The Contractor shall be required to (a) commence work under this contract within the time give at the Task Order level calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than the time given in the Task Order* The time stated for completion shall include final cleanup of the premises.
*The Contracting Officer shall specify either a number of days after the date the contractor receives the notice to proceed, or a calendar date.

Section 00 21 00 - Instructions
00 21 00 STEP 1 INSTRUCTIONS
STEP I – SOLICITATION
INSTRUCTIONS TO OFFERORS
This procurement will be issued in accordance with FAR 4.403 and DFARS PGI 204.403.
Offerors must have a valid U.S. Facility Clearance Level (FCL) at the SECRET level or higher in order to respond to the RFP, because the RFP includes contract plans, specifications and drawings that are classified at a level which will be released only to Offerors possessing the appropriate clearance. All classified material must be handled in accordance with the National Industrial Security Program Operating Manual (NISPOM) (DoD 5220-22-M) and Industrial Security Regulation (DoD 5220.22-R).
The solicitation will be issued on an UNRESTRICTED basis under North American Industry Classification System (NAICS) code 236220. The corresponding SBA size standard is $39.5 million. The estimated cost range for the solicitation is a total contract capacity of $95,000,000.00. The procurement will result in a firm fixed price Multiple Award Contract for a target of five (5) firms.
The solicitation process for this RFP will occur in two steps: In Step I, the Government's objective is to receive and verify potential Offerors’ security clearances. In Step II, the Government will issue the amended solicitation and DD 254 only to those Offerors with a valid
FCL.
Procedures for Step I:
Offerors shall respond to Step I by providing verification of FCL. Offerors shall submit the SF 1442, completing blocks 14, 15, and 20, along with a memorandum on company letterhead, verifying the following:
1) Their firm has the required U.S. Facility Clearance level of SECRET;
2) Personnel who will perform on site at the embassy locations currently have U.S.
Security Clearances of TOP SECRET;
3) CAGE code;
4) The names of authorized individual(s) to speak on behalf of the firm and signature(s) of those individuals.
5) Contact Information for the Offeror’s Facility Security Officer.
6) If the Offeror is a Joint-Venture, they will also be required to submit their Joint-
Venture agreement.
NOTE: DD 254s will be accomplished prior to issuance of STEP II of the solicitation for all Offerors with a valid FCL.
Step I Proposals as described above are due NLT 2:00 PM, 24 March 2020. The preferred method of submission for Step I proposals is via e-mail to ericka.t.collins@usace.army.mil with courtesy copies to glenda.a.canty@usace.army.mil. If necessary and NLT than the 2:00PM, 24 March 2020 deadline, Step I proposals may be mailed to:

After the Government confirms that the Offerors meet the required minimum U.S. Security Clearance and are otherwise eligible to receive the classified documents, the Government will issue the Step II solicitation to those firms who provided a timely response to the Step I Security Verification Process outlined under the solicitation. Offerors will have a minimum of 30 calendar days to provide a proposal in response to the Step II solicitation contract terms and conditions. Exact due date and time will be provided in the Step II solicitation.
The project will consist of construction activities for facility renovations and repair requirements located in U.S. diplomatic facilities worldwide, with a heavy emphasis on renovations in secure spaces. Work shall include, but not be limited to, repair, enhancement, maintenance, and incidental demolition of facilities, utilities, real property systems, and other infrastructure requirements. Projects will not be design-build, as each project will be fully designed.
The anticipated contract ordering period is seven (7) years.
Place of Performance: Overseas location to be disclosed to only those Offerors with the proper, verified clearances.
It is anticipated that the procurement will be evaluated in Step II on the following factors:
Previous Experience; Technical Approach to the Sample Project; Past Performance;
Organizational Capabilities; and Price. Proposals will be evaluated to determine which offer provides the best value to the Government utilizing trade-off selection procedures. Once proposals are received in response to Step II, all technical evaluation factors, when combined, are significantly more important than cost or price.

(i) Mark, identify, transmit, store, and handle any defense articles provided for the purpose of responding to such solicitations, as well as any defense articles provided with or developed pursuant to their responses to such solicitations, in accordance with theDTC Treaties, the Implementing Arrangements, and corresponding regulations of the United States Government and the government of Australia or the government of the United Kingdom, as applicable, including, but not limited to, the marking and classification requirements described in the applicable regulations;

52.216-19 ORDER LIMITATIONS (OCT 1995)
(a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than $2,500.00, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract.
(b) Maximum order. The Contractor is not obligated to honor -
(1) Any order for a single item in excess of $95,000,000;
(2) Any order for a combination of items in excess of the maximum contract award amount; or
(3) A series of orders from the same ordering office within 30 days that together call for quantities exceeding the limitation in paragraph (b) (1) or (2) of this section.
(c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) of this section.
(d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within 1 day after issuance, with written notice stating the Contractor's intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source.
52.216-22 INDEFINITE QUANTITY. (OCT 1995)
(a) This is an indefinite-quantity contract for the supplies or services specified, and effective for the period stated, in the Schedule. The quantities of supplies and services specified in the Schedule are estimates only and are not purchased by this contract.
(b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. The Contractor shall furnish to the Government, when and if ordered, the supplies or services specified in the Schedule up to and including the quantity designated in the Schedule as the "maximum". The Government shall order at least the quantity of supplies or services designated in the Schedule as the "minimum".
(c) Except for any limitations on quantities in the Order Limitations clause or in the Schedule, there is no limit on the number of orders that may be issued. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations.
(d) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor's and Government's rights and obligations with respect to that order to the same extent as if the order were completed during the contract's effective period; provided, that the Contractor shall not be required to make any deliveries under this contract after expiration of the applicable task order.
52.216-32 TASK-ORDER AND DELIVERY-ORDER OMBUDSMAN (SEPT 2019)
(a) In accordance with 41 U.S.C. 4106(g), the Agency has designated the following task-order and delivery-order Ombudsman for this contract. The Ombudsman must review complaints from the Contractor concerning all task-order and delivery-order actions for this contract and ensure the Contractor is afforded a fair opportunity for consideration in the award of orders, consistent with the procedures in the contract.
