52.217-9 Option to Extend the Term of the Contract (Mar 2000) Comment by Johnson, Melissa -FS: Use in solicitations and contracts when the inclusion of an option is appropriate (see 17.200 and 17.202) and it is necessary to include in the contract any or all of the following:

(2) A statement that an extension of the contract includes an extension of the option.
(3) A specified limitation on the total duration of the contract.
For IDIQ contracts where ordering periods are established instead of option years, this clause would not be included. In this situation, the PoP at time of award could be stated as up to 5 years to reflect all IDIQ order periods.
(a)The Government may extend the term of this contract by written notice to the Contractor within 60 days provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. Comment by Johnson, Melissa -FS [2]: Tailor offer submission information here. What do you want the contractor to submit based on the evaluation factors in 52.212-2?

Sample Language:
Addenda to Provision 52.212-1: Comment by Johnson, Melissa -FS [2]: If you are requesting quotes rather than proposals, you can include verbiage like this since 52.212-1 uses the term offer/offeror rather than quote/quoter.
For simplified acquisitions, the word quote or quoter is substituted in provision 52.212-1 for the word offer or offeror.
Addenda to Provision 52.212-1 paragraph (b) Submission of Offers:
1) Offerors must have an active entity registration in the System for Award Management in order to submit an offer. https://www.sam.gov/SAM/

What you ask for must match the 52.212-2 evaluation factors. Be sure to include a bio-based factor when applicable. |
| i) Past Performance – provide a list of similar projects completed by your firm over the past three years. Include a brief description of the project, dollar amount, year completed, and project owner contact information (name, phone, and email). The government may use past performance information from any available source. If a company does not have past performance information available, information may be provided for predecessor companies, key personnel, or subcontractors. In the event that there is no past performance information available, the offeror will receive a neutral rating in this factor. | |
| ii) Technical Capability – Provide a list of equipment and key personnel (with qualifications) that will be used to complete this project. |
b) Price Proposal – Include the following: 1) the completed, signed SF-1449, 2) acknowledgement of any amendments to this solicitation by following the instructions that accompany the amendment(s), and 3) the completed Schedule of Items contained in Section B of this solicitation.

52.212-2 Evaluation – Commercial Products and Commercial Services (NOV 2021) Comment by Johnson, Melissa -FS: When the use of evaluation factors is appropriate, the contracting officer may (1) Insert the provision at 52.212-2, Evaluation-Commercial Items, in solicitations for commercial items (see 12.602); or
(2) Include a similar provision containing all evaluation factors required by 13.106, subpart 14.2 or subpart 15.3, as an addendum (see 12.302(d)).
FILL IN THE BLANKS. Coordinate with provision 52.212-1 so that you are requesting sufficient documentation to address the factors here. Add a bio-based factor when applicable.
CO must justify the use of the LPTA source selection process. Not to be used for IT, telecom, professional services, PPE, or training. (see FAR 13.106-1(a)(2)(v) and FAR 15.101-2)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
Past Performance Price
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
Comment by Johnson, Melissa -FS: Choose the clause that fits your needs. You can leave all three of these out if you include provision 52.212-2 since it has a section that describes options.
NOTE: if you’ve included clause 217-8 for a 6-month extension you should include clause 217-5 in full text and tailor it to say the total price for the 6-month option applicable to clause 52.217-8 will be evaluated by using the prices offered for the last option period to determine the price for the 6-month option. This 6-month option will be added to the base and other options for total price evaluation.
52.217-5 Evaluation of Options. (July 1990)
Except when it is determined in accordance with FAR 17.206(b) not to be in the Government’s best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s).
