the instructions on how to register and submit invoices via IPP as prescribed in the previous communications from USDA and Treasury. All invoices are to be submitted via the electronic Invoice Processing Platform. This is a mandatory requirement initiated by the U.S. Department of Treasury and more information can be found at this website: https://www.ipp.gov/index.htm. Section H—Special Contract Requirements

H.1.1 Additionally, the contractor must provide coverage for any other risks deemed appropriate, since the Government is not indemnifying the Contractor against any risks under the contract. A current duplicate (not machine reproduced) certificate of insurance must be submitted to the CO for approval before the Contractor begins work under this contract. Duplicates of renewal certificates (not machine reproduced) obtained by the Contractor during the life of the contract must immediately be provided to the CO.
H.1.2 The insurance policy must contain an endorsement that any cancellations or material decreases in the coverages shall not be effective, unless the insurer or the contractor gives advance notice of cancellations or changes in accordance with the CO’s instructions.
H.1.3 All premiums or costs incurred to comply with these insurance requirements will be paid by the contractor.
If the contractor already has an organizational policy in effect, the CO requires evidence that it satisfies all the above stated requirements. The contractor is required to provide such evidence as deemed necessary by the CO before a notice to proceed with contract performance is issued. The Government reserved the right to disapprove the purchase of any insurance coverage determined to not be in the Government’s interest.
H.1.4 The contract requires that all insurance coverages be kept in full force and effect until all contract work is completed; the insurance requirements also apply to subcontractors.
H.1.5 The Government will not be responsible for any losses, damages, or liabilities beyond the amounts, limits, and conditions of the above-required insurance.
H.1.6 The requirement FAR Clause 52.228-5 is hereby supplemented to provide that the general liability policy shall name “The United States of America, acting by and through USDA-NRCS” additional insured with respect to operations performed under this contract.

I.2 FAR Clauses in Full Text
I.2.1 FAR 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment (Nov 2021)
(a) Definitions. As used in this clause— Backhaul means intermediate links between the core network, or backbone network, and the small subnetworks at the edge of the network (e.g., connecting cell phones/towers to the core telephone network). Backhaul can be wireless (e.g., microwave) or wired (e.g., fiber optic, coaxial cable, Ethernet).
Covered foreign country means The People’s Republic of China.
Covered telecommunications equipment or services means–
(1) Telecommunications equipment produced by Huawei Technologies Company or ZTE Corporation (or any subsidiary or affiliate of such entities);
(2) For the purpose of public safety, security of Government facilities, physical security surveillance of critical infrastructure, and other national security purposes, video surveillance and telecommunications equipment produced by Hytera Communications Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology Company (or any subsidiary or affiliate of such entities);
(3) Telecommunications or video surveillance services provided by such entities or using such equipment; or
(4) Telecommunications or video surveillance equipment or services produced or provided by an entity that the Secretary of Defense, in consultation with the Director of National Intelligence or the Director of the Federal Bureau of Investigation, reasonably believes to be an entity owned or controlled by, or otherwise connected to, the government of a covered foreign country.
Critical technology means–
(1) Defense articles or defense services included on the United States Munitions List set forth in the International Traffic in Arms Regulations under subchapter M of chapter I of title 22, Code of Federal Regulations;
(2) Items included on the Commerce Control List set forth in Supplement No. 1 to part 774 of the Export Administration Regulations under subchapter C of chapter VII of title 15, Code of Federal Regulations, and controlled-
(i) Pursuant to multilateral regimes, including for reasons relating to national security, chemical and biological weapons proliferation, nuclear nonproliferation, or missile technology; or
(ii) For reasons relating to regional stability or surreptitious listening;
(3) Specially designed and prepared nuclear equipment, parts and components, materials, software, and technology covered by part 810 of title 10, Code of Federal Regulations (relating to assistance to foreign atomic energy activities);
(4) Nuclear facilities, equipment, and material covered by part 110 of title 10, Code of Federal Regulations (relating to export and import of nuclear equipment and material);

(5) Select agents and toxins covered by part 331 of title 7, Code of Federal Regulations, part 121 of title 9 of such Code, or part 73 of title 42 of such Code; or
(6) Emerging and foundational technologies controlled pursuant to section 1758 of the Export Control Reform Act of 2018 (50 U.S.C. 4817).
Interconnection arrangements means arrangements governing the physical connection of two or more networks to allow the use of another's network to hand off traffic where it is ultimately delivered (e.g., connection of a customer of telephone provider A to a customer of telephone company B) or sharing data and other information resources.
Reasonable inquiry means an inquiry designed to uncover any information in the entity's possession about the identity of the producer or provider of covered telecommunications equipment or services used by the entity that excludes the need to include an internal or third-party audit.
Roaming means cellular communications services (e.g., voice, video, data) received from a visited network when unable to connect to the facilities of the home network either because signal coverage is too weak or because traffic is too high.
Substantial or essential component means any component necessary for the proper function or performance of a piece of equipment, system, or service.
(b) Prohibition. (1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. The Contractor is prohibited from providing to the Government any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system, unless an exception at paragraph
(c) of this clause applies or the covered telecommunication equipment or services are covered by a waiver described in FAR 4.2104.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract, or extending or renewing a contract, with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system, unless an exception at paragraph (c) of this clause applies or the covered telecommunication equipment or services are covered by a waiver described in FAR 4.2104. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract.
(c) Exceptions. This clause does not prohibit contractors from providing—
(1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(d) Reporting requirement. (1) In the event the Contractor identifies covered telecommunications equipment or services used as a substantial or essential component of any system, or as critical technology as part of any system, during contract performance, or the Contractor is notified of such by a subcontractor at any tier or by any other source, the Contractor shall report the information in paragraph (d)(2) of this clause to the Contracting Officer, unless elsewhere in this contract are established procedures for reporting the information; in the case of the Department of Defense, the Contractor shall report to the website at https://dibnet.dod.mil. For indefinite delivery contracts, the Contractor shall report to the Contracting Officer for the indefinite delivery contract and the Contracting Officer(s) for any affected order or, in the case of the Department of Defense, identify both the indefinite delivery contract and any affected orders in the report provided at https://dibnet.dod.mil.
(2) The Contractor shall report the following information pursuant to paragraph (d)(1) of this clause
(i) Within one business day from the date of such identification or notification: the contract number; the order number(s), if applicable; supplier name; supplier unique entity identifier (if known); supplier Commercial and Government Entity (CAGE) code (if known); brand; model number (original equipment manufacturer number, manufacturer part number, or wholesaler number); item description; and any readily available information about mitigation actions undertaken or recommended.
(ii) Within 10 business days of submitting the information in paragraph (d)(2)(i) of this clause: any further available information about mitigation actions undertaken or recommended. (d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215- 2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1), in a subcontract for commercial products or commercial services. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause-
