Attachment V Additional Instructions

General

Award will be made to the lowest priced, technically acceptable, responsive and responsible Offeror. This is a competitive LPTA selection. By submission of its offer, the Offeror accepts all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements. Offerors must clearly identify any exception to the solicitation and conditions and provide complete accompanying rationale.

1. Number of Contracts to be awarded:

The Government intends to select one contractor to provide the services covered herein. However, the Government reserves the right to award no contract, depending on the quality of proposals and prices submitted.

2. Rejection of Unrealistic Offers:

The Government may reject any proposal that is evaluated to be unrealistic in terms of program commitments, including contract terms and conditions or unrealistically high or low in price when compared to Government estimates, such that the proposal is deemed to reflect an inherent lack of competence or failure to comprehend the complexity and risks of program.

Evaluation

This acquisition will utilize Lowest Price Technically Acceptable (LPTA) source selection procedures. Failure to meet a requirement may result in an offer being determined technically unacceptable. Technical tradeoffs will not be made and no additional credit will be given for exceeding acceptability. Award will be made to the acceptable Offeror with the lowest evaluated price, which is deemed responsible and whose proposal conforms to the solicitation requirements. The Government reserves the right to award without discussions. Therefore, each initial offer should contain the Offeror’s best terms from a price and technical stand point. However, the Government reserves the right to conduct discussions if determined to be in the Government’s best interest by the Source Selection Authority (SSA).

Evaluation Factors

The Government will evaluate the factors and subfactors described below:

Factor 1 – Technical Acceptability Factor 2 – Price

1. Evaluation Methodology:

A technical evaluation will be performed on all offers. Offers that are found technically acceptable will be ranked according to price. The lowest priced offer will be evaluated for past performance. If that offer does not have acceptable past performance, the next lower offer will be evaluated for past performance, etc. Award will be made to the lowest evaluated priced proposal meeting the acceptability standards.

2 Technical Factor:

Technical proposals will be evaluated for acceptability in accordance with the criteria set forth in this section. The offeror’s technical proposal must convey to the Government that the Offeror is capable, possesses adequate technical expertise and experience, possesses sufficient resources, and is able to plan, organize, and use those resources in a coordinated and timely fashion to meet the needs of the Government.

It is the offeror’s responsibility to clearly demonstrate their submission meets the Technical Requirements/Statement of Work. The offeror shall clearly address each area of the Statement of Work.

3. Price

The offeror’s price proposal will be evaluated based upon the total evaluated price. The total evaluated price will be calculated as the sum of the proposed prices for both CLINS and all options. Evaluation of options is not a guarantee that the option will be exercised by the government.

The Government may also determine a proposal unacceptable should the proposed prices, be materially unbalanced. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more items is significantly overstated or understated as indicated by the application of price analysis techniques.

Proposed prices will be evaluated for reasonableness. For a price to be reasonable, it shall represent a price to the Government that a prudent person would pay when consideration is given to prices in the market. Price reasonableness may be established by adequate price competition and/or price analysis techniques.

The resulting contract will be a Indefinite-Delivery, Requirements contract. Each unit price shall be a Firm Fixed Price. The government will modify the contract for an Economic Price Adjustment only when the Rocky Mountain PADD 4 Diesel price increases or decreases by 10%. The quantities identified for each period are estimates and may vary, depending on circumstances of training schedules. Contract pricing shall include all charges to the Government for the provision of the NIC Transportation services (e.g. overheard, profit, maintenance, etc.).

This solicitation indicates that, solely for the purpose of the EPA, fuel represents about 15% of CLIN price. The initial reference point is U.S. Energy Information Administration (eia) for Rocky Mountain PADD 4 Diesel retail prices on the effective date of contract award, EPA applies only if fuel prices change is +/- 10% and Government will allow EPA to be employed only at the time of quarterly task orders. The link to eia is http://www.eia.gov/petroleum.
