The criteria above guide responsibility determinations where pricing is comparable or where bids are reviewed for technical adequacy. If the Town determines that best-value selection applies, additional scoring guidance will be issued by addendum.
SECTION 2.0 PROJECT DESCRIPTION AND GOALS
2.1 Background
The Town of Oxford, a Maryland municipal corporation located in Talbot County, Maryland (the "Town"), is seeking sealed proposals for construction services under a grant-funded program to renovate a portion of the Strand roadway and beach access parking lot to improve drainage conditions. There are two main areas of persistent ponding along the roadway. To solve the ponding issue, the road will need to be regraded and drainage installed that connects to stormwater BMPs located in the beach access parking lot. The surrounding area includes a newly installed dune that requires minimal disturbance during construction.
The Phase 1 site plans include a sidewalk and low retaining wall to provide pedestrian access from the parking lot to the nearest beach access point, to improve drainage to the proposed channel drain, and to protect the dune from vehicular impacts that worsen drainage conditions. Adjacent private property will also be protected from impacts during construction.
2.2 Project Goals
The goals of this project are:
• Eliminate persistent nuisance ponding on the Strand roadway by regrading the road surface and installing a positive drainage system.
• Install stormwater BMPs in the beach access parking lot to treat, retain, and infiltrate stormwater.
• Construct pedestrian access improvements that also protects the dune including a new concrete sidewalk, curb and low retaining wall from the parking lot to the beach access point, meeting ADA accessibility requirements.
• Protect the existing dune from vehicular impacts and construction disturbance, repairing any dune impacts that occur during construction.
• Complete all work in compliance with MDE grant requirements, Town standards, and all applicable permits.
2.3 Scope of Work
The Work includes, but is not limited to, the following major items:
• Coordinating with the Town on permitting and approvals
• Milling and overlaying the existing road to the proposed alignment for positive drainage
• Installing curb/gutter, concrete sidewalk, and low retaining wall
• Installing channel drain system in the roadway
• Installing stormwater BMPs (infiltration/retention) in the beach access parking lot
• Ensuring limited impact to the existing dune and repairing dune where impacted
May 2026 | Page 6
• Implementing all required sediment and erosion control measures
• Providing traffic control during construction
• Ensuring all work necessary to complete the Phase 1 plans is completed
2.4 Current Environment and Neighbor Coordination
The project site is located in a coastal community with significant environmental sensitivities. The work completed on this project shall take those sensitive natural features into account and shall be carried out to protect the natural resources of the area, particularly the newly installed dune system adjacent to the Strand roadway.
The construction area is located in close proximity to residential properties, beach access users, and the Town's beach access parking lot, which may remain in partial use during construction. Professional courtesy and care shall be given to limit disruption to those neighbors and users, including their enjoyment and use of their properties. The Contractor shall coordinate with Town Staff and neighbors to create a harmonious environment throughout the construction process.
2.5 ADA Accessibility
All constructed pedestrian improvements, including the sidewalk and access path from the parking lot to the beach access point, shall be designed and constructed to comply with the Americans with Disabilities Act (ADA) Accessibility Guidelines and all applicable Maryland accessibility standards.
2.6 Permitting Responsibility
The Town has obtained or will obtain required permits from Talbot County and the Maryland Department of the Environment (MDE) for the work contained in this contract. The Contractor shall complete all work required by those approvals and permits, including coordinating all required agency meetings and inspections as part of the Lump Sum Base Bid. The Contractor shall review all permit documents and familiarize itself with the requirements of those permits prior to submitting a bid. The Contractor shall be responsible for obtaining any additional permits or approvals specifically required for its means, methods, or operations not covered by Town-obtained permits.
2.7 Subsurface and Site Conditions
No formal geotechnical investigation has been provided with this RFP. Bidders are strongly encouraged to attend the mandatory pre-bid site visit, to inspect the site, review existing conditions, and perform any independent investigation of surface and subsurface conditions deemed necessary prior to submitting a bid. The Contractor shall include all costs associated with unknown subsurface conditions appropriate to this type of coastal roadway project in its lump sum bid. The Town will not be responsible for additional costs arising from subsurface conditions that a reasonable site investigation would have revealed.
SECTION 3.0 INSTRUCTIONS TO BIDDERS
3.1 Purpose and Clarification of Terms
The purpose of this Request for Proposals is for the Town to contract, under a grant-funded program, to mitigate negative drainage conditions on the Strand in the vicinity of the beach access parking lot. Firms or individuals submitting a bid for award of a contract are referred to as "Contractors" or "Bidders" in this document. The Contractor awarded the contract is referred to as the "Successful Contractor."
3.2 Mandatory Pre-Bid Meeting

Award may then be made to the next lowest responsible Bidder, or the work may be re-advertised.
3.15 Notice to Contractors
Before submitting Bid Documents, the Contractor must become fully informed as to the extent and character of the goods and/or services required and completely familiarize itself with the requirements of these Bid Documents. Submission of a bid constitutes agreement with all items and conditions referred to herein.
Any items, systems, or devices supplied in this bid that are proprietary in nature relative to maintenance, repair, servicing, or updating must be disclosed on the bid form.

3. In case of an emergency requiring work on Saturdays, Sundays, or holidays, the Successful Contractor shall request permission from the Town.
4.17 Construction Safety and Health Standards
It is a condition of this contract that the Successful Contractor and any subcontractor shall not require any laborer or mechanic employed in performance of the contract to work in surroundings or under working conditions that are unsanitary, hazardous, or dangerous to health or safety, as determined under construction safety and health standards (Title 29, CFR Part 1926, as revised). Failure of the Town to inform the Successful Contractor of safety violations will not release the Contractor of responsibilities.
4.18 Vegetative Stabilization Requirements
Following initial soil disturbance or re-disturbance, permanent or temporary stabilization shall be completed within three (3) calendar days for the surface of all perimeter controls, dikes, swales, ditches, perimeter slopes, and all slopes greater than 3:1, and within seven (7) calendar days for all other disturbed or graded areas on the project site. All soil erosion control measures shall be in accordance with the 2011 Maryland Standards and Specifications for Soil Erosion and Sediment Control (or most current edition). No sediment and erosion control devices may be removed without prior approval from the applicable inspectors.
4.19 Guarantee / Warranty
1. The Successful Contractor shall furnish the Town with a one-year warranty of workmanship and materials, dating from the time of acceptance of the project, and shall make good any defects which may occur during that period.
2. If any special guarantees in excess of the one-year period are specified by the manufacturer, these guarantees shall take precedence over the one-year guarantee or warranty.
3. Upon completion of the work, and before final payment, the Successful Contractor shall submit, and obtain from each subcontractor, material supplier and equipment manufacturer general warranties.
4. There will be 10% retention on all invoices held throughout the one-year maintenance period unless the Successful Contractor gives a maintenance bond of equal value.
5. At the end of the one-year maintenance period, the Town will do a follow-up inspection. Anything found within 1 year will be fixed and repaired by the Successful Contractor. Release of the maintenance bond will occur once the Town is satisfied with any repairs required.
