DESCRIPTION
(i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) subpart 12.6, “Streamlined Procedures for Evaluation and Solicitation for Commercial Items,” as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested, and a written solicitation document will not be issued.
(ii) This solicitation is issued as a Request for Quote (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) number 2022-06, 05/01/2022.
(iii) This solicitation is Full and Open competition to the maximum extent practicable to obtain supplies from a company whose offer is the most advantageous to the Government.
(iv) The associated North American Industrial Classification System (NAICS) cod for this procurement is 325413, with a small business size standard of 1,250 employees. The FSC/PSC is 6550 (In Vitro Diagnostic Substances, Reagents, Test Kits and Sets).
(v) The Department of Veterans (VA), Network Contracting Office 22 (NCO 22) is seeking to purchase In Vitro Diagnostic (IVD) Test Kits that will be used on Government owned equipment (GenMark Dx XT-8) for the extraction, amplification, and detection of HCV genotypes in patient specimens.
(vi) All interested companies shall provide a quote for the following:

The company offer must demonstrate meeting the salient physical, functional, or performance characteristic specified in this solicitation, otherwise it will be considered non-responsive. The technical specification for this requirement is listed for Brand Name or Equal.
The information provided is intended to be descriptive, not restrictive and to indicate the quality that will be satisfactory. The interested parties bear full responsibility to ensure their submission demonstrates to the Government that they can provide the brand name or equal to products being requested.

The Period of Performance (POP) shall start shortly after award for one (1) year. Orders shall be made on an as needed basis throughout the POP not to exceed stated total without a supplemental agreement between the Contractor and Contracting Officer in accordance with 52.212-4(c) and 52.217-6. All shipping shall be inclusive of item price and FOB Destination.
(viii) FAR 52.212-1, Instructions to Offerors - Commercial Items, applies to this solicitation.
Addenda:
All company quotes for this solicitation must be received electronically through email to Anthony Dela Cruz at Anthony.delacruz@va.gov no later than Tuesday, May 31st, 2022, 4:00pm PST. Ensure to reference solicitation number RFQ 36C26222Q0970 within subject line of the email. Any quotes received after the prescribed date/time shall be considered non-responsive and will not be considered for award. Any questions or concerns regarding this solicitation must be received electronically through email no later than Friday, May 27, 2022, 4:00pm PST. Ensure to reference solicitation number 36C26222Q0970 within subject line of the email.
Companies shall submit the following via email:
(a) For brand name, provide one quote for the item listed.
(b) See Attachment A. Salient Characteristics if providing equal to brand name and provide one quote.
(c) Company shall provide verification that their item is not grey market, verified by an authorization letter or other documents from the Original Equipment Manufacturer (OEM) of IVD test kits.
(ix) FAR 52.212-2 Evaluation -- Commercial Products and Commercial Services.
(a) The Government will award a contract resulting from this solicitation to the responsible and responsive company whose quote conforms to the solicitation will be most advantageous to the Government price alone considered. The Government reserves the right to consider a quote other than the lowest price that provides additional benefit(s). Submissions must show clear, compelling, and convincing evidence that equal to IVD Test Kits meet all the salient characteristics listed on Attachment A. Acceptability of IVD Test Kits shall be verified by designated evaluator(s) that any equal to brand name meets the salient characteristics to fulfill this requirement. Companies that include any item that are not determined as Brand Name or Equal shall result in an unacceptable offer.
Price: The Government will evaluate the price by adding the total of all line item prices. The total evaluated price will be that sum for award purposes.
Evaluation Approach. The Government will evaluate quotations using the comparative evaluation process outlined in FAR 13.106-2, where quotations will be compared to one another to determine which provides the best benefit to the Government.
(x) To facilitate the award process, all companies shall include a statement regarding the terms and conditions herein as follows:
“The terms and conditions in the solicitation are acceptable to be included in the award document without modification, deletion or addition.”
OR
“The terms and conditions in the solicitation are acceptable to be included in the award document with the exception deletion, or addition of the following:”
Offerors shall list exception(s) and rationale for the exception(s), if any.
(xi) Companies must complete annual representation and certifications electronically via the System for Award Management (SAM) website located at https://www.sam.gov/portal in accordance with FAR 52.212-3, “offerors Representations and Certifications-- Commercial Items”. Ensure https://www.sam.gov/portal is updated with current information.
(xii) The clause at 52.212-4, “Contract Terms and Conditions -- Commercial Items” (Nov 2021) applies to this acquisition.
(xiii) The clause at 52.212-5, “Contract Terms and Conditions Required To Implement Statutes Or Executive Orders -- Commercial Products and Commercial Services” (May 2022) applies to this acquisition.
(xiv) The following clauses/provisions apply:
52.211-6 - Brand Name or Equal (Aug 1999)
(a) If an item in this solicitation is identified as “brand name or equal,” the purchase description reflects the characteristics and level of quality that will satisfy the Government’s needs. The salient physical, functional, or performance characteristics that “equal” products must meet are specified in the solicitation.
(b) To be considered for award, offers of “equal” products, including “equal” products of the brand name manufacturer, must—
(1) Meet the salient physical, functional, or performance characteristic specified in this solicitation;
(2) Clearly identify the item by—
(i) Brand name, if any; and
(ii) Make or model number;
(3) Include descriptive literature such as illustrations, drawings, or a clear reference to previously furnished descriptive data or information available to the Contracting Officer; and
(4) Clearly describe any modification the offeror plans to make in a product to make it conform to the solicitation requirements. Mark any descriptive material to clearly show the modification.
(c) The Contracting Officer will evaluate “equal” products on the basis of information furnished by the offeror or identified in the offer and reasonably available to the Contracting Officer. The Contracting Officer is not responsible for locating or obtaining any information not identified in the offer.
(d) Unless the offeror clearly indicates in its offer that the product being offered is an “equal” product, the offeror shall provide the brand name product referenced in the solicitation.
(End of clause) Grey Market Items.
(a) Gray market items are Original Equipment Manufacturers (OEM) goods sold through unauthorized channels in direct competition with authorized distributors. This procurement is for new OEM medical supplies, medical equipment and/or services contracts for maintenance of medical equipment (i.e., replacement parts) for VA Medical Centers. No remanufactures or gray market items will be acceptable.
(b) Vendor shall be an OEM, authorized dealer, authorized distributor or authorized reseller for the proposed medical supplies, medical equipment and/or services contracts for maintenance of medical equipment (i.e., replacement parts), verified by an authorization letter or other documents from the OEM, such that the OEM’s warranty and service are provided and maintained by the OEM. All software licensing, warranty and service associated with the medical supplies, medical equipment and/or services contracts for maintenance of medical equipment shall be in accordance with the OEM terms and conditions.
(c) The delivery of gray market items to the VA in the fulfillment of an order/award constitutes a breach of contract. Accordingly, the VA reserves the right to enforce any of its contractual remedies. This includes termination of the contract or, solely at the VA’s election, allowing the Vendor to replace, at no cost to the Government, any remanufactured or gray market item(s) delivered to a VA medical facility upon discovery of such items.
(End of clause) 52.217-8 - Option to Extend Services.
As prescribed in 17.208(f), insert a clause substantially the same as the following: Option to Extend Services (NOV 1999) The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor 30 days before period of performance end.
