REQUEST FOR QUOTATION (RFQ) 21-006-TRS BLACKFEET COMMUNITY HOSPITAL FLOORING REPLACEMENT

PART I

BLACKFEET COMMUNITY HOSPITAL FLOORING REPLACEMENT

INTRODUCTION:

The Browning Community Hospital is a PHS Indian Hospital which provides healthcare services to the Blackfeet Indian Reservation. Flooring in Corridor 1041, Corridor 1343, Waiting Area 1096, and the suite of rooms known generally as the Women’s Clinic is worn beyond its useful life and requires replacement.

The Billings Area Indian Health Service in Billings, Montana is acquiring construction services in accordance with the attached drawing and specifications associated with Request for Quote (RFQ)-21-006-TRS for flooring replacement at the Blackfeet Community Hospital at the Blackfeet Service Unit, Browning, Montana.

The procurement is conducted pursuant to the authority of Federal Acquisition Regulation (FAR) Part 13, Simplified Acquisition Procedures and FAR 36, Construction and Architect-Engineer Contracts.

This solicitation is 100% Small Business set-aside.

SCOPE OF WORK:

•Remove existing resilient base in areas shown on drawing.
•Remove existing carpet tile in areas shown on drawing.
•Install new LVT (luxury Vinyl Tile) in the Women’s Clinic.
•Install new Carpet Tile in Corridor and Waiting Area.
•Remove and legally dispose of all demolished flooring materials, packaging, and associated construction trash.

PERIOD OF PERFORMANCE:

Work shall be completed 21 calendar days from the Notice to Proceed.

WAGE DETERMINATION:

General Decision Number: MT20210034 Dated 05/21/2021 is applicable to the construction services as set forth in 40 U.S.C. chapter 31, subchapter IV, Wage Rate Requirements (Building), formerly known as the Davis-Bacon Act.

The estimated price range for this project is between $25,000 and $100,000.

One of the payment protections referenced in Federal Acquisition Regulation (FAR) 52.228-13, “Alternative Payment Protections (JUL 2000)”, must be submitted to this office prior to commencing work.

STANDARD REQUIREMENTS:

Standard Requirements are described in the attached Technical Specifications.

ASSUMPTIONS:

Contractor shall be responsible for obtaining all necessary licenses and permits required to complete the Work, including compliance with all existing TERO laws and regulations.

The contractor is required to obtain registration with the Montana Department of Labor and Industry (DLI). Forms for registration are available from the Department of Labor and Industry, P.O. Box 8011, 1805 Prospect, Helena, Montana 59604-8011. Information on registration can be obtained by calling (406) 444-7734. Contractor is required to have registered with the DLI prior to bidding on this project. All workers employed by the contractor or subcontractors in performance of the construction work shall be paid wages at rates as may be required by the laws of the Blackfeet Tribes.

PROJECT COMPLETION:

The project is considered complete when the IHS Project Engineer has certified the final inspection.

INVOICE SUBMISSION AND PAYMENTS:

The Contractor shall submit its invoice to the Billings Area Office, Attn: Todd Rydquist, Billings, Montana 59107, with a courtesy copy to the Billings Area Financial Management Office. The Contractor agrees to include the following information on each invoice:

(1) Contractor’s name and address;

(2) Contact name, title, and telephone number,

(3) Contract Number;

(4) Invoice number and date;

(5) Description, quantity, unit of measure, unit price, and extended price of supplies delivered or services performed;

(6) Remit to Address: 2900 4th Ave. North, Billings, MT 59107

(7) Taxpayer Identification Number (Employer Identification Number or Social Security Number); and

(8) Data Universal Numbering System (DUNS) number (to ensure payment is made to the correct bank account) and vendor mailing address, as provided in the System for Award Management (SAM), database.

Payment shall be made by the Billings Area Financial Management Branch, P.O. Box 36600, Billings, Montana 59101.

PROPOSAL SUBMISSION INSTRUCTIONS:

In order to be considered for award, contractor must (1) be able to submit a bid for all items listed on the Bid Sheet, (2) approved by flooring manufacturer to install specified products and (3) provide copy of five completed installations similar in scope to this project.

Contractors intending to conduct business with the Federal Government must register with the System for Award Management (SAM). SAM is now the primary Government repository, which retains information on Government contractors. You may register via the Internet at www.sam.gov.

All responsible offerors may submit a proposal, which shall be considered by the Agency. Offers shall be submitted no later than August 19, 2021 at 2:00 p.m. MST. Offers will be accepted by e-mail at Tanya.Schwab@ihs.gov. Please reference the solicitation number in the subject line.

ACCEPTANCE PERIOD:

Your proposal must stipulate that it is predicated upon all the terms and conditions of this RFQ. In addition, it must contain a statement to the effect that it is firm for a period of at least 90 days from the date of receipt by the Government.

TRIBAL REQUIREMENTS and TERO (Tribal Employments Rights Ordinance):

Notice is hereby given that contractors who perform projects within the exterior boundaries of the Blackfeet Indian Reservation, Glacier County, Montana, must be certified through the TERO Office prior to commencing work. The Contractor is also responsible for payment of any tribal taxes and work permits and compliance with the local tribal employment rights ordinances.

52.211-10 Commencement, Prosecution, and Completion of Work (APR 1984)

The Contractor shall be required to (a) commence work under this contract within 21 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than December 4, 2021. The time stated for completion shall include final cleanup of the premises.

52.228-13 Alternative Payment Protections (JUL 2000) (Applicable over $35K)

(a) The Contractor shall submit one of the following payment protections:

(i) A payment bond.

(ii) An irrevocable letter of credit (ILC).

(iii) A tripartite escrow agreement. The prime contractor establishes an escrow account in a federally insured financial institution and enters into a tripartite escrow agreement with the financial institution, as escrow agent, and all of the suppliers of labor and material. The escrow agreement shall establish the terms of payment under the contract and of resolution of disputes among the parties. The Government makes payments to the contractor’s escrow account, and the escrow agent distributes the payments in accordance with the agreement, or triggers the disputes resolution procedures if required.

(iv) Certificates of deposit. The contractor deposits certificates of deposit from a federally insured financial institution with the contracting officer, in an acceptable form, executable by the contracting officer.

(v) A deposit of the types of security listed in 28.204-1 and 28.204-2.

(b) The amount of the payment protection shall be 100 percent of the contract price.

(c) The submission of the payment protection is required within 15 days of contract award.

(d) The payment protection shall provide protection for the full contract performance period plus a one-year period.

(e) Except for escrow agreements and payment bonds, which provide their own protection procedures, the Contracting Officer is authorized to access funds under the payment protection when it has been alleged in writing by a supplier of labor or material that a nonpayment has occurred, and to withhold such funds pending resolution by administrative or judicial proceedings or mutual agreement of the parties.

(f) When a tripartite escrow agreement is used, the Contractor shall utilize only suppliers of labor and material that signed the escrow agreement.

CONTRACTOR LIABILITY FOR PERSONAL INJURY AND/OR PROPERTY DAMAGE

The Contractor assumes responsibility for all damage or injury to persons or property occasioned through the use, maintenance, and operation of the Contractor’s vehicles or other equipment by, or the action of, the Contractor or the Contractor’s employees and agents. The Contractor assumes responsibility for any and all damage and/or injury to persons or property resulting from any action of prime contractor and subcontractor employees (at any tier).

The Contractor, at the Contractor’s expense, shall maintain adequate public liability and property damage insurance during the continuance of this contract, insuring the Contractor against all claims for injury or damage.

The Contractor shall maintain Workers’ Compensation and other legally required insurance with respect to the Contractor’s own employees and agents.

The Government shall in no event be liable or responsible for damage or injury to any person or property occasioned through the use, maintenance, or operation of any vehicle or other equipment by, or the action of, the Contractor or the Contractor’s employees and agents in performing under this contract, and the Government shall be indemnified and held harmless against claims for damage or injury in such cases.

PHYSICAL BARRIER AND ACCESS CONTROL

Subject to prior submittal and approval of the IHS, the Contractor shall install or construct a physical barrier between the construction activity/work zone and ongoing hospital/clinic operations. The barrier shall be installed prior to the commencement of all other work and shall control the access of all Contractor personnel to the approved construction activity/work zone. The Contractor must further prohibit all Contractor personnel authorized to perform work under this contract from entering any area of the facility other than those areas where work is being performed and is cordoned off from facility operations. The barrier shall be removed upon completion of all work and as approved by the IHS.

Failure to adhere to this requirement may result in permanent removal of the Contractor employee found to be outside of the approved construction activity/work zone. Repeated failure to adhere to this requirement may result in termination of this contract for default in accordance with FAR 52.249-10.

52.204-8 Annual Representations and Certifications (MAR 2020)

(a) (1) The North American Industry Classification System (NAICS) code for this acquisition is 238330.

(2) The small business size standard is $16.5 Million.

(3) The small business size standard for a concern which submits an offer in its own name, other than on a construction or service contract, but which proposes to furnish a product which it did not itself manufacture, is 500 employees.

(b) (1) If the provision at 52.204-7, System for Award Management, is included in this solicitation, paragraph (d) of this provision applies.

52.233-2 Service of Protest (Sep 2006)

(a) Protests, as defined in section 33.101 of the Federal Acquisition Regulation, that are filed directly with an agency, and copies of any protests that are filed with the General Accounting Office (GAO), shall be served on the Contracting Officer (addressed as follows) by obtaining written and dated acknowledgment of receipt from Mr. Jerry L. Black, Senior Contracting Officer, 2900 Fourth Avenue North, Room 304, Billings, Montana 59107.

(b) The copy of any protest shall be received in the office designated above within one day of filing a protest with the GAO.

52.236-27 Site Visit (Construction) (Feb 1995)

(a) The clauses at 52.236-2, Differing Site Conditions, and 52.236-3, Site Investigations and Conditions Affecting the Work, will be included in any contract awarded as a result of this solicitation. Accordingly, offerors or quoters are urged and expected to inspect the site where the work will be performed.
