EVALUATION

FAR 52.212-2 – Evaluation-Commercial Products and Commercial Services (NOV 2021)

1.0 GENERAL

The Government will review all quotations to determine whether they comply with the instructions to quoters. A quotation that fails to comply with these instructions may be determined unacceptable, may not be evaluated further, and may be removed from consideration for award.

2.0 EVALUATIONS METHODOLOGY

The Government intends to award a contract resulting from this solicitation to the responsible Quoter whose quotation conforms to the solicitation requirements and represents the best value to the Government, considering price and the other evaluation factors.

The Government intends to use the Lowest Price Technically Acceptable (LPTA) source selection process to determine the best value. Under the LPTA process, award will be made to the responsible Quoter whose quotation is determined to be technically acceptable and offers the lowest evaluated price. The following evaluation factors will be used to evaluate quotations:

• Technical (non-price): The Quoter's quotation will be evaluated for technical acceptability based on how well the proposed item(s) meet the BEP requirements identified in the RFQ. Each quotation will receive a rating of ACCEPTABLE or UNACCEPTABLE. Quotations rated UNACCEPTABLE will not be considered for award.

• Price: The Government will evaluate price to determine fair and reasonableness. Price fairness and reasonableness will be determined using one or more price analysis techniques in accordance with

FAR 13.106-3.

A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
