B.1 - General Description
The Contractor shall perform the effort required under this Blanket Purchase Agreement (BPA) on a Firm Fixed Price (FFP) basis.
The work shall be performed in accordance with this BPA. Individual Calls placed will be placed under this BPA.
The Government intends to make multiple BPA awards as a result of this solicitation.

B.2 - Supplies or Services
The Government will provide basic classroom space, AV equipement, and supplies if required.
Session rates provided by the contractor shall be fully loaded and inclusive of all costs for which the contractor expects compensation, including travel to and from the primary place of performance.
The Contractor shall furnish all personnel, equipment, material, supplies, and services (except as may be expressly set forth in this BPA as furnished by the Government) and otherwise do all things necessary for, or incidental to, the performance of work as described in Section C. Performance Work Statement.
B.3 - Type of Contract
This solicitation and subsequent award(s) will be for Blanket Purchase Agreement(s) (BPA(s)) and will follow FAR Part 12- Acquisition of Commercial Items utilizing policies and procedures from FAR 13- Simplified Acquisition Procedures.
B.4 - Services and Prices
The contractor shall provide a fully loaded firm-fixed price session rate A session is defined as the work each contract counselor shall perform to support one JSTP offering (March, August, or October). A session is defined as between 95-110 hours. Contractors shall provide fully loaded sesion rates with the understanding that counselors may be required to work up to a maximum of 110 hours.

C.1 - Performance Work Statement
Foreign Service Institute Transition Center Career Training Center (FSI/TC/CTC) RV102 Job Search/Training Program (JS/TP) Performance Work Statement
Background The George P. Shultz National Foreign Affairs Training Center of the Department of State is the federal government’s primary training facility for personnel of the foreign affairs community. The Foreign Service Institute (FSI) is the Department bureau that provides training for employees of the Department of State and other agencies at the Shultz Center. The FSI/TC/Career Transition Center offers three major programs to help employees plan for the future and prepare for retirement: The Early/Mid-Career Retirement Planning Seminar (EMCRPS), the Retirement Planning Seminar (RPS) and the Job Search/Transition Program (JSTP).
The professional services of a Counselor are needed to assist JSTP participants’ transition from Foreign and Civil Service careers in the Department of State and other Foreign Affairs agencies, including employees who are being voluntarily and involuntarily separated from service with the government. Each participant is beginning a transition to a new phase of life, following a full-time federal career. They vary in expertise, rank, race, gender and age, with most being in the range from late-40s to late-60s. Their post-retirement plans are diverse, and their geographic targets include overseas as well as U.S. locations. Some seek employment in the private sector; others are interested in not-for-profit or education sectors, part-time government service, entrepreneurship, consulting, creative pursuits and/or volunteer commitments. Some are uncertain of their next steps, and use the JSTP to help them formulate their plans for the future.
The Job Search/Transition Program helps employees clarify career goals, assess interests, skills, and values, prepare a resume, build a network of people who can help in finding a job, sharpen interviewing skills, and negotiate salary and benefits. JSTP class sizes range from 55 to over 140. The program is offered three times each year in March, August and October. Seminars are delivered either in-person at the Foreign Service Institute (400 Arlington Boulevard, Arlington, Virginia) or virtually via digital platform. Program and Institute leadership determine delivery formats for each session in response to sometimes changing needs of the program, students, and institution.
Purpose The Foreign Service Institute is actively seeking contract Counselors to counsel participants during the Job Search Program (JSTP).
The overall aim of the JSTP is to help individuals identify ways to satisfactorily move into retirement from the federal government and to develop a plan for dealing with the transition. The two-month long program is offered three (3) times a year, and utilizes a variety of presentation formats. Contract Counselors work during the first month, the structured segment of the two-month program, and their work is complete at the end of the final program evaluation meeting. A second month of enrollment is provided for independent pursuit of transition activities and job search, for Foreign Service personnel only.
The JSTP program requires the services of qualified and experienced Counselors to provide counseling support on each student’s unique transition from the government to the next phase of life. Goals may include full or part-time work in government, non-profit or private sectors, education, entrepreneurship, volunteer work, traditional retirement, or a combination of pursuits. The Counselor meets with the participants during different times and settings in the JSTP. Sessions differ in length and type, including mid-size groups of about 16 – 20 people, small groups of 8 - 9 participants, and one on one counseling sessions. Individual sessions may focus on career counseling issues, resume and other self-marketing materials, information and job interviews, the participant’s goals, strategies, research and plans, and/or other issues of importance to the participant.
The program, entitled the Job Search/Transition Program, will contain, but is not limited to the following topics: the transition process, job search skills and up-to-date search strategies, development of consulting or contracting or small businesses, planning for choices other than employment such as volunteer work, and/or traditional retirement.
During the JSTP program, contract Counselors are required to work both individually and collaboratively as part of a larger JSTP team comprised of Career Transition Center staff and government employee Counselors as well as other contract Counselors.
The number of required contract Counselors per JSTP will vary based on the number of program participants and available Government staff. The Government estimates approximately 35 - 40 contract Counselors may be required per calendar year, with the August JSTP program requiring the most contract Counselors (estimated 16 - 18). The program generally strives for a ratio of one Counselor per eight participants.
Fair Opportunity Procedures for Multiple Awardees Counselors will receive the opportunity to accept BPA calls for each of the three annual offerings of the Job Search/Transition Program (JSTP). The actual number of required contract Counselors will vary based on actual enrollment and FSI does not guarantee any number of BPA calls per JSTP offering, ordering period/year, or BPA awardee.
During the Base Ordering Period of the Blanket Purchase Agreement, a random sequence generator (https://www.random.org/ sequences/) is used to assign a random number from 1 – x (x = the number of BPA calls) to each Counselor. Early in the BPA life, there is no history of BPA calls for any of the Counselors. Therefore, a random number generator is utilized to determine the initial order of first opportunity to receive BPA calls for JSTP sessions.
In subsequent offerings of JSTP, first opportunity will be based on a rotation order determined by the number of times each awardee has worked on the currently valid Blanket Purchase Agreement and the number of times worked during the twelve (12) months prior to the upcoming JSTP. The rotation list places awardees in order from those who have worked the least number of times in both categories through those who have worked the greatest number of times in both categories. For example, a Counselor who has worked once on the entire currently valid BPA and once in the past calendar year would have a higher position in the rotation than a Counselor who has worked three times on the BPA and twice in the past calendar year.
Description of Agreement The Government will award multiple Blanket Purchase Agreements with fully loaded firm fixed session price rates.
Incorporation of Contractor’s Technical Quote The contractor shall provide contract Counselor services in accordance with its technical proposal and any revisions submitted in response to this solicitation prior to contract award. The final version of the contractor’s technical proposal is incorporated into this Section C. by reference. The awarded contractor shall also furnish the Contracting Officer with a soft copy of the technical proposal (.pdf file) at time of award notification.
Firm Fixed Price Session Rate Pricing Contractors shall provide pricing on a per session basis. One session is defined as the work each contract Counselor shall perform to support one JSTP offering (March, August, or October). When JSTP is convened in person at the FSI training facility, each session requires the contract Counselor to provide onsite services for 95-110 hours. CTC will request State.gov accounts for each contract Counselor to facilitate their use of FSI classroom technology. Training on the current classroom technology and time to complete the required online training will be included in the service hours, during the JSTP Counselor Orientation that precedes the first day of the
JSTP.
When JSTP convenes virtually, Counselors are expected to provide 95 – 100 service hours from a location of the Counselor’s choice, from which they will participate in course preparation, delivery, and evaluation. Counselors are expected to learn and know the basics of virtual delivery platforms such as Zoom and Google Drive independently.
Contractors shall provide fully loaded session rates with the understanding that Counselors may be required to work up to a maximum of 110 hours, depending on enrollment and number of assigned hours for back-up and mock interview duties. Included in the total hours is a 1.5 day Orientation for JSTP sessions offered in virtual format and a two-day Orientation for JSTPs offered in person. The extra time is needed for in-person JSTP Counselor Orientation due to the requirement to obtain and activate State.gov accounts, to complete the required online training associated with having a State.gov account, to review FSI emergency evacuation procedures, and to learn how to use the FSI classroom technology. Orientation is attended by all Counselors for both in-person and virtual formats.
Orientation is typically scheduled Thursday and Friday prior to the first day of the JSTP session. The first of two days of Orientation for an in-person offering of JSTP includes training on the current classroom technologies at FSI, information about emergency evacuation of classrooms and time to complete required on-line courses. The half-day Orientation for virtual offerings of JSTP includes discussion of virtual format strategies, technology demonstrations as the program requires, and adjustments to the curriculum for virtual delivery. The second day of Orientation is an eight-hour planning and training session, required of all Counselors working in a JSTP session.
Note: this is not a labor hour Blanket Purchase Agreement.
The Government will not pay travel, housing or administrative costs separately. Any and all costs the offeror expects to be compensated for must be included in the fully loaded firm fixed price quote. The Contracting Officer’s Representative will determine the schedules of individual contract Counselors. A sample schedule for JSTP Counselors is attached to the solicitation.
If a Counselor accepts a BPA call and is unable to provide services for all hours required in the schedule provided due to excusable nonperformance (illness, injury, etc.), a deduction shall be calculated from the firm fixed price rate. 1% of the total firm fixed price shall be deducted for each hour of services that are not performed. The Government expects contract Counselors to perform all scheduled services.
Tasks The contract Counselor supports the formulation and implementation of all plans, operations and evaluation matters relating to the Career Transition Center (CTC) Job Search/Transition Program. The offeror works under the broad policy direction of the Director of FSI/Transition Center (TC) and reports to the Contracting Officer’s Representative, typically the CTC Division Director, for day-to-day oversight of performance under the BPA. Under the guidance of the COR, the offeror will:
1. Provide career counseling and job search advising/coaching for individuals enrolled in the JSTP. This will include general guidance and assistance on the entire transition and job search process, interpretation of informal assessments and formal assessments such as the MBTI Step II, Group Narrative Assessments developed by OneLifeTools including “Who You Are Matters – Virtual” and specific counseling as appropriate for each individual’s situation;
2. Participate in periodic CTC group sessions on transition and job search topics. Demonstrate the ability to teach sessions on job search topics, as needed or if assigned back-up responsibility for a presenter. This will include both formal and informal follow-up sessions, staff meetings, orientation sessions, back-up duties, and preparation of materials for teaching, serving as subject matter experts for participants and program;
3. Conduct individual counseling/coaching sessions and facilitate small and mid-sized group sessions on job search topics offered in the JSTP. Communicate with assigned JSTP participants via digital platform and email as primary modes during virtual offerings. Provide resume and mock interview feedback to individual participants, and monitor course requirements of participants;
4. Recommend appropriate group activities, and teaching aids including websites, books, articles and audiovisual aids, to be used in the CTC programs;
5. Attend course sessions, introduce guest speakers, lead group discussions, present materials and evaluate program effectiveness, as assigned;
6. Participate in program evaluations periodically during and after each program, to ensure that program objectives are being met, offer suggestions for JSTP best practices;
7. Perform other tasks of similar professional/technical complexity as required, including operation of computers, current classroom technology at FSI or other digital teaching tools, and audio-visual equipment. For virtual offerings, utilize delivery platforms such as Zoom and other platforms or web-based programs as required.
Required Experience and Qualifications for Counselors
1. Substantial experience in career counseling (minimum five (5) years), especially with clients who are federal employees in international affairs and with clients who have lived and worked overseas.
2. Current Certification to administer and interpret Myers-Briggs Type Indicator, Step I (form M) and Step II (Form Q). See publisher (The Myers-Briggs Company) information on Certification https://www.themyersbriggs.com/en-US/Get-Certified/ MBTI-Certification Include a copy of certificate with response.
3. Proof of completion of two trainings from OneLifeTools, (https://onelifetools.com/pages/training), including “Who You Are Matters-virtual Facilitator” Training and “Who You Are Matters! Program Training featuring Online Storyteller.” Include both certificates with response. (If at the time of the BPA solicitation submission deadline, an offeror is enrolled in one or both trainings from OneLifeTools.com but has not completed them yet, offeror should submit proof of enrollment. After completion of the two trainings, and prior to accepting a BPA call, the offeror should provide the Certificates.)
1. Detailed description of training and education (requiring at minimum a Bachelor’s degree), degrees, or certifications in Counseling or Coaching.
2. Detailed description of experience and professional and theoretical approach(s) to counseling adults in transition, especially federal employees in international affairs and who may have lived overseas.
Counselor Duties and Responsibilities
1. Prepare and use top-quality visual aids compatible with the Foreign Service Institute’s audio-visual technology (in person), and compliant with 508 Rehabilitation Act. 508 Compliant handouts may be provided by awardee if desired, subject to the approval of the COR.
2. Provide Subject matter input toward course materials.
3. Employ adult experiential learning methods, including but not limited to interactive group exercises, case studies, open discussions, and coaching, to allow students ample opportunities to practice and implement strategies presented in class.
4. Be present for the entire month-long schedule including orientation, training, assigned program hours and meetings, during the JSTP. A participant schedule will be provided to contractors when selected and again at JSTP session Counselor Orientation meetings. Log in to virtual sessions at least fifteen minutes before the official start of any session and check audio/visual connections.
5. Maintain confidentiality for all participants, and follow guidelines in Counselor Handbook for participant file management and shredding of documents at the end of the program. Maintain an email account dedicated only for JSTP sessions.
6. Serve as “back-up” for plenary sessions. Write and submit a detailed back-up feedback report within 24 hours to the CTC Division Director. Guidelines are provided and reports will be evaluated with special consideration for scope, quality of analysis and recommendations, and timeliness of delivery.
7. Participate in and contribute to the all Counselor and CTC staff meeting at the end of week two (mid-way through the four-week session) and a final JSTP evaluation meeting scheduled to coincide with the last day of the contractors’ BPA call period of performance. In the final evaluation meeting, Counselors analyze and report on the overall program individually. They also work in pairs to analyze the survey data and back-up reports for one of the four weeks. The program is enhanced as a result of the collaborative discussion and the suggestions provided during the evaluation meeting.
8. Abide by accepted standards of professionalism for Counselors in the conduct of their duties including interaction with JSTP program participants and other contractors.
9. If a Counselor starts a JSTP session, the same individual Counselor shall continue the scheduled services and no replacement Counselor will be acceptable.
Cancellation Should the Government’s needs change and the services offered via BPA calls are no longer required, BPA calls may be cancelled.
In the event of a cancellation, every effort will be made to give the Contractor a notice of 5 business days prior to the scheduled beginning of performance. In the event of cancellation, the contractor will only be paid for actual documented costs incurred in the performance of services in preparation for the Program. In the case of postponement of the Job Search/Transition Program, the contractor will be reimbursed only actual documented costs that cannot be deferred until the rescheduled session(s).
Contractor and Counselor Administrative Duties The Government requires that the same contract Counselor perform for the entire JSTP offering i.e. up to the full session duration not to exceed 110 hours. Counselors may not be substituted during performance, unless explicitly approved by the COR and only in case of emergency or illness. The contractor shall only supply the Counselors whose resumes and qualifications were submitted with the technical quote. Unless included in the submission of the initial quote and BPA award, any substitute, replacement, or additional Counselors proposed by offerors must be equally qualified and approved in advance by the COR. Individual contract Counselors and/ or their employers must notify the COR/ACOR and GTM (as applicable) in writing and via phone call as soon as possible if they are unable to perform their required scheduled hours during JSTP due to emergency or illness.
Data Rights
All materials developed by the contractor for use in JSTP become the property of the Government, and the contractor may not copy or reproduce them in any way for use outside of an FSI class, share them by any means outside of the Foreign Service Institute, or publish them in any fashion without the express permission of the Director of the Transition Center.
Period of Performance and Contractor Schedules The Period of Performance appears on the itemized line in Section B of individual BPA calls as well as in the attached JSTP schedule.
The overall JSTP schedule will be attached to each individual BPA call when it is issued (a sample JSTP schedule provided as an attachment to the solicitation). Schedules provided remain subject to change and adjustment in the event of unexpected government closures, or unforeseeable events such as public health emergencies. Contractors will not be penalized for unexpected closures that impede their ability to perform the required services (e.g., for in person JSTP sessions, snow days where the government is closed) The COR will determine the schedules of individual contract JSTP Counselors. Schedules may vary and not every contract Counselor may be required to perform the same number of hours in each JSTP offering. However, the total number of required scheduled hours will not exceed 110.
Government Provided Property The Government will provide all necessary teaching materials and supplies to perform the duties listed above; including but not limited to classroom facilities; standard audio-visual equipment and the existing technology used for training in the FSI classrooms.
All materials developed by the contractor for use in the JSTP under this contract remain the property of the Government and may not be published, shared, or used in any way outside of authorized Department of State training contexts. Additionally, all provided documentation and materials shall not be shared or published outside of FSI. For virtual delivery, contractors will use their privately-purchased computers and privately-purchased digital platform accounts to convene and conduct small and mid-sized group meetings and one to one counseling sessions. The government requests Counselors have at least two means of participating virtually. Virtual course platforms with video conferencing capabilities can be accessed from desktops, laptops, tablets and smart phones.
Quality Assurance The COR, ACOR, or GTM (Contracting Officers Representative, Alternate Contracting Officer’s Representative, Government Technical Monitor) determine acceptability of services according to the Performance Work Statement (PWS) and performance metrics. The Government has the right to inspect and approve all services called for in orders issued under the BPA. If the Contractor fails to perform the required services at an acceptable level as determined by the COR, ACOR , or GTM, either from a performance or professionalism standpoint, the Government reserves the right to cease issuance of additional orders under the BPA as well as terminate the BPA.
Technical Direction Contractor is expected to carry out responsibilities in a professional and timely manner as defined by the Performance Work Statement (PWS). The JSTP includes a structured curriculum with guidance each JSTP Contractor/ Counselor is expected to follow. A Counselor Handbook outlines specific curricula and activities, offering options and room for innovation based on professional experience, in collaboration with the Division Director and team of JSTP contract Counselors and CTC staff. Changes to the curriculum and recommended activities will be discussed in the JSTP Orientation, mid-seminar staff meeting and final evaluation meeting, and/or individually with the Division Director. It is assumed that once the contractor receives instructions about how to perform the duties that the contractor will implement the instructions. Should contractor performance not be adequate, the Government may not issue additional orders or terminate the BPA.
Neither the COR, ACOR, nor the GTM have the authority to make changes in this Performance Work Statement or in the terms and conditions of this contract; any necessary changes are only made by the Contracting Officer in the form of a bilateral agreement. The Contractor is forewarned that the Government will not compensate any additional work by the contractor if it is not authorized in the contract.
Place of Delivery Services under this contract may be performed at the Government's facility located at The George P. Shultz National Foreign Affairs Training Center at 4000 Arlington Boulevard, Arlington, Virginia or online in virtual format.
Contractors Awarded offerors understand that they are not Government employees. As such, the contractor is responsible for managing their taxes, health insurance, social security payments, etc. The Government will pay the contractor based on the fully loaded firm fixed session price established in the BPA award; the contractor is responsible for paying their personal expenses. The government will pay no benefits under this agreement. Contractors are responsible for paying daily parking fees at SA-42 or obtaining monthly permits as allowed.
Termination of Blanket Purchase Agreement If the government determines that the terms and conditions of the BPA are not adequately met, the government reserves the right to terminate for cause. The government may also terminate for convenience as determined by the government’s needs.
Failure to follow directions/guidance from the COR, ACOR, or/GTM can result in the termination of the BPA.
COR, ACOR, or GTMs are responsible for monitoring contractor performance. Should they observe that a contractor is failing to follow guidance, is unable to complete designated tasks, cannot work collegially with colleagues (both government employees and fellow contractors), or is demonstrating any other unprofessional behavior; the COR/GTM will advise the contractor and also notify the CO. Any of the above could result in the cancellation of individual orders or, the termination of a BPA.
Termination for Excusable Nonperformance
This BPA or any orders issued thereunder may be terminated by the Government in whole or in part without prior notice if the contractor is unable to perform due to illness, family emergencies, or other causes beyond the contractor’s control. Contractor shall not be liable for re-procurement costs, but shall receive no payment of unperformed services, and funds may be de-obligated from the order, on a unilateral basis, to the extent of the nonperformance and used to fund replacement order to other contractors for substitute services.

C.2 - Performance Metrics
1. Performance Metrics - Contractor Evaluation The awarded BPA and subsequent BPA calls will be closely monitored by the COR(s)/ACOR(s) and GTM(s) throughout the entire period of performance and will be reported on at minimum one time annually at the conclusion of each ordering period. The evaluation will be submitted via a format agreed upon by COR and the Contracting Officer. The evaluation will be considered in determining if additional BPA calls are issued. The performance metrics, by which the contractor company will be evaluated, including the contractor company's adherence to the PWS requirements, are included below.
2. Performance Metrics - Evaluation Ratings and Definitions The Contractor must be considered successful in fulfilling the contract requirements to be considered for future opportunities. To be considered successful the Contractor must receive a minimum of Very Good in all Evaluation Areas. Performance will be rated as follows:
Exceptional: Performance meets contractual requirements and exceeds many elements to the Government’s benefit. The contractual performance of the element or sub-element being evaluated was accomplished with few minor problems for which corrective actions taken by the Contractor were highly effective. Facilitator(s) routinely demonstrate outstanding facilitation skills, exceptional understanding of program requirements, and significantly exceeds performance standards.
Very Good: Performance meets contractual requirements and exceeds some to the Government’s benefit. The contractual performance of the element or sub-element being evaluated was accomplished with some problems for which corrective actions taken by the Contractor was effective. Facilitator(s) routinely demonstrates excellent facilitation skills, a strong understanding of program requirements, and exceeds performance standards. Facilitator has exceptional strengths that significantly benefit the Government.
Satisfactory: Performance meets contractual requirements. The contractual performance of the element or subelement contains some minor problems for which corrective actions taken by the Contractor appear or were satisfactory.
Facilitator(s) demonstrates acceptable facilitation skills, an acceptable understanding of program requirements, and meets performance standards. Facilitator has few or no additional strengths that benefit the Government.
Marginal: Performance does not meet some contractual requirements. The contractual performance of the element or sub-element being evaluated reflects a serious problem for which the contractor has not yet identified corrective actions. The Contractor’s proposed actions appear only marginally effective or were not fully implemented. Facilitator(s) demonstrates poor facilitation skills, a shallow understanding of program requirements, and does not meet performance standards.
Unsatisfactory: Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element or sub-element contains a serious problem(s) for which the Contractor’s corrective actions appear or were ineffective. Facilitator(s) routinely fails to demonstrate facilitation skills and an understanding of program requirements.
3. Performance Metrics - Evaluation Areas For each of the Evaluation Areas below, performance will be rated and evaluated using, but not limited to, the following considerations:
Quality:
The JSTP Counselor must adhere to the requirements as outlined in the PWS and facilitate high quality small group sessions and one-to-one counseling with assigned participants, as well as high quality and professional co-facilitation of mid-sized group sessions in collaboration with a partner/Counselor, and substantive technical knowledge of career development, career and life transitions, career assessment and job search techniques, and ability to demonstrate excellent professional counseling and coaching skills (devoting more than half of the sessions to listening and engaging the participant (s) experiences, reflections and feelings.) Multiple measurements will be used to formulate a rating between 1-5 including student feedback, quality of JSTP Counselor’s assigned “back-up Counselor reports”, review of JSTP and CTC Program reports, and observations of both the Career Transition Center Director and COR/GTM.
Schedule/Timeliness of Performance:
The JSTP Counselor must adhere to JSTP and CTC program sessions and events, and reporting deadlines specified by the COR/ GTM. The ratings on a scale of 1 to 5 will be formulated by the COR/GTM based on his/her observation and input from the Career Transition Center Director.
Management/Business Relations/Customer Satisfaction:
The JSTP Counselor must provide effective customer service to the internal FSI clients of this contract- COR/GTM, Career Transition Center Division Director, CTC and TC staff, and JSTP participants - per their duties in the PWS. The COR/GTM will use his/her expertise and general observance of interactions and customer service with colleagues, JSTP speakers/panelists, FSI staff, and JSTP participants. A rating between 1-5 in two categories, JSTP Counselor services and JSTP Program Reports, will be tabulated for this evaluation.
- JSTP Counselor services – Multiple measurements will be used to formulate a rating for this evaluation category, including: student feedback of JSTP Program, FSI staff feedback and COR observations. The COR/GTM’s observations of the JSTP Counselor will include timeliness of responses to inquiries and requests within the scope of the contract, and execution of JSTP responsibilities. The JSTP Counselor should consider the following factors when counseling individuals and small groups and when facilitating mid-sized and large groups and plenary sessions: student privacy, confidentiality, emotional and mental health issues, decision-making and adjustment issues, career and retirement planning issues, and dynamics of participants in the JSTP.
- JSTP Program Reports– The following measurements will be used to formulate a rating for back-up Counselor reports: a review by the COR/GTM with special consideration for scope, timeliness of delivery, and the quality of the analysis and recommendations. In addition to the JSTP Counselor back-up Counselor reports, Counselors keep confidential records for each small group participant through the end of the program. Counselors must destroy confidential notes especially personally identifiable information (PII) notes about participants.
Counselors submit their small group participants’ final resumes, DoS Retirement Agreement and the Participant Contact Sheet to CTC staff and these are maintained for three years. Measurement will consist of observation of confidentiality throughout the program by the COR/GTM and timely file management with shredding of confidential records following the JSTP Evaluation meeting. Third, in the JSTP Evaluation meeting, Counselors analyze and report on the overall program and on one specific week in groups of two or three. Evaluation of the Counselors reports include following measures: keeping to the time limits for review of data, preparation of a report, and following the guidelines for reports provided on the agenda for the meeting.
Key Personnel:
The COR will assess the contractor's performance in selecting, retaining, supporting, and replacing, when necessary, key personnel JSTP Counselors. The JSTP Counselor(s) must adhere to the requirements as outlined in the PWS to facilitate high quality one-on-one, small group, and mid-sized group sessions. They should have substantive knowledge of career transition theory and self-assessment tools, such as the MBTI Step II and OneLifeTools’ “Who You Are Matters-virtual.”
Additional considerations:
- How well did the contractor match the qualifications of the key position, as described in the contract/order, with the person who filled the key position?
- Did the contractor support key personnel so they were able to work effectively?
- If a key person did not perform well, what action was taken by the contractor to correct this?
- If a replacement of a key person was necessary, did the replacement meet or exceed the qualifications of the position as described in the contract or order schedule?
E.1 - Inspection and Acceptance of Services
The Contracting Officer’s Representative (or the ACOR in the COR’s absence) shall make inspection and acceptance of the services to be provided hereunder. GTMs cannot accept services, but can advise the COR appropriately.
E.2 - The Role of Government Personnel and Responsibility for Contract Administration
*Contracting Officer (CO): The CO has the overall responsibility for administering this contract. He/she alone, without delegation, is authorized to take actions on behalf of the Government to: amend, modify, or deviate from the contract terms, conditions, requirements, specifications, details and delivery schedules; make final decisions on disputed deductions from contract payments for non-performance or unsatisfactory performance; terminate the contract for convenience or default; and issue final decisions regarding contract questions or matters under dispute. Additionally, he/she may delegate certain other responsibilities to authorized representatives.
*Contracting Officer’s Representative (COR): The COR is responsible for promptly notifying the Contracting Officer in writing of any noncompliance or deviation in performance or failure to make progress; knowing and understanding the terms and provisions of the contract; knowing the scope and limitations of your authority; using good judgment, skill and reasonable care in the exercise of authority; protecting privileged and sensitive procurement information. If questions arise which are not clearly answered in the contract or if disputes with the Contractor occur, prepare a written report to the Contracting Officer setting forth the problem(s) encountered. The COR will be responsible for technical direction, reviewing and approving contractor work plans, assessing contractor progress against work plans, receipt and acceptance of contract deliverables, reviewing and approving invoices. The COR is also responsible for keeping the CO informed of any issues affecting contractor’s performance under the contract. Alternate COR(s) may be delegated to assume the role of the COR in the absence of the delegated COR.
*Government Technical Monitor (GTM):
Government Technical Monitor (GTM): The GTM will assist the COR in discharging responsibilities. The responsibilities of the GTM include, but are not limited to: monitoring and inspecting the Contractor's progress and performance; evaluating contractor performance with the terms and conditions of this contract; acting as the Government's representative at the work site; advising the contractor of proposed deductions for nonperformance or unsatisfactory performance; preparing receiving reports; and advising the COR of any factors which may cause delay in work performance.
E.3 - Quality Standards
All services performed under BPA calls issued from this BPA shall be of the highest quality standards, consistent with best industry practices, to assure timely provision of services, optimum Department of State customer satisfaction, and adequate protection of Government assets.
52.246-4 - Inspection of Services-Fixed-Price (Aug 1996)
(a) Definition. "Services," as used in this clause, includes services performed, workmanship, and material furnished or utilized in the performance of services.
(b) The Contractor shall provide and maintain an inspection system acceptable to the Government covering the services under this contract. Complete records of all inspection work performed by the Contractor shall be maintained and made available to the Government during contract performance and for as long afterwards as the contract requires.
(c) The Government has the right to inspect and test all services called for by the contract, to the extent practicable at all times and places during the term of the contract. The Government shall perform inspections and tests in a manner that will not unduly delay the work.
(d) If the Government performs inspections or tests on the premises of the Contractor or a subcontractor, the Contractor shall furnish, and shall require subcontractors to furnish, at no increase in contract price, all reasonable facilities and assistance for the safe and convenient performance of these duties.
(e) If any of the services do not conform with contract requirements, the Government may require the Contractor to perform the services again in conformity with contract requirements, at no increase in contract amount. When the defects in services cannot be corrected by reperformance, the Government may--
(1) Require the Contractor to take necessary action to ensure that future performance conforms to contract requirements; and
(2) Reduce the contract price to reflect the reduced value of the services performed.
(f) If the Contractor fails to promptly perform the services again or to take the necessary action to ensure future performance in conformity with contract requirements, the Government may--
(1) By contract or otherwise, perform the services and charge to the Contractor any cost incurred by the Government that is directly related to the performance of such service; or
(2) Terminate the contract for default.
