Summary of RFP No. 21-031/IM Amendment 1

This is Amendment No. 1 to a Request for Proposal issued by the Palm Beach County Purchasing Department for Acoustic Water Leak Detection Survey Services. The amendment, dated May 11, 2021, provides clarifications and additional information to the original RFP with a proposal due date of Friday, May 21, 2021. The scope of work involves surveying approximately 100 miles of water mains, with the anticipated material breakdown consisting of 70% PVC (70 miles), 8% Ductile Iron Pipe (8 miles), 7% Cast Iron Pipe (7 miles), and 15% Asbestos-Cement (15 miles). A non-mandatory pre-proposal conference was held on April 28, 2021, with an attendee sign-in list provided as Attachment 1. The amendment addresses questions from three proposers regarding pre-bid attendance, electronic signatures, water main material specifications, and EBO (Equal Business Opportunity) requirements.

The amendment clarifies that proposals must be executed with original physical signatures from authorized officers, as the County does not accept electronic signatures. While the County's EBO Ordinance is applicable to this project, Affirmative Procurement Initiatives (API) have been waived, and there is no required minimum percentage for Small/Minority/Women Business Enterprise (S/M/WBE) participation. However, if subcontractors are utilized, required EBO documentation must be submitted. The amendment specifies that leak sound correlators are not required on service lines and water mains smaller than 6-inch diameter, with 10 miles of the 100-mile survey assumed to fall into this category. The County stated it is not inclined to accept exceptions to the Sample Standard Contract terms and conditions, and all amendments must be signed and submitted with the proposal to avoid deeming the proposal non-responsive.

AMENDMENT NO. 1 to

Questions received from Echologics, LLC, and the Water Utilities Department’s responses:

Per Article 11, the EBO Ordinance is made part of the contract. Please clarify the EBO requirements applicable to this project. Is there a required minimum percentage for S/M/WBE participation?

Pursuant to the County’s EBO Ordinance (sections 2-80.20 through 2-80.30 of the Palm Beach County Code), the County’s EBO program is applicable to this project; however, the Affirmative Procurement Initiatives (API) have been waived for this project. Please see Exhibit C to the Sample Standard Contract (Attachment 1). While there is no required minimum percentage for S/W/WBE participation, note that subsection 2.10 Small/Minority/Women Business Enterprise (S/M/WBE) / EBO Requirements includes information regarding the required documentation that must be submitted in the event that subcontractors will be utilized. You may contact the Office of Equal Business Opportunity by calling 561-616-6840 if more clarification is needed.

Per Section 4.3.5 “All potential leak locations shall be pinpointed with a computer based leak sound correlator when feasible”. Can PBC clarify potential non-feasible conditions where acoustic, computer based leak sound correlator will not be required?

Leak sound correlators are not required on service lines and small PVC water mains (less than 6-inch diameter). In such locations, single point acoustic leak detection methods are acceptable. The Contractor shall assume that 10% of the water mains to be surveyed (10 miles) will not require leak sound correlators.

Our legal team has reviewed the RFP- their suggested modifications are also available in the same document (Questions and Legal Suggestions from Echologics.docx). Modifications on General Terms and conditions: Section Comment

Section 2.10 - EBO Program Requesting to strike out Subsection (e) Compliance - Penalties (page 13)

A.3. Proposers should propose any exceptions to the Sample Standard Contract (Attachment 1) in their proposal. The County, however, is not inclined to accept any such exceptions since these are the County’s standard contract terms and conditions.

Regarding the requested modification to the General Terms and Conditions of the RFP, the County cannot accept this change request since it is a requirement of the EBO Ordinance.

All changes addressed in this Amendment No. 1 shall be incorporated into RFP No. 21- 031/IM and the final contract. All other terms and conditions of the RFP remain the same and unchanged.

NOTE: Please acknowledge receipt of this Amendment No. 1 by signing below and returning this page with your Proposal Response. Each Amendment to the RFP shall be signed by an authorized agent and submitted with the proposal or the proposal shall be deemed non-responsive.
