ATTENTION OFFERORS: This notice has been prepared to point out some of the important sections or requirements of this solicitation or to pro-vide you with additional information related to this proposed contract.

Please note that it is not inclusive - you are cautioned to carefully read the entire solicitation in order to be fully aware of all requirements, provisions, and clauses.

GENERAL SERVICES ADMINISTRATION’S MISSION

To provide quality services required by our clients in a timely manner and to ensure the best value to the Federal Government and the public thereby enhancing our clients’ ability to accomplish their mission.

“SHALL” “WILL” and “MUST” Throughout this solicitation, the terms “shall” “will” and “must” are used. “Shall” “will” and “must” denote the imperative. They indicate an obligation to act. In this solicitation, and any resulting contract, “shall” “will” and “must” have the same meaning.

SOLICITATION ISSUED ELECTRONICALLY

This solicitation is being issued electronically as of the solicitation “Date Issued” in block 6 of the Standard Form 33. The offeror shall not alter the solicitation or any component thereof (i.e. drawings, etc.). The Government’s version of the solicitation and accompanying components take precedence if a discrepancy arises between the version issued by the Government and the signed documents submitted by the offe-ror.

SYSTEM FOR AWARD MANAGEMENT (SAM)

All contractors must be active in the System for Award Management (SAM), https://beta.sam.gov/ prior to submission of offers to be considered for award.

AFFIRMATIVE PROCUREMENT PROGRAM (APP)

GSA has implemented an Affirmative Procurement Program intended to maximize the use of recovered materials, environmentally preferable, and bio-based products. Offerors should familiarize themselves with the requirements for using and reporting on the use of such materials in performance under any re-sultant contract.

FAR 23.7 requires consideration of environmental factors when purchasing products and services. FAR

4.303 and FAR 52.204-4 require double sided printing on recycled paper for all reports required by this contract. FAR 52.223-10 encourages vendors to practice waste reduction.

SAFEGUARDING DOCUMENTS

Associated plans, drawings, or specifications provided under this solicitation are intended for use by pro-spective bidders/offerors (and their subcontractors and suppliers). In support of this requirement, GSA requires bidders/offerors to exercise reasonable care when handling documents relating to building draw-ings/plans, security equipment, security equipment installations, and contract guard service, to include:

1) Limiting reproduction and/or dissemination of covered materials only to persons/parties related to this acquisition or otherwise authorized to receive such information;

2) Making every possible effort that is reasonable and prudent to prevent unauthorized disclosure of this information;

3) Upon award and completion of any appeals process, unsuccessful bidders/offerors making every rea-sonable and prudent effort to destroy or render useless all information/documentation received during the solicitation and/or appeals process; and

4) The awardee continuing the efforts required above throughout the entire term of contract and for what specific time thereafter as may be necessary, as determined by the awardee.

PERFORMANCE BASED SPECIFICATIONS

Note that the service specifications included in this solicitation are performance-based specifications.

These specifications express the Government’s requirements in the form of minimum quality standards.

Work schedule, frequencies, resources utilized, and methods of performance are to be determined by offerors.

A-76 REQUIREMENT

CURRENT CONTRACTOR AND CURRENT CONTRACT PRICE

The current contractor for all locations is Midwest Landscaping, Inc. located in Monroe, MI. The current monthly price for Location 1, Anthony J. Celebrezze Federal Building, Cleveland, OH is $1,670.00 and the current monthly price for Location 2, Carl B. Stokes United States Courthouse, Cleveland, OH and Location 3, Donald J. Pease Federal Building, Medina, OH is $2,760.67. Although this solicitation is for services basically the same as the current contract Scope of Work for this location only, it should be re-viewed carefully before submitting a bid.

SITE VISIT

Offerors are urged and expected to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of contract performance, to the extent that the information is reasonably obtainable. In no event shall failure to inspect the site consti-tute grounds for a claim after contract award.

CONTRACTOR DATA UNIVERSAL NUMBERING SYSTEM (DUNS) NUMBER.

Enter your DUNS number in Block 15A on the first page of this solicitation. If you do not know or do not have a DUNS number please contact Dun and Bradstreet directly to obtain one. A DUNS number will be provided immediately by telephone at no charge to you. For information on obtaining a DUNS number, you should call Dun and Bradstreet at 1-866-705-5711. Be prepared to provide the following information:

(1) Company name, (2) Company address, (3) Company telephone number, (4) Line of business, (5) Chief executive officer/key manager, (6) Date the company was started, (7) Number of people employed by the company, (8) Company affiliation.

FAIR LABOR STANDARDS/SERVICE CONTRACT ACT PRICE ADJUSTMENT PROVISIONS

If this is a multiyear service contract or a service contract that may exceed a year in length if options are exercised, offerors should note the price adjustment provisions in Section I of this solicitation.

FREEDOM OF INFORMATION ACT (FOIA) REQUESTS

It is not necessary to reference the FOIA when requesting procurement history, such as the name of the current contractor, contract amount, contract copies, or abstracts of bids. For this information, you may contact the point of contact shown in Block 10 on the first page of the solicitation.

PRICING OF OPTIONS

Offerors shall price the initial one year base period and the option requirements for the four one year op-tion periods by assuming that the minimum hourly wages and fringe benefits established by the Adminis-trator, Wage and Hour Division, U.S. Department of Labor for the initial 1 year period of performance will apply to the initial one year period and to the four one year option periods. The minimum wage rates and fringe benefits applicable to the initial 1 year period of performance are outlined on the wage rate sheet.

PROMPT PAYMENT DISCOUNT

Block 13 on the Standard Form 33 and possibly the solicitation pricing page(s), is to be used to offer prompt payment discounts. Payment terms are set forth in the Prompt Payment clause in this solicitation.

Offerors are cautioned against inserting any statement that indicates that payment is due sooner that the time stipulated in the Prompt Payment clause. EXAMPLE: Inserting "Net 20" may cause the offer to be rejected as unacceptable, because the entry would be contrary to the 30-day payment terms specified in the Prompt Payment clause.

OPTION TO EXTEND SERVICES

Offerors should note that Section I of this solicitation includes FAR 52.217-8, Option to Extend Services, which allows the Government the unilateral option to extend the term of any resultant contract up to six months, exclusive of any other option provisions which may be included as part of any resultant contract.

QUALITY CONTROL PLAN (QCP)

The contracting Officer (CO) must accept a completed Quality Control Plan (QCP) prior to award of a con-tract. The QCP will be specific to the contract specification and location(s) in accordance with the provi-sions and requirements of the solicitation.

NOTICE TO PROCEED (NTP)

Notice to Proceed (NTP) will NOT be issued until the COR has officially notified the CO that approved clearances for proposed employees have been received and approved.

AVAILABILITY OF FUNDS

Funds are not presently available for award. The Government's obligation under this contract is contin-gent upon the availability of appropriated funds. No legal liability on the part of the Government may arise until funds are made available to the Contracting Officer.

PROJECT LABOR AGREEMENT

Offerors may submit a price proposal subject to the PLA requirements set forth in this solicitation (a PLA proposal), a price proposal not subject to the PLA requirements set forth in this solicitation, or both.

Any price proposal submitted shall clearly identify whether it is subject to such PLA requirements.

PRE-BID/PRE-PROPOSAL CONFERENCE

A pre-bid/pre-proposal meeting has not been scheduled at this time. Once determined, information will be made available via amendment.

PRE- AND POST-AWARD DEBRIEFINGS

The General Services Administration’s hours of operation are 8 a.m. to 4:30 p.m. Requests for pre-award debriefings postmarked or otherwise submitted after 4:30 p.m. will be considered submitted the following business day. Requests for post-award debriefings delivered after 4:30 p.m. will be considered received and filed the following business day.

SECTION B - SERVICES, ORDERING AND PRICES

B.1. Description of Services (Landscaping and Related Services) The Contractor shall provide all management, administrative, supervision, labor, materials, supplies, tools, equipment (except as otherwise provided) and subcontracts necessary, and shall plan, schedule, coordinate, and assure effective completion of all work and services and performance of Landscape and related services described herein. The contract starts April 1, 2021; the standard services will be paid over a 12 month period. Performance of standard services will take place during the months of April though November each year. The Government shall have the unilateral option of extending the term of this contract for up to four (4) consecutive additional periods of 1 year each.

All the contractor’s labor hour prices must include expenses for overhead, General and Administrative (G&A) and profit. Thus no separate allowance for travel time, parking, overhead, G&A or profit will be applied when hourly services are ordered.

Offeror must submit offers for all locations in order to be considered for award. Offerors must submit prices for all four of the option periods, in addition to the initial period, to be considered for award. Options shall be priced using the wage determination contained in this solicitation. Upon exercising a renewal option, the contract price will be adjusted in accordance with FAR 52.222-43 Fair Labor Standards Act and Service Contract Labor Standards—Price Adjustment (Multiple Year and Option Contracts) (May 2014).

Offerors should visit the building and become familiar with existing conditions; examine all contract documents relating to this work, and carefully review the requirements contained in this specification.

Offerors shall determine any conditions which affect the work and make a thorough site investigation before submitting an offer. No allowances will be made for failure of an offeror to avail themselves of such information.

Note 1. These quantities are for evaluation purposes only and are based on an estimate of the Government’s anticipated need for such service.

Note 2. Offerors are cautioned not to confuse overtime services with additional services. Additional services are defined as any work requested by the Government that is within the scope of this contract but in addition to the contract requirements. Overtime services are defined as work within the scope of the contract originally intended to be performed during normal working hours, where the Government requests the work be performed outside of normal working hours to expedite the return of a piece of equipment to operating condition or to minimize disruption to tenants.

Note 3. Quote a price per hour for providing Above Standard Services when ordered that are in addition to the services specified herein for the standard services. Orders for above standard service may be placed orally when the amount of the order totals $2,500.00 or less or in the event of an emergency. All orders which exceed $2,500.00 must be placed or confirmed by issuance of a GSA Form 300, Order for Supplies or Services and will be paid by GSA Finance. The GSA Form 300 will describe the service to be provided and will establish, excluding emergencies as determined by the Contracting Officer (CO) or the Contracting Officer’s Representative (COR), the maximum number of hours for which the contractor will be compensated. Orders of $2,500.00 or less may be processed using the Government wide commercial purchase card, which is the preferred method to purchase and to pay for micro purchases. Individual orders for above standard services involving more than forty (40) hours will only be issued with the assent of the contractor. This above standard services provision is intended to be used to satisfy the Government's short term non-recurring needs for service. Should a continuing need for additional service arise, a contract modification will be negotiated pursuant to the "Changes Fixed Price" clause. Above standard services cannot be accomplished by diverting resources from work that is supposed to be accomplished.

SECTION C - DESCRIPTION/SPECIFICATION/STATEMENT OF WORK

Introduction This is a Performance Based Contract which focuses on outcomes as opposed to prescriptive requirements. This specification represents GSA's performance objectives and minimum levels of service to be provided by the contractor. A high level of effective communication between the Government and contractor is essential. This performance based requirement demands a greater emphasis by the contractor on self-evaluation, robust quality control processes and strict oversight of building operations to ensure the highest level of efficiency. The Contractor will be required to maintain a quality control program to ensure that the requirements of this contract are met. The contractor must closely monitor all aspects of the work, identify deficiencies and implement corrective action, without reliance on Government oversight.

C.1. SCOPE OF WORK

C.1.1

The contractor shall provide the management, supervision, manpower, equipment and supplies necessary to provide landscaping services as described herein. The Contractor shall be responsible for performing all work under this contract in accordance with all Federal, State, County, City laws and codes, and follow the more stringent of them. In addition to compliance with these laws, the Contractor shall follow all applicable standard industry practices including, but not limited to: Occupational Safety and Health Act (OSHA). If you are an Ability One Program (formerly the Javits-Wagner-O’Day Program) contractor, please include any Ability One requirements in your offer.

C.1.2 CONTRACT EFFORT REQUIRED

All work shall be performed between sunrise and sunset, Monday through Friday, Federal holidays excluded, unless specifically approved or requested by the COR.

C.1.3 BASIC LANDSCAPING SERVICES

(a) Landscaping maintenance will be performed during the growing season on a cycle approved by the COR to maintain the outside area in a neat and clean manner. Policing landscape areas remove trash and other cleaning issues will be done by the Janitorial staff during the off season and between scheduled landscaping visits as directed by the Property Manager.

(b) Basic Landscaping Maintenance includes mowing lawns, aerating lawns, power raking, edging, mulching, pruning, watering, weed, pest and disease control and plants and ivy maintenance. In compliance with EPA and USDA requirements, compost and fertilizers made from recovered organic materials and bio-based herbicides and pesticides will be used unless an alternative product is approved by the COR. The Contractor shall be held liable for any damage to grounds, vegetation, or landscaping due to his negligence and shall promptly report any theft or missing plants to the COR. The COR will determine if the plants are covered under the one year/season guarantee or if the government will order the replacement under additional services. The contractor is responsible for watering landscaped areas as needed (see Section H.14.) for availability of water connections and irrigation systems). If weed, pest or disease control is needed the COR will approve in advance their application.

(c) Lawns will be well maintained and free of weeds and trash. Soil shall be aerated by mechanical methods of piercing the ground to provide an adequate air supply to the soil and promote sustained plant life at least once per year. Cores will remain on the lawn to decompose and provide additional organic matter to the soil. Contractor will over-seed, dethatch and plug as necessary to prevent bare areas and promote even growth of turf areas. Lawns will be maintained at a height of 3-3.5 inches.

(d) Groundcovers shall receive rejuvenation pruning as needed and be maintained within their established bed lines to maintain a weed free, neat consistent appearance.

(e) Walkways, landings, and steps will be free of trash and weeds. Shrubbery, trees and other landscaping will be pruned to maintain a well-groomed appearance and be free of deadwood, suckers, litter and weeds. Fence areas, turf areas, sidewalks, gutters, roadways, cooling tower yard and other surfaces included in the maintenance area shall be free of leaves, litter and other debris. Plant material around fences, monuments, flagpoles, walls, walkways, parking lots and other property appurtenances will be trimmed to maintain a well-groomed appearance.

(f) The landscaping plan currently in place for the building must be reviewed and addressed by the contractor in the offer. Any alterations to the plan must be approved by the Property Manager/COR.

Any planting included in the landscape plan will be guaranteed for one year/season and failing or missing plants will be replaced at no cost to the government. A photographic record (in digital format) shall be provided to the COR of each season’s plantings. Images should be taken prior to and after planting activities.

NOTE: The Contractor shall remove all debris generated in the performance of this contract each day service is performed. Upon completion of the repair or installation work, the Contractor shall remove and dispose of all unused materials, containers, wrappings, cuttings, trimmings and any other debris accumulated as a result of this contract. Organic materials shall be composted and other materials shall be recycled to the extent possible.

C.1.4 ADDITIONAL SERVICES

(a) Contractor shall perform a site visit/consultation with the COR at the beginning of the growing season; April; and submit a report identifying any additional services required to bring the landscape back to the original condition (excluding damage or failure of plants caused by negligence of the contractor). A plan and pricing for replacement plants and other services not included in the basic landscaping services will be submitted to the COR 30 days prior to scheduled planting. Any plants installed will be guaranteed for 1 year. Guarantee will include plants, installation and any soil amendments necessary to return the site to the original condition.

(b) Orders for additional service may be placed orally when the amount of the order totals $2,500.00 or less or in the event of an emergency. All orders which exceed $2,500.00 must be placed or confirmed by issuance of a GSA Form 300, Order for Supplies or Services and will be paid by GSA Finance. Orders of $2,500.00 or less may be processed using either direct pay procedures or the Government wide commercial purchase card, which is the preferred method to purchase and to pay for micro purchases. Individual orders for additional services involving more than forty (40) hours will only be issued with the assent of the contractor.

(c) This additional services provision is intended to be used to satisfy the Government's short term non-recurring needs for service. Should a continuing need for additional service arise, a contract modification will be negotiated pursuant to the "Changes Fixed Price" clause.

(d) Additional services cannot be accomplished by diverting resources from work that is supposed to be accomplished.

(e) Plants and supplies provided under additional services will meet the standards identified in Section C.1.5. The Contractor will submit a fixed price quotation for the plants, supplies and installation as requested by the COR. Plants will be guaranteed for one year including replacement and installation.

C.1.5 LANDSCAPING MATERIALS STANDARDS

PLANT AND SOIL AMENDMENT REQUIREMENTS

The section below identifies the standards for landscaping materials supplied under this contract. Plant materials of native species and cultivars are preferred. Mature plant size shall be appropriate to the location with minimal maintenance.

(a) SHRUB MATERIAL General: Furnish nursery-grown shrubs complying with ANSI Z60.1, with healthy root systems.

Provide well-shaped, fully branched, healthy, vigorous stock free of disease, insects, eggs, larvae, and defects such as knots, sunscald, injuries, abrasions, and disfigurement.

(1) Grade: Provide shrubs of sizes and grades complying with ANSI Z60.1 for type of shrubs required. Shrubs of a larger size may be used if acceptable to the COR, with a proportionate increase in size of roots or balls.

(2) Label at least one shrub of each variety and caliper with a securely attached, waterproof tag bearing legible designation of botanical and common name.

(3) If formal arrangements or consecutive order of shrubs is shown, select stock for uniform height, spread, and number label to assure symmetry in planting.

(i) Deciduous Shrubs:

Form and Size: Deciduous shrubs with not less than the minimum number of canes required by and measured according to ANSI Z60.1 for type, shape, and height of shrub.

(ii) Evergreens:

Form and Size: Normal-quality, well-balanced, broadleaf evergreens, of type, height, spread, and shape required, complying with ANSI Z60.1.

(b) ANNUAL PLANTS (1)Annuals: Provide healthy, disease-free plants of species and variety shown or listed. Provide only plants that are acclimated to outdoor conditions before delivery and that are in bud but not yet in bloom.

(2) Bulbs: Provide healthy, disease-free bulbs of species and variety shown or listed.

(3) Annual Vines: Provide vines of species indicated complying with requirements in ANSI Z60.1.

(c) PERENNIALS Provide healthy, field-grown plants from a commercial nursery, of species and variety shown or listed.

Provide field-grown vines. Vines grown in 6” pots or other containers of adequate size and acclimated to outside conditions will also be acceptable.

Topsoil Source: Import topsoil or manufactured topsoil from off-site sources. Obtain topsoil displaced from naturally well-drained construction or mining sites where topsoil occurs at least 4 inches (100 mm) deep; do not obtain from agricultural land, bogs or marshes.

Topsoil Source: Amend existing in-place surface soil with compost made from the composting onsite of branches, leaves and grass in the joraform compost tumblers located in back area on site. Verify suitability of surface soil to produce topsoil. Clean surface soil of roots, plants, sod, stones, clay lumps, and other extraneous materials harmful to plant growth.

Surface soil may be supplemented with imported or manufactured topsoil from off-site sources.

Obtain topsoil displaced from naturally well-drained construction or mining sites where topsoil occurs at least 4 inches (100 mm) deep; do not obtain from agricultural land, bogs or marshes.

(e) ORGANIC AMENDMENTS Use of compost shall be the preferred amendment for improving topsoil. Other amendments may be considered if a soil test shows that they would be the best method of balancing the soil composition.

Compost shall be a well decomposed, stable, weed free organic matter source. It shall be derived from: food waste, yard trimmings, manure, bio-solids and other recovered organic materials that are placed in the joraform compost tumbler on site. The tumblers shall be returned when onsite to expedite breakdown. The product shall contain no substances toxic to plants and shall be reasonably free (1% by dry weight) of man-made foreign matter. The compost will possess no objectionable odors and shall not resemble the raw material from which it was derived.

(f) INORGANIC SOIL AMENDMENTS

(1) Lime ASTM C 602, agricultural limestone containing a minimum 80 percent calcium carbonate equivalent and as follows:

(2) Class: Class T, with a minimum 99 percent passing through No. 8 (2.36-mm) sieve and a minimum 75 percent passing through No. 60 (0.25-mm) sieve.

(3) Class: Class O, with a minimum 95 percent passing through No. 8 (2.36-mm) sieve and a minimum 55 percent passing through No. 60 (0.25-mm) sieve.

(4) Provide lime in form of dolomitic limestone.

(5) Sulfur: Granular, biodegradable, containing a minimum of 90 percent sulfur, with a minimum 99 percent passing through No. 6 (3.35-mm) sieve and a maximum 10 percent passing through No. 40 (0.425-mm) sieve.

(6) Iron Sulfate: Granulated ferrous sulfate containing a minimum of 20 percent iron and 10 percent sulfur.

(7) Aluminum Sulfate: Commercial grade, unadulterated.

(8) Perlite: Horticultural perlite, soil amendment grade.

(9) Agricultural Gypsum: Finely ground, containing a minimum of 90 percent calcium sulfate.

(10) Sand: Clean, washed, natural or manufactured, free of toxic materials.

(11) Diatomaceous Earth: Calcined, diatomaceous earth, 90 percent silica, with approximately 140 percent water absorption capacity by weight.

(12) Zeolites: Mineral clinoptilolite with at least 60 percent water absorption by weight.

(g) FERTILIZER Fertilizer is an EPA/CPG and USDA bio-based designated product. If the use of fertilizer is required, a product containing recovered organic materials should be considered first. Fertilizers shall be made from recovered organic materials such as alfalfa meal, blood meal, cottonseed meal, feather meal, fish meal, meat and bone meal, poultry manure/litter, soybean meal and wood ash. It shall contain the highest percentage of recovered materials practicable, while maintaining a satisfactory cost/level of competition. If that product will not meet the performance needs then the use of a biobased product should be specified. The CO or COR must approve the fertilizer.

(h) MULCHES Bio-based or Hydraulic mulch must be free from deleterious materials and suitable as a top dressing for trees and shrubs, consisting of shredded hardwood and/or paper. Compost may also be used as mulch if appropriate. The CO or COR must approve the scheduling of mulch application.

(i) WEED CONTROL BARRIERS Weed control barriers must contain the highest percent of recycled content practicable and meet the requirements for effective weed control.

(j) MISCELLANEOUS PRODUCTS

(1) Antidesiccant: Water-insoluble emulsion, permeable moisture retarder, film forming, for trees and shrubs. Deliver in original, sealed, and fully labeled containers and mix according to manufacturer's written instructions.

(2) Bio-based Insecticide: Deliver in original, sealed, and fully labeled containers and mix according to manufacturer's written instructions.

(3) Bio-based Fungicide: Deliver in original, sealed, and fully labeled containers and mix according to manufacturer's written instructions.

(4) Bio-based Herbicide: Deliver in original, sealed, and fully labeled containers and mix according to manufacturer's written instructions.

(k) POTTING SOIL MIX Soilless mix of organic materials such as compost, perlite, vermiculite, and organic/bio-based fertilizer, for use in containers.

SOD: Shall comply with ASPA specifications for machine-cut thickness, size, strength, moisture content, mowed height, and free of weeds and undesirable native grasses. Provide viable sod of uniform density, color, texture, strongly rooted, and capable of vigorous growth and development when planted.

C.1.6 EMPLOYEE ORIENTATION

(a) All contract employees are required to attend an orientation conducted by the Contractor during the first month of the contract. Employees hired after the contract start date must attend an orientation within 30 days of employment. The orientation will include an explanation of the contract requirements, the occupant agency's function, and procedures to follow in the event of fire or other emergency.

(b) The contractor is required to provide necessary and on-going tenant relations training for their employees. This training will stress the importance of conflict avoidance and problem resolution.

Emphasis shall be placed on grooming, proper attire, and the importance of professionalism and courtesy in day-to-day contacts with building occupants and visitors.

C.1.7 OTHER SERVICES

Except for the following services, the contractor will perform all work required by this contract with his/her own personnel: The Government reserves the right to disapprove the subcontractor selected at no increase in cost, and the right to acquire services for subcontracts from sources other than the contractor when it is in the best interest of the Government.

C.1.8 PROTECTION AND DAMAGE

Contractor Responsibility: The Contractor shall provide all labor, materials, and equipment necessary for the protection of Government personnel, equipment, furnishings, buildings, and building accessories (such as parking lots, fences, sidewalks, grounds, etc.) from damage caused by Contractor's negligence. Equipment, furnishings, building and building accessories damaged due to work performed by the Contractor or their subcontractor shall be repaired or replaced to their original condition by the Contractor at no additional cost to the Government. The Contractor will not use any material which the COR determines would be unsuitable for the purpose or harmful to the surfaces to which applied.

Costs for correcting damage caused by the Contractor will be borne by the Contractor.

C.1.9 LANDSCAPING QUALITY ASSURANCE PLAN

(a) General The procedures and methods established in this Quality Assurance Plan will serve as a guide for all parties involved ensuring that tenants and the GSA receive the services paid for and specified in this contract.

(b) Partnering In order to have an effective contract administration program that also ensures a successful business relationship between GSA and the contractor, all parties involved in the service delivery process must work as a team and foster open and honest communication at all times. Close coordination and active cooperation on a continuous basis between the contractor and those representing the Contracting Officer are necessary to ensure a safe and healthy working environment, and a well maintained and operated building.

(c) GSA/Contractor Meetings An initial step in avoiding disputes and claims is to settle minor problems and misunderstandings at the lowest possible level. Accordingly, the contractor or the contractor's representative shall meet with the COR or his representative frequently, as often as necessary, at the discretion of the COR, but not less than once per month during the growing season. A mutual effort shall be made to resolve all problems identified during these meetings.

Specific topics to be addressed by the COR or his representative during the regular monthly meeting to determine contractor responsiveness may include such areas as: effectiveness of Quality Control Plan;

performance evaluation; corrective action plans; and proposal submittals for extra services.

(d) Performance Evaluation Both the contractor and the Government, at the time of contract award, have agreed upon all terms and conditions as stated in the contract. During the life of the contract, contractor performance will be documented by means of the Contractor Performance Assessment Reporting System (CPARS), written inspections and minutes of meetings, which will be retained as part of the official contract file.

(e) Effectiveness of Quality Control The COR shall assess the effectiveness of the contractor's Quality Control Program through review of reports required of the contractor, service delivery information, customer interaction, and by means of GSA inspections.

(f) Service Delivery The quality and timeliness of the contractor's performance of the scheduled program and service call responses will be used to assess the overall service delivery. The contractor's service call program must document requests for service and responses. The contractor will make the service call records available for inspection by the COR at all times. If the contractor's performance remains less than satisfactory or fails to adhere to the contract specifications, the Government may contract for the services and charge the contractor for all costs incurred, including administrative costs.

Performance Objectives/Inspection Methods and Frequencies:

GSA representatives will make tours and inspections of the grounds covered by this contract with the contractor’s representative, to ascertain the level of services being performed. The contractor will be informed of less than satisfactory performance. The inspections will be carried out as described on the Inspection Form. See SECTION J, EXHIBIT 3.

C.1.10 MISCELLANEOUS REQUIREMENTS

(a) Turn in lost and found articles to the COR.

(b) Notify the Property Manager's Office when an unauthorized or suspicious person is seen or is encountered.

(c) During performance of this contract, the contractor is required to report to the COR any recommended maintenance and/or repair items that are necessary to maintain the physical integrity of the exterior of the facility and to insure that it is free of missing components or defects which (1) may negatively affect the safety or intended use of the facility; (2) hinder any electrical, mechanical, plumbing or structural system from functioning in accordance with its design; or (3) otherwise degrade the aesthetic appearance of the building. The contractor must certify to the COR in writing, five days after award, that all of its employees involved in the performance of this contract, have been made aware of this provision and understand how to report such discoveries.

C.1.11 SUBCONTRACTING

The Government reserves the right to approve or disapprove any subcontract and any subcontractor selected.

C.1.12 SAFETY AND HEALTH

(f) Compliance with Regulations All work, including contact with and handling of hazardous materials and/or the disposal of hazardous materials shall comply with the applicable requirements of 29 CFR 1926/1910 and 40 CFR 761. All work shall comply with applicable federal, state and municipal safety and health requirements. Where there is a conflict between applicable regulations, the most stringent shall apply.

(g) Contractor Responsibility The Contractor shall assume full responsibility and liability for compliance with all applicable regulations pertaining to the health and safety of personnel during the execution of work, and shall hold the Government harmless for any action on his/her part or that of his/her employees or subcontractors, which results in illness, injury or death.

(h) Submittals

(1) Accident Reporting:

A copy of each accident report relating to this contract, which the Contractor submits to their insurance carriers, shall be forwarded to the COR as soon as possible, but in no event later than seven (7) calendar days after the day the accident occurred. The COR shall submit a copy of the accident report to the Environmental, Safety, & Fire Protection Branch.

(2) Permits:

If hazardous materials are disposed of offsite, submit copies of permits from applicable, federal, state, or municipal authorities and necessary certificates that the material has been disposed of as per regulations.
