3. Evaluation Factors and Basis for Award Determination:
Evaluation of the proposals will be based on a Lowest Priced Technically Acceptable basis, in accordance with Simplified Acquisition Procedures outlined in FAR 13.106 and utilizing FAR 52.212-2 “Evaluation-Commercial Items.”
FAR 52.212-2 Evaluation – Commercial Items:
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation has been found to be technically acceptable and is the lowest price of the technically acceptable offers. The following factors shall be used to evaluate offers:
• Technical Acceptability: Responses will be rated either “Technically Acceptable” or “Technically Unacceptable”. In order to be determined “Technically Acceptable,” responses must demonstrate adherence to the specifications in this RFP, the PWS, and its attachments, as well as a clear understanding of the requirement as per the required technical submission delineated below in #4.
• Price: Pricing must adhere to the CLIN descriptions and must be determined fair and reasonable.
If all submissions received meet the technical specifications, pricing information – once determined to be fair and reasonable- will be used to select the awardee.
1. In accordance with FAR 15.403-5(a)(1), certified cost or pricing data is not required for initial proposal submission.
2. For its initial proposal submission, the offeror shall provide the data outlined below to permit a determination that the proposed price is fair and reasonable.
3. The offeror shall provide its completed Attachment 0002 – Government Format Pricing Model (GFPM) with its proposal. Complete the attachment in accordance with the instructions included within the attachment. Do not enter any proposed prices into the table in Section 2 of the RFP. Submit Attachment 0002 in Microsoft Excel format.
4. The Government reserves the right to request additional or more detailed price breakdown data to support its determination of price reasonableness as part of exchanges pursuant to FAR 15.306.
• Total Evaluated Price equals the sum of:
1. The total proposed price for all CLINs, as calculated in Attachment 0002– GFPM.
2. If applicable, any other price adjustments, for evaluation purposes only, that are required in accordance with the (i)FAR; (ii) DFARS; or (iii) RFP (to include RFP Attachments).
3. Price Reasonableness: A price is reasonable if, in its nature and amount, it does not exceed that which would be incurred by a prudent person in the conduct of competitive business. The Government may make a determination of price reasonableness by any means allowable under FAR 15.404-1.
4. Unbalanced Pricing: Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly over- or understated as indicated by the application of cost and price analysis techniques.
Offerors are cautioned that a proposal the Government assesses to be unbalanced as to price, may either be rejected or determined unacceptable for award. See FAR 15.404- 1(g) for more information on unbalanced pricing.
(c) The agency intends to award solicitation as a Women-Owned Small Business (WOSB) set-aside under FAR 19.15 and will be a Firm Fixed-Price contract. Only WOSB firms certified under the SBA WOSB Program are eligible to submit offers and must provide proof of certification at the time of proposal submission.
(d) After receipt of proposal, the Government will first determine if the proposal provided is technically acceptable, per the criteria outlined in this solicitation. If the proposal is found to be technically acceptable, then the pricing of that proposal will need to be determined to be fair and reasonable, and otherwise properly awardable.
The award will be made to the contractor that can achieve technical acceptability to deliver the services as outlined in the PWS, as well as a proposal that can be found fair and reasonably priced. Only proposals from Women-Owned Small Business (WOSB) concerns certified under the SBA WOSB Program will be considered. If two or more proposals are found to be technically acceptable, and do not provide an advantage of technical capability over the other proposals, then the lower priced proposal will receive the award.
(e) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
4. Technical Submission
Offerors shall demonstrate their methods for obtaining proposed staff that have the education, training, knowledge, and experience to successfully carry out the ACIC External Assessment Services requirement. Technical submission shall consist of the following:
(a) List of all open-source intelligence (OSINT) and/or PAI/CAI tools or capabilities used for conducting investigations/research.
(b) Licenses and/or subscription documents or information (i.e. tools / databases).
(c) List of past projects/clients conducting the same or similar work (assessments / investigative research / identity management).
(d) List of any / all relevant training for assigned contract personnel (i.e. OSINT, private investigation, internet investigations training, cyber-security, Ubiquitous Technical Surveillance (UTS), PAI/CAI tools/capabilities, online analysis, etc.)
(e) Requisite qualifications, experience, effective communications skills
(f) Staff flexibility and commitment to perform work assignments on short notice based on changing task priorities
(g) Provide an effective quality control and cost monitoring plan that adheres to requirements specified in the Quality Assurance Surveillance Plan, para 1.6.1 of PWS
5. An offer may be rejected if:
The offeror does not enter pricing for all required services in the GFPM.
6. DD254 - Applicable DD254 Not Applicable - Contractors must complete and submit with proposal Blocks 6, 7, and 8 of the DD Form 254.
7. The Government intends to evaluate proposals and award a contract without exchanges with contractors. However, the Government reserves the right to conduct exchanges or seek clarifications if the KO determines they are necessary. Additionally, the KO reserves the right to make no award under this solicitation.
8. Attachment 0003 contains provisions that apply to this solicitation and clauses that will be applicable to the resulting award. Some of the provisions require a response from the contractor and must be submitted along with your proposal.
9. The proposal received in response to this RFP shall remain valid for 180 calendar days from the due date below. Further, should you be awarded this contract, the contractor will furnish the items and/or services identified in its proposal at the price quoted to the designated point(s) within the time specified in the contract.
10. The KO reserves the right to withdraw and cancel this Solicitation at any time. In such event, the contractor shall be notified in writing of the KO's decision. This decision is final and conclusive and shall not be subject to the "Disputes" clause or the "Contract Disputes Act".
Sincerely, Regina M. Cronin
