STATEMENT OF WORK (SOW)
STATEMENT OF WORK (SOW)
PERSONAL ASSISTANCE SERVICES (PAS)
1. SCOPE
This Statement of Work (SOW) establishes the requirement for contractor support services to assist an individual perform basic activities of daily living.
1.1 Background. The U.S. Equal Employment Opportunity Commission (EEOC) regulations implementing Section 501 of the Rehabilitation Act of 1973, the law that prohibits the federal government from discriminating in employment based on disability, require that as part of the obligation to engage in affirmative action, federal agencies provide PAS to individuals who need them because of certain disabilities. The EEOC regulations implementing the Rehabilitation Act in the Federal sector are found at 29 C.F.R. §1614.203.
While Federal agencies are generally prohibited from expending appropriated funds on personal expenses for employees, the restrictions do not apply to services that the government is legally required to provide, such as those required under the Rehabilitation Act. It is the Department of the Navy’s policy to provide PAS to its employees in accordance with the regulations, absent undue hardship on the agency. Navy commands can use independent contractors to provide PAS.
PAS are services that help individuals who, because of targeted disabilities, require assistance to perform basic activities of daily living, like eating and using the restroom. PAS allow such individuals to enjoy the opportunity and independence offered by paid employment. Federal agencies must provide PAS to employees who have targeted disabilities unless doing so would impose an undue hardship on the agency.
“PAS" is defined in the regulations as "assistance with performing activities of daily living that an individual would typically perform if he or she did not have a disability and that is not otherwise required as a reasonable accommodation, including, for example, assistance with removing and putting on clothing, eating, and using the restroom." The regulations do not attempt to list every activity that might constitute PAS. PAS do not include helping individuals with disabilities perform their essential job functions. In addition, PAS do not include performing medical procedures (e.g., administering shots) or medical monitoring (e.g., monitoring blood pressure).

3. REQUIREMENTS
3.1 GENERAL REQUIREMENTS
PAS. as required herein, shall consist of contractor personnel who aid one FRCSE employee in performing activities of daily living in the workplace as defined in the EEOC regulations.
3.1.1 WORK LOCATIONS AND FACILITIES
The contractor shall provide qualified personnel to provide Personal Assistance Services (PAS) for Fleet Readiness Center Southeast (FRCSE) personnel. The contractor’s PAS employee and FRCSE employee will be co-located and may be at either the FRCSE facilities in Florida on Naval Air Station Jacksonville (NAS JAX) or the personal residence of the FRCSE employee at times of telework. The primary work location will be the personal residence of the FRCSE employee which is 17 miles from NAS JAX.
3.1.2 Reserved
3.1.3 CONTRACTOR REPORTING REQUIREMENTS
Monthly Man-Hour and Invoice Support Report: This report shall be broken out by CLIN and shall list the name, and hours worked of each contractor employee based on daily documented clocked attendance. The contractor shall provide this information in an Excel spreadsheet. The contractor shall provide a list of all contract employees. Changes in contractor employee staffing shall be reported to the COR. The contractor shall inform the COR of any dismissals, and prior to any action involving new hires.
3.1.4 WORK SCHEDULE
3.1.4.1 Hours of Operation:
The hours of operation for FRCSE Jacksonville, including all remote sites are 0600 to 1530, Monday through Friday.
FRCSE employees have the flexibility of choosing to work a straight 8-hour workday schedule, Monday through Friday or work an alternate Compressed Work Schedule (CWS) wherein workdays are 9 hours on Monday through Thursday, with one Friday an 8-hour workday and the other Friday off. Therefore, on a CWS within a two-week pay period, one week is a 44-hour work week and the other week is a 36-hour work week. This is excluding federal holidays, installation closure, FRCSE shutdowns, severe weather closure, and furlough periods.
The FRCSE employee requiring PAS may choose to be on either a straight 8-hour workday schedule or CWS so the contractor PAS personnel must align their days and hours of work to exactly align with the FRCSE employee they are assisting.
After hours’ support will be required to support urgent FRCSE personnel that require PAS assistance to prevent loss of capability, production, damage to equipment, and/or have the potential for causing injuries to personnel.
3.1.4.2 Reserved

When a holiday occurs on a Saturday, Federal employees are normally granted the previous Friday as the holiday observance. When a holiday occurs on a Sunday, Federal employees are normally granted the following Monday as the holiday observance. There are occasions when the FRC reduces operations in conjunction with the following holidays: Thanksgiving Day, Christmas Day, and New Year's Day which encompass additional non-holiday workdays and weekends. When such a notice is given, the contractor shall modify their support level for the reduced operations.
3.1.4.4 Installation Closure:
When Federal facilities are closed by the Government, or when Federal employees are officially excused from work due to a holiday or a special event, severe weather, a security threat, or any other Government facility related problem that prevents Federal personnel from working at the Government facility, contractor personnel assigned to work at that facility in support of such Federal employees shall follow their parent company’s policies.
While generally contractor personnel may not perform work on-site at a government facility without oversight from Federal personnel, in very limited circumstances, work being performed by contractor personnel may be deemed mission essential and performance of such mission essential work may be authorized to continue at the Government facility despite the facility being otherwise closed for normal operations. The circumstances permitting work being performed by contractor personnel to be deemed mission essential are extremely limited and generally only apply to performance of efforts related to public health, safety, or matters related to national security.
