(i) The Government is contemplating a single award of a competitive, commercial, Firm-Fixed Price (FFP) purchase order, using the purchase order which represents the best value to the Government using trade-off procedures for the services described in these instructions. This solicitation is open to all Small Business participation. The Government reserves the right to cancel this solicitation at any time. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in the Federal Acquisition Regulations (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.

(ii) This solicitation number 192122CCO21000006 is issued as a request for quotation (RFQ).

The resultant contract will be a firm-fixed price contract.

(iii) This solicitation document (RFQ) and incorporated provisions and clauses are those in effect through Federal Acquisition Circular ((FAC) 2005-101.

(iv) This proposed acquisition is 100% set-aside for Small Businesses participation only.

This acquisition is under NAICS 485999 - All Other Transit and Ground Passenger Transportation Services. The size standard is $16.5M annually.

(v) The following is a list of line item number(s) and items, quantities, and units of measure, (including option(s)), needed by the Department of Homeland Security (DHS), Immigration and Customs Enforcement (ICE) Agency, the Office of Principal Legal Advisor (OPLA).

(vi) DHS/ICE/OPLA has a requirement for Passenger Transport Services in accordance with the attached Performance Work Statement (PWS).

(vii) FAR clause 52.212-1, Instructions to Offerors-Commercial Items (April 2014) applies to this acquisition. To be considered for award quotes must be submitted on the attached pricing template with prices provided for all contract line item number (CLINS). Also, contractors must have an active DUNS. Provide your company's DUNS along with your quote. The Technical Proposal is limited to 15 pages. All pages after page 15 will be deleted. Font will be 12 point Times New Roman. Margins will be one (1) inch. Failure to comply with any of these instructions will result in the offer being determined non-responsive. Late submissions will not be accepted.

(viii) The FAR provision 52.212-2, Evaluation-Commercial Items (OCT 2014), does apply to this RFQ. The order will be awarded to the responsible offeror who represents the best value to the government. Technical acceptability will be determined based on the offerors’ demonstrated understanding/fulfillment of the Performance Work Statement (PWS) as described in its proposal. The following factors shall be used to evaluate offers:

Technical Capability and Delivery when combined are more important than Price. As the non-price evaluation of quotations determines there are no substantial differences, price becomes more important, but not necessarily determinative, in making the award determination.

Each factor will be given a consensus rating, based on the evaluation team’s collective evaluations. Individual evaluators will not assign ratings, but rather will collectively decide what confidence rating each offeror will receive for each factor. Each offeror will have three confidence ratings (Factors 1-2) and price (Factor 3) will be evaluated for reasonableness.

DEFINITION OF RATINGS:

The table below shows the confidence ratings the Government will assign in its evaluation of offers when evaluating Factors 1 and 2.

High Confidence The Government has high confidence that the offeror understands the requirement, proposes a sound approach, and will be successful in performing the work.

Some Confidence The Government has some confidence that the offeror understand the requirement, proposes a sound approach, and will be successful in performing the work.

Low Confidence The Government has low confidence that the offeror understands the requirement, proposes a sound approach, or will be successful in performing the work.

TECHNICAL CAPABILITY

The offerors shall provide a description of their technical capabilities, detailed and complete enough to clearly and fully demonstrate their understanding and capabilities to carry out the requirements of the PWS. Although it is recognized that all the technical criteria cannot be detailed in advance, the techniques and procedures the offeror plans to follow in conjunction with the task areas to be performed must be described in as much detail as the offeror considers necessary to fully explain and demonstrate their proposed technical approach and capabilities. At a minimum, the offeror’s Technical Capabilities shall describe how it will carry out the requirements for passenger transport services.

The written narrative of the technical proposal must include a minimum of three (3) examples of demonstrated performance of Passenger Transport Services on similar requirements (including contract numbers, points of contact with telephone numbers and other relevant information) for work within the past two years. A quote may be determined technically unacceptable and ineligible for award if the offeror demonstrates as lack of detail or only includes a quote to perform in accordance with the Government’s PWS.

DELIVERY

The Government has a current need for Passenger Transportation services in Newark, NJ.

Offerors must include a statement of their ability to provide services in Newark, NJ as described in Section 1 of the Performance Work Statement (PWS). Offers that do not include a statement of their ability to provide services in Newark, NJ will be considered unacceptable.

PRICE

The Government will evaluate offers for award purposes by adding the total price for all options and -8 Extension of Services to the total price for the basic requirement. The price of extension of services will be evaluated based on it being half of the price proposed for option year 4. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(ix) All offerors shall complete provision at 52.212-3, Offeror Representations and Certifications-Commercial Items (MAR 2015), electronically via the System for Award Management (SAM) online at http: www.sam.gov or if an Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (p) of provision 52.212.3 and submit a copy of with the offer.

(x) FAR clause 52.212-4, Contract Terms and Conditions-Commercial Items (Jan 2017), applies to this acquisition.

(xi) A statement that the clause at 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders-Commercial Items (Jul 2018), applies to this acquisition and the clause are applicable to the acquisition are listed in the attached Terms and Conditions

(xii) The date, time and place offers are due: Quotes are due no later than 22 October 2021, 11:59 PM Central Time (CT). Quotes shall be submitted by email to Cory Chandler, Contract Specialist, Cory.Chandler@ice.dhs.gov.

(xiii) The name and telephone number of the individual to contact for information regarding the solicitation: Questions shall be submitted, by email only, to Cory Chandler, Contract Specialist, cory.chandler@ice.dhs.gov. All questions shall be submitted no later than 20 October 2021, 11:59 PM Central Time (CT)
