Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary.

The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. EVALUATION-COMMERCIAL ITEMS (OCT 2014)

(a)The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

EVALUATION

The Proposed requirement will be awarded to the responsible Offeror providing the best value to the Government. To decide Best Value, the Lowest Price Technically Acceptable process has been selected for this acquisition. The Government considers it to be in its best interest to award to the lowest price offeror with a technically acceptable proposal.

Technical factors are in descending order of importance and when combined are more important than price.

The Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a). The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary.

A proposal must receive a rating of “ACCEPTABLE” in each non-price factor in order to be eligible for award. An “UNACCEPTABLE” rating in any factor results in the overall non-price factors proposal being rated “UNACCEPTABLE”. An overall non-price factors rating of “UNACCEPTABLE” makes a proposal ineligible for award.

Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”

PRICE (Volume 2)

The Government anticipates that offerors will submit pricing quotations as Firm Fixed Price.
