Enclosed is a Request for Quotations (RFQ) for English Language Program. If you would like to submit a quotation, complete the required portions of the attached document and submit it following instructions below in Section 3 of the solicitation.
The U.S. Government intends to award a purchase order to the responsible company submitting an acceptable offer at the best valued on initial quotations, without holding discussions, although we may hold discussions with companies in the competitive range if needed.

I. SCOPE OF SERVICES
• The objective of this firm-fixed-price contract is to deliver English language instruction to local employees of the U.S. Embassy in Tegucigalpa.
• The period of performance will be for Twelve Months once awarded.
• The offers must be submitted in English.
• All offers must be priced in Lempiras (HNL).
• All offers must be valid for 60 days.

DESCRIPTION/SPECIFICATIONS/PERFORMANCE WORK STATEMENT
GENERAL
The objective of this firm-fixed-price contract is to deliver English language instruction to local employees of the U.S. Embassy in Tegucigalpa. The vendor must be a professional, accredited organization/person.
DEFINITIONS
"COR" means Contracting Officer's Representative; see FAR 52.212-4 Contract Terms and Conditions – Commercial Items, in Section 2.
"Government" means the United States Government unless otherwise stated.
1. MODALITY
The classes need to be offered in both modalities: online, via the school platform or one of the programs such as Teams, Zoom something of the sort AND have the option of in person class at the contractor’s facilities. We are NOT requesting a hybrid mode, although it can be available, we want the option for students who want to take the online training to be able to do so, and the people who want to take the in person training can as well.
2. PERIOD OF PERFORMANCE
The period of performance will be defined and confirmed after the award date.
3. SCHEDULE
The schedule for these courses would be after hours (after 4:30pm) two days a week for two hours each day or whatever is convenient for the students. If weekends are available by the contractor, and it works for the students, this is also an option that we would like open to review.
4. NUMBER OF STUDENTS PER CLASS
Each level will be open to a maximum of 15 students per class. The U.S. Embassy is requesting 4 modules (3 month modules per quarter of the year) to take place in a year per group that we open at a firm fixed price per module and to leave the contract open for 1 year.
5. ASSESSMENT TEST
Assessment tests will need to take place, by a qualified facilitator, to determine the employee's level (and make sure that we have enough people on the same level per section). The assessments need to be turned in at the latest within a week with the results, after they have been tested. COR or Embassy shall be provided the opportunity to review and approve the test in advance of its implementation.
6. MATERIAL
Contractor will provide each student with any material (books, handouts, audio-visual exercises, materials designed for each level, as well as scheduled testing).
7. LEVELS
A conversational level for the more advanced students would need to be included. The levels offered would depend on the results of the placement tests and of the methodology offered by the contractor.
8. PASSING GRADE
The passing grade is 70%. Students are required to justify their absence. Students cannot miss more than four classes within the three-month period unless it is due to a medical emergency or something related to their job.
9. REPORTS
All reports shall be submitted to the Contracting Officer’s Representative (COR) in a timely manner, in accordance with the reporting schedule outlined below:
- Report of absences and grades: in order to keep better track of each class on a monthly basis or once each module has concluded (every three months).
- Feedback from all students at the end of every module and share with the Embassy to make sure we are meeting students expectations. Constant communication between the vendor and the COR is required.
- Number of services provided: to ensure better tracking of the available services. This report should be submitted either on a monthly basis or upon the conclusion of each module (every three months).
10. PLATFORM TRAINING
Contractor will provide a training session before the classes start, in order for all students to be able to test the platform (or one of the programs such as Teams, Zoom, other) used for the classes and be able to ask any questions that might come up.
11. PAYMENT
The Contractor shall not submit an invoice for payment until all requirements identified in this contract have been completed and delivery to the COR is complete. The COR shall calculate the number of services which the contractor shall include in its invoice and provide a tax exoneration if necessary.
Once approved by the COR, the contractor shall submit an invoice for payment in the proper amount in Lempiras. Payment will be made via EFT monthly if given invoices are properly submitted in PDF format thru the Web Portal:

12. STUDENT TESTING
The Contractor shall administer tests on knowledge and proficiency as a required element of evaluating the student's progress in the training module or lesson. The Contractor shall provide these tests periodically to:
• Determine the student's progress in training;
• Identify areas of weakness where supplemental training may be needed; and,
• Quantify the student's then-current level of knowledge and proficiency.
Initial testing will be used to establish a baseline for measurement of knowledge and proficiency obtained and may be used in a predictive manner to facilitate personal training planning.
13. STUDENT PROGRESS DOCUMENTATION AND TRAINING
RECOMMENDATIONS
The Contractor's instructor(s) shall be responsible for documenting each student's progress in training, and for preparing a training recommendation for each student. The student's progress will be reported to the student biweekly. The instructor will document the student's progress as measured performance under each lesson module. The Contractor shall prepare training recommendations that state specific plans for remedial, or supplementary use of supportive training materials, or use of tutoring and personalized training techniques.
14. STUDENT COUNSELING
The Contractor's instructor(s) shall be responsible for counseling each student in the student’s performance, and for preparing and discussing with the student any corrective actions which may assist the student in the improvement of their performance. The student's progress will be discussed with the student on a bi-weekly basis, and the Instructor shall document the training recommendations made to direct the student's progress. The counseling sessions should result in specific tasking for remedial, or supplementary use of supportive training materials, or use of tutoring and personalized training techniques, as needed to improve student performance.
15. MINIMUM FACILITY REQUIREMENTS FOR TRAINING VENUES
These facilities need to be appropriate, with regards to safely, lighting, proper space to receive classes, proper parking, bathrooms, and a safe and clean environment.
16. CERTIFICATES
Certificates of successful completion MUST be given to each student at the end of each module.
17. MAKE-UP SESSIONS FOR UNFORESEEN INTERRUPTIONS
The vendor should offer the possibility of making up classes to complete the schedule at their facilities or online, if a class was not imparted because of a teachers absence or a situation not caused by one of our students, where classes were not given on the date and time established.
18. CONTRACTING OFFICER’S REPRESENTATIVE (COR)
The Contracting Officer’s Representative (see clause 652.242-70 in Section 2 Addendum) will provide specific guidance and answer questions relative to the requirement described in paragraph D.1, above.

19. QUALITY ASSURANCE AND SURVEILLANCE PLAN (QASP)
This plan provides an effective method to promote satisfactory contractor performance. The QASP provides a method for the Contracting Officer's Representative (COR) to monitor Contractor performance, advise the Contractor of unsatisfactory performance, and notify the Contracting Officer of continued unsatisfactory performance. The Contractor, not the Government, is responsible for management and quality control to meet the terms of the contract.
The role of the Government is to monitor quality to ensure that contract standards are achieved.
Performance Objective Scope of Work Para Performance Threshold
Performs all English Classes set forth in the scope of work.

(1) customer complaint is received per month.
19.1 SURVEILLANCE
The COR will receive and document all complaints from Government personnel regarding the services provided. If appropriate, the COR will send the complaints to the Contractor for corrective action.
19.2 STANDARD
The performance standard is that the Government receives no more than one (1) customer complaint per month. The COR shall notify the Contracting Officer of the complaints so that the Contracting Officer may take appropriate action to enforce the inspection clause (FAR 52.212-4, Contract Terms and Conditions-Commercial Items), if any of the services exceed the standard.
19.3 PROCEDURES
(a) If any Government personnel observe unacceptable services, either incomplete work or required services not being performed they should immediately contact the COR.
(b) The COR will complete appropriate documentation to record the complaint.
(c) If the COR determines the complaint is invalid, the COR will advise the complainant.
The COR will retain the annotated copy of the written complaint for his/her files.
(d) If the COR determines the complaint is valid, the COR will inform the Contractor and give the Contractor additional time to correct the defect, if additional time is available.
The COR shall determine how much time is reasonable.
(e) The COR shall, as a minimum, orally notify the Contractor of any valid complaints.
(f) If the Contractor disagrees with the complaint after investigation of the site and challenges the validity of the complaint, the Contractor will notify the COR. The COR will review the matter to determine the validity of the complaint.
(g) The COR will consider complaints as resolved unless notified otherwise by the complainant.
(h) Repeat customer complaints are not permitted for any services. If a repeat customer complaint is received for the same deficiency during the service period, the COR will contact the Contracting Officer for appropriate action under the Inspection clause

(d) Comptroller General Examination of Record. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

Alternate I (Feb 2000). As prescribed in 12.301 (b)(4)(i), delete paragraph (d) from the basic clause, redesignate paragraph (e) as paragraph (d), and revise the reference to "paragraphs (a), (b), (c), or (d) of this clause" in the redesignated paragraph (d) to read "paragraphs (a), (b), and
(c) of this clause".
Alternate II (Nov 2024) . As prescribed in 12.301 (b)(4)(ii), substitute the following paragraphs (d)(1) and (e)(1) for paragraphs (d)(1) and (e)(1) of the basic clause as follows:
(d)(1) The Comptroller General of the United States, an appropriate Inspector General appointed under section 3 or 8 G of the Inspector General Act of 1978 ( 5 U.S.C. App.), or an authorized representative of either of the foregoing officials shall have access to and right to—
(i) Examine any of the Contractor’s or any subcontractors’ records that pertain to, and involve transactions relating to, this contract; and
(ii) Interview any officer or employee regarding such transactions.
