1. Performance Work Statement

1.1 Post Award Conference

A post award conference is required. It will be scheduled and held prior to the start of work.

1.2 Government Quality Assurance Surveillance Plan

The Government will monitor progress to assure the Contractor is providing acceptable quality and that work meets performance standards. Government inspections, as described below, are for payment determination only and are not intended to be used as a quality control by the Contractor. Surveillance will consist of sample plots to determine compliance with the specifications. Plots will be located throughout the contract area to obtain a representative sample of the work. The Contractor may observe plot procedures while they are underway.

The Government will additionally conduct a visual inspection to ensure compliance with leave tree selection, cutting methods, and slash treatment. Each component must equal or exceed the performance threshold of 90% for full payment. If cutting methods, leave tree requirements or slash treatment appear to fall below 90% quality, the inspector will document deficiencies through inspection plots, photographs and indicate the areas and acreage affected. Areas less than 90% quality will be considered unsatisfactory, and unsatisfactory acreage exceeding 10% of item acreage will be terminated for cause. Cutting trees larger than those defined or outside of the areas described in this contract may result in a termination for cause.

The following actions will be considered as being in non-compliance:

a) Specified trees and shrubs not cut.

b) Weed treatment not complete or non-compliant.

c) Slash treatment not complete or non-compliant.

d) Stumps too high.

e) Cut trees that are interfering with crop trees.

f) Cutting of reserve or crop trees.

1.3 Inspection Plot Procedure

The Government inspector will mark on the ground a series of plots sufficient in number to sample at least one percent of the acres. Plot centers will be numbered and marked with flagging. A minimum of five plots will be established on each unit; units will not be combined for quality determination.

Inspections will not occur until all activities, including slash and weed treatment are complete.

a) Each plot will be examined to record findings on the items listed below:

Number of missed stems (stems that should have been cut but were not, or were improperly cut) Number of leave trees that were cut, but should not have been cut Number of stems that should have been cut

b) The following formula will be used to calculate the quality of the work for all cutting work:

Quality % = (1 -(no. of missed stems + no. of leave trees cut)) *

no. of stems that should have been cut

1.4 Unsatisfactory Performance

The minimum acceptance quality is 90%. If the quality may be improved by reworking the area (e.g., lowering stump heights or re-arranging slash), the Contractor shall rework the area to meet specifications. The Government will permit the Contractor to rework an area only if the existing deficiencies can be corrected. Only one rework is permitted. The COR will then conduct a second inspection. If the quality is still below 90%, the CO will issue a termination for cause of each failed item.

2. SPECIFICATIONS:

2.1 Scope of Work

The purpose of this item is to secure services for tree release and brushing treatments in such a manner as to release desirable tree seedlings from competing brush and to prepare sites for tree planting by cutting brush.

The Contractor shall, considering given resource objectives for the work unit, develop a plan of operation to accomplish these objectives, organize, and direct all the equipment and personnel needed to fully accomplish the work. The Contractor shall furnish all technical expertise, labor, equipment, supervision, transportation, operating supplies, services, permits, licenses, and credentials necessary to complete the work required. All aspects of the work program shall be performed in an organized, systematic, and safe manner to assure services will be performed over the entire project area.

2.2 Definitions

Brush – Shrubby vegetation that does not produce commercial timber. Hardwood trees like Bigleaf maple, Oregon ash, and Pacific madrone are generally defined as brush under this contract since they are growing as stump sprouts.

Crop Tree – In this contract crop trees include all conifer species and Oregon white oak seedlings that are at least 4-inches tall or greater.

Natural Regeneration – The establishment of a plant or a plant age class from natural seeding or sprouting.

Release – A treatment designed to free young trees from undesirable, competing vegetation.

Site Preparation – Hand or mechanized manipulation of a site, designed to enhance the success of regeneration.

2.3 Location and Description

The location, access, and acreage of each line item, as well as other information pertinent to this item are contained in the Vicinity and Unit Maps. All units are located on the Umpqua National Forest, North Umpqua Ranger District. All units were burned in 2020 and may or may not have had salvage treatments. Units with salvage treatments will be specified in the Schedule of Items.

Unit conditions are highly variable and consist of a mix of potential brush species. Dominant brush species and potential cover are noted in the Schedule of Items, but may include Ceanothus velutinus (snowbrush), Ceanothus integerrimus (deerbrush), Cytisus scoparius (scotch broom), and Rubus armeniacus (Himalayan blackberry), among other potential brush such as hardwood resprout clumps.

In addition, unit slope conditions may exceed 90 percent in some areas. Slope conditions are shown on the detailed unit maps. For visual examples of possible conditions that may be encountered, two photos have been attached showing cases of heavy brush cover of snowbrush in Unit 205 (Figure 1) and more extreme examples of slope conditions that may be encountered as shown in Unit 110 (Figure 2). These figures are meant to portray some of the more extreme conditions that may be encountered and are not meant to serve as an average representation of conditions across units.

Line Item 1.1: Brushing for Site Preparation (Site Prep) – Units may or may not have been planted.

Stocking levels are expected to be under 150 trees per acre (TPA). Brushing will be used to prepare units for future planting.

Line Item 1.2: Tree Release – Units may or may not have been planted. Stocking levels are expected to be above 150 TPA. Brushing will be used to remove competing vegetation away from planted and naturally regenerating seedlings.

All units are within ¼ mile of Forest roads that are accessible by a standard two-wheel drive pickup equipped with snow tires and chains, if needed, during normal operating seasons.

Roads shown on unit maps indicate access to units and are not to suggest the roads are open within units or for any further travel.

Use of motorized equipment other than hand-held equipment such as power saws and brush cutters will not be permitted off designated roads in the project area without approval of the COR, or as hereinafter provided.

2.4 Cutting Methods

All brush that are less than 5-inches DBH shall be cut (unless listed under the Leave Tree Selection section).

Standard cutting methods for all units include the following:

During release/brushing activities, brush will be cut below the lowest branch and not higher than 6 inches above the ground level unless otherwise specified. Stumps shall be cut to less than a 30 degree angle.

Bigleaf maple, Oregon ash, AND Pacific madrone stump sprouts should be thinned (instead of completely cut) down to 2 of the strongest stems instead of completely cut.

The cut brush shall not be on top of, or otherwise positioned, to impede the growth or form of a crop tree or positioned on top of any leave tree.

Annuals such as grasses, sedges, ferns, etc. are not required to be cut.

2.5 Leave Tree Selection

The following trees shall not be cut:

(1) Live conifer (including Pacific Yew)

(2) Live Oregon white oak

(3) Live trees greater than or equal to 5” DBH

(4) Snags, unless for safety reasons

(5) Monumented trees (visibly marked)

2.6 Slash Treatment

Lop and scatter to distribute woody material throughout the unit up to 18 inches in depth. Cut stems shall not exceed 6 feet in length. Cut material shall not be placed against in a leaning position, or on top of, any leave trees. Cut material shall also be moved at least 12-inches away from any crop tree.

In areas of heavy brush where this may not be feasible for all seedlings, the contractor should coordinate with the COR to continue to keep brush from being piled on top of seedlings, especially those that are the tallest and most healthy.

An additional slash treatment is required in Unit 116 where the popular hiking trail Fall Creek Falls runs through the western edge of the unit (exact trail location shown in the unit map for Unit 116).

Where the trail intersects with the unit, slash shall be pulled back by at least 5 ft on either side of the trail as work is being done. The Contractor will coordinate with the COR to communicate when crews are working in this unit so that the public can be properly advised.

2.7 Weed Treatment

Units 201 and 215 have specific weed treatments that are listed in the schedule of items. Contractors should bid accordingly for work specific to those units, which in addition to brushing treatments will include the following:

Scotch Broom Treatment – Scotch broom greater than or equal to ½-inch diameter at ground level will be cut as close to the ground as possible. Stump heights for scotch broom shall not exceed 3 inches above the ground level. Scotch broom less than ½-inch diameter at ground level shall be pulled and uprooted rather than cut. Lop and scatter all scotch broom material as described in the slash treatment section.

Blackberry Treatment – All non-native blackberry will be cut as close to the ground as possible.

Stump heights for blackberry shall not exceed 3 inches above the ground level. Lop and scatter all material as described in the slash treatment section.

2.8 Preservation of Historical And Archaeological Resources

If in connection with operations under this contract the Government, the Contractor, Subcontractor(s), or the employees of any of them, discovers, encounters or becomes aware of any objects or sites of cultural value on the project area, such as historical or pre-historical ruins, graves or grave markers, fossils, or artifacts, the Contractor shall immediately suspend all operations in the vicinity of the cultural value and notify the COR in writing of the findings. No objects of cultural resource value may be removed. Operations may resume at the discovery site upon receipt of written instructions.

(d) Comptroller General Examination of Record. (2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

Contracting officers will not consider these representations when making award decisions or enforce requirements. Entities are not required to, nor are they able to, update their entity registration to remove these representations in SAM.

FAR 52.212-1 INSTRUCTIONS TO OFFERORS – COMMERCIAL PRODUCTS AND

Addenda to provision 52.212-1:

Addenda to paragraph (b) Submission of Quotes:

1) Quoters must have an active entity registration in the System for Award Management in order to submit a quote. https://www.sam.gov/SAM/

2) Quotes submitted in response to this solicitation shall include Technical Quote, Relevant Past Experience, Price Quote

a) Technical Quote – The technical quote shall address the evaluation factors in 52.212-2.

At a minimum technical quote shall include:

1) Quality Control

The Contractor shall provide a Quality Control Plan (QCP). The Plan must demonstrate how the Contractor shall assure that quality of performance meets the objectives and requirements of the task order. The QCP shall specify:

- How quality will be monitored to ensure performance standards are met.

- How the work will be supervised.

- How results of the monitoring will result in quality performance.

- Identify the personnel responsible for performing quality control.

2) Work Plan and Schedule

-Provide your general Work Plan including crew size, work schedule, and production rate that will allow you to complete the work to meet performance time for work you are proposing to do.

-Describe your ability to adjust crew sizes in order to complete the work acceptably and on time.

-How will you organize your workforce to achieve the various contract requirements?

3) Contractors must submit copies of their MSPA Certificate of Registration from the Federal DOL, their Oregon State BOLI license, and Temporary Employment Certificate if using H2B workers, along with their quote, to have their quote considered for award, if they intend to Migrant and Seasonal Agricultural Workers. b) Relevant Past Experience - List of references to call or contact from the last 3 years

Each reference shall include the following information:

1) Date of contract

2) Type of work, contract name, etc

3) Contract number

4) Agency

5) CO and/or COR name & telephone number

And answer the following questions:

6) Quality of Work - - the quoter will be evaluated on compliance with previous contract requirements, accuracy of work and technical excellence

7) Business -the quoter will be evaluated on demonstrated effective management, ability to manage projects involving subcontracts, working relationship with Contracting Officer and technical representatives, reasonable/cooperative behavior, flexibility, effective contractor recommended solutions, business like concern for Government interest.

8) Timeliness of Performance – the quoter will be evaluated on meeting contract milestones, reliability, responsiveness to direction, deliverable completed on time and adherence to contract schedule.

Other sources may be utilized to determine quoter’s experience and evaluator knowledge of quoters performance may be utilized.

c) Price Quote – Include the following: 1) completed, signed SF-1449 from page 1 of this solicitation, 2) Include the completed price schedule contained on page 2 of this solicitation.

3) Notification of Subcontracting The Contractor shall notify the Contracting Officer as part of their solicitation response of any subcontract arrangement. The subcontractor shall have the experience and be equipped for such work. The written notification shall include as a minimum:

(a) The name, address, UEI number and telephone number of the subcontractor

(b) The date upon which the subcontract was entered into and its duration

(c) A detailed description of the work being subcontracted including a listing of contract items, units, etc., as appropriate.

(d) Documentation of the subcontractor's representative authority.

Subcontracting any portion of the contract shall not relieve the Prime Contractor of any responsibility under this contract. Any subcontract agreement shall contain all terms and conditions of the prime contract.

Emails should contain 4 separate attachments (Technical Reverent Past Experience, Price Quote, and Subcontractor information) in Microsoft Word or Adobe PDF format. FAR 52.212-2 EVALUATION – COMMERCIAL PRODUCTS AND COMMERCIAL

SERVICES (NOV 2021)

(a) The Government will award a Firm-Fixed Price contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(b) A written notice of award or acceptance of an offer, emailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.

EMPLOYMENT OF ELIGIBLE WORKERS

WORKFORCE CERTIFICATION

Contractors are required to provide certification under this solicitation in compliance with the Migrant and Seasonal Agricultural Workers Protection Act (MSPA) and Farm Labor Contractor (FLC) Certificate of Registration requirements describing the workforce they will utilize to fulfill the contract requirements under this solicitation and any resulting contract. If the Contractor will supply workers under the H-2B Program, the Contractor is required to provide a copy of the Temporary Employment Certificate issued by DOL.

Subcontractors are bound by the same requirements for licenses and permits under this contract. If a Prime Contractor identifies a Subcontractor as part of their workforce to accomplish the work under this solicitation, the Prime Contractor shall submit the Subcontractor's signed certification with their response to the solicitation.
