“SHALL” “WILL” and “MUST” Throughout this solicitation, the terms “shall” “will” and “must “are used. “Shall” “will” and “must” denote the imperative. They indicate an obligation to act. In this solicitation, and any resulting contract, “shall” “will” and “must” have the same meaning.
SOLICITATION ISSUED ELECTRONICALLY
This solicitation is being issued electronically as of the solicitation “Date Issued” in block 5 of the Standard Form 33 - SOLICITATION, OFFER, AND AWARD. The offeror shall not alter the solicitation or any com-ponent thereof (i.e. drawings, etc.). The Government’s version of the solicitation and accompanying com-ponents take precedence if a discrepancy arises between the version issued by the Government and the signed documents submitted by the offeror.
INFORMATION COLLECTION REQUIREMENTS
The information collection requirements contained in this solicitation/contract are either required by regu-lation or approved by the Office of Management and Budget pursuant to the Paperwork Reduction Act and assigned OMB Control No. 3090-0163.
SYSTEM FOR AWARD MANAGEMENT (SAM)
All contractors must be active in the System for Award Management (SAM), https://sam.gov/ prior to submission of offers to be considered for award.
AFFIRMATIVE PROCUREMENT PROGRAM (APP)
GSA has implemented an Affirmative Procurement Program intended to maximize the use of recovered materials, environmentally preferable, and bio-based products. Offerors should familiarize themselves with the requirements for using and reporting on the use of such materials in performance under any re-sultant contract.
FAR 23.7 requires consideration of environmental factors when purchasing products and services. FAR
4.303 and FAR 52.204-4 require double sided printing on recycled paper for all reports required by this contract. FAR 52.223-10 encourages vendors to practice waste reduction.
SAFEGUARDING DOCUMENTS
Associated plans, drawings, or specifications provided under this solicitation are intended for use by pro-spective bidders/offerors (and their subcontractors and suppliers). In support of this requirement, GSA requires bidders/offerors to exercise reasonable care when handling documents relating to building draw-ings/plans, security equipment, security equipment installations, and contract guard service, to include:
1) Limiting reproduction and/or dissemination of covered materials only to persons/parties related to this acquisition or otherwise authorized to receive such information;
2) Making every possible effort that is reasonable and prudent to prevent unauthorized disclosure of this information;
3) Upon award and completion of any appeals process, unsuccessful bidders/offerors making every rea-sonable and prudent effort to destroy or render useless all information/documentation received during the solicitation and/or appeals process; and
4) The awardee continuing the efforts required above throughout the entire term of contract and for what specific time thereafter as may be necessary, as determined by the awardee.
PERFORMANCE BASED SPECIFICATIONS
Note that the service specifications included in this solicitation are performance-based specifications.
These specifications express the Government’s requirements in the form of minimum quality standards.
Work schedule, frequencies, resources utilized, and methods of performance are to be determined by offerors.
GSAR 552.219-72 PREPARATION, SUBMISSION, AND NEGOTIATION OF SUBCONTRACTING
PLANS (OCTOBER 2016)
(a) When submitting a subcontracting plan in accordance with FAR 52.219-9, the offeror shall submit a subcontracting plan with its initial offer. The subcontracting plan will be negotiated concurrently with price and any required technical and management proposals, unless the offeror submits a previously-approved commercial plan.
(b) Maximum practicable utilization of small, HUBZone small, small disadvantaged, women-owned, veteran-owned, and service-disabled veteran owned small business concerns as subcontractors is a mat-ter of national interest with both social and economic benefits. The General Services Administration (GSA) expects that an offeror’s subcontracting plan will reflect a commitment to assuring that small, HUBZone small, small disadvantaged, women-owned, veteran-owned, and service-disabled veteran owned small business concerns are provided the maximum practicable opportunity, consistent with effi-cient contract performance, to participate as subcontractors in the performance of the resulting contract.
An offeror submitting a commercial plan can reflect this commitment through subcontracting opportunities it provides that relate to the offeror’s production generally; i.e., for both its commercial and Government business.
(c) GSA believes that this potential contract provides significant opportunities for the use of small, HUBZone small, small disadvantaged, women-owned, veteran-owned, and service-disabled veteran owned small business concerns as subcontractors. Consequently, in addressing the eleven elements de-scribed at FAR 52.219-9(d) of the clause in this contract entitled Small Business Subcontracting Plan, the offeror shall:
(1) Demonstrate that its subcontracting plan represents a creative and innovative program for involv-ing small, HUBZone small, small disadvantaged, women-owned, veteran-owned, and service-disabled veteran owned small business concerns in performing the contract.
(2) Include a description of the offeror’s subcontracting strategies used in any previous contracts, significant achievements, and how this plan will build upon those earlier achievements.
(3) Demonstrate through its plan that it understands the small business subcontracting program’s objectives and GSA’s expectations, and it is committed to taking those actions necessary to meet these goals or objectives.
(d) In determining the acceptability of any subcontracting plan, the Contracting Officer will take each of the following actions:
(1) Review the plan to verify that the offeror demonstrates an understanding of the small business subcontracting program’s objectives and GSA’s expectations with respect to the program and has includ-ed all the information, goals, and assurances required by FAR 52.219-9.
(2) Consider previous goals and achievements of contractors in the same industry.
(3) Consider information and potential sources obtained from agencies administering national and local preference programs and other advocacy groups in evaluating whether the goals stated in the plan adequately reflect the anticipated potential for subcontracting to small, HUBZone small, small disadvan-taged, women-owned, veteran-owned, and service-disabled veteran owned small business concerns.
(4) Review the offeror’s description of its strategies, historical performance and significant achieve-ments in placing subcontracts for the same or similar products or services with small, HUBZone small, small disadvantaged, women-owned, veteran-owned, and service-disabled veteran owned small business concerns. The offeror’s description can apply to commercial as well as previous Government contracts.
(e) Failure to submit an acceptable subcontracting plan and/or correct deficiencies in a plan within the time specified by the Contracting Officer shall make the offeror ineligible for award.
(End of provision)

Offerors should note the requirements of paragraph entitled License Requirement, on page H.18, that evidence of having or having made application for all appropriate permits and licenses for the state speci-fied must be submitted with their offer.

The minimum wage rates and fringe benefits applicable to the initial 1 year period of performance are outlined on the wage rate sheet.

Payment terms are set forth in the Prompt Payment clause in this solici-tation. EXAMPLE: Inserting "Net 20" may cause the of-fer to be rejected as unacceptable, because the entry would be contrary to the 30-day payment terms specified in the Prompt Payment clause.
OPTION TO EXTEND SERVICES
Offerors should note that Section I of this solicitation includes FAR 52.217-8, Option to Extend Services, which allows the Government the unilateral option to extend the term of any resultant contract up to six months, exclusive of any other option provisions which may be included as part of any resultant contract.

All the contractor’s labor hour prices must include expenses for overhead, General and Administrative (G&A) and profit. Thus, no separate allowance for travel time, parking, overhead, G&A or profit will be applied when hourly services are ordered.
Offeror must submit offers for all locations in order to be considered for award. Offerors must submit prices for all four of the option periods, in addition to the initial period, to be considered for award. Options shall be priced using the wage determination contained in this solicitation. Upon exercising a renewal option, the contract price will be adjusted in accordance with FAR 52.222-43 Fair Labor Standards Act and Service Contract Labor Standards—Price Adjustment (Multiple Year and Option Contracts) (May 2014).
Offerors should visit the building and become familiar with existing conditions; examine all contract documents relating to this work, and carefully review the requirements contained in this specification. Offerors shall determine any conditions which affect the work and make a thorough site investigation before submitting an offer. No allowances will be made for failure of an offeror to avail themselves of such information.
Note 1. These quantities are for evaluation purposes only and are based on an estimate of the Government’s anticipated need for such service.
Note 2. Quote a price per hour for providing Above Standard Services when ordered that are in addition to the services specified herein for the standard services. Orders for above standard service may be placed orally when the amount of the order totals $2,500.00 or less or in the event of an emergency. All orders which exceed $2,500.00 must be placed or confirmed by issuance of a GSA Form 300, Order for Supplies or Services and will be paid by GSA Finance. The GSA Form 300 will describe the service to be provided and will establish, excluding emergencies as determined by the Contracting Officer (CO) or the Contracting Officer’s Representative (COR), the maximum number of hours for which the contractor will be compensated.
Orders of $2,500.00 or less may be processed using the Government wide commercial purchase card, which is the preferred method to purchase and to pay for micro purchases. Individual orders for above standard services involving more than forty (40) hours will only be issued with the assent of the contractor. This above standard services provision is intended to be used to satisfy the Government's short term non-recurring needs for service. Should a continuing need for additional service arise, a contract modification will be negotiated pursuant to the "Changes Fixed Price" clause. Above standard services cannot be accomplished by diverting resources from work that is supposed to be accomplished.
SECTION C - DESCRIPTION/SPECIFICATION/STATEMENT OF WORK
C.1 Introduction
This is a Performance Based Contract which focuses on outcomes as opposed to prescriptive requirements. This specification represents GSA's performance objectives and minimum levels of service to be provided by the contractor. A high level of effective communication between the Government and contractor is essential. This performance-based requirement demands a greater emphasis by the contractor on self-evaluation, robust quality control processes and strict oversight of building operations to ensure the highest level of efficiency. The Contractor will be required to maintain a quality control program to ensure that the requirements of this contract are met. The contractor must closely monitor all aspects of the work, identify deficiencies and implement corrective action, without reliance on Government oversight.
C.1.1 Scope of Work It is the intent of the Government to keep the maximum amount of materials from landfills through aggressive recycling.
The contractor shall provide all management, supervision, labor, materials, equipment, repairs, parts, tools and supplies including inspection and maintenance of all operational equipment necessary to provide recycling services identified in Section B and as described herein. The contractor shall plan, schedule, coordinate and ensure effective and economical completion of all work and services specified in this contract. The contractor will furnish all supplies, materials, equipment, and employee training necessary for the performance of the work of this contract unless otherwise specified herein.
The Contractor shall maintain all the spaces used in the performance of recycling services in a clean and orderly manner. The overflow of materials from containers and dumpsters shall be picked up from the ground and floor area used to collect and consolidate the materials. The Contractor shall remove all hydraulic fluid and/or oil spillage caused either by the collection vehicles, or released from containers at the designated centralized collection site (loading dock, etc.). Sorbent use for cleanup shall contain post-consumer recycled content minimum as required.
The minimum depends on the type of sorbent used: see the EPA/CPG website for details. Spill residue and clean-up materials shall be disposed of in accordance with the Environmental Protection Agency (EPA), and State and local regulatory requirements
(a) The Contractor shall develop and implement operational guidelines covering all aspects of the recycling service. A copy of the guidelines shall be submitted to the COR within 5 days after award.
All equipment shall be maintained in accordance with the manufacturer's recommendations and/or the best practices of the industry.
(b) Maintenance includes, but is not limited to, greasing, oiling, cleaning, adjusting, replacing belts and replacing of other expendable items, it also includes scheduled work on all contractor equipment or systems required to provide continuing operation, to preclude unnecessary breakdowns and to provide continuous service.
(c) When equipment is taken out of service for any reason, the Contracting Officers Representative (COR) shall be notified immediately. Notification will include the reason for outage, action being taken to return equipment to service and the anticipated schedule for the equipment re-entering service.
C.1.2. Additional Recycling Services Collections of recyclable materials not included in the base contract may be required on an irregular basis and will be coordinated with the CO or their designee. Payment for these pick-ups shall be based on a price per pick-up.
Collection may include electronics, techno-trash, batteries, commercial plastic, and/or unusable wooden pallets.
Techno trash is a recyclable material type category that includes but is not limited to electronic media, inkjet and toner cartridges, rechargeable batteries, and computer cables and accessories. All material shall be recycled in accordance with the Environmental Protection Agency (EPA), and State and local regulatory requirements. The Contractor shall use an R2 or e-Steward Certified company for the disposal of all electronic and applicable techno trash materials.
C.1.3. Disposal Facility
It is the desire of the Government that all solid recyclables collected as a requirement of this contract shall be removed from the premises and transported to a processing facility for the purpose of remanufacturing or recycling to the extent available. All recyclables not transported to a facility for remanufacturing or recycling shall be disposed of only through a recyclables disposal facility that has been certified by the appropriate State Agency responsible for recycling management, or by the U.S. Environmental Protection Agency.
C.1.4. Number of Containers Required AND Schedule of Pick Up Recycling Services: The Contractor shall supply containers as indicated in Exhibit 1, Building Information Sheets.
The Contractor will be responsible for the maintenance of the compactors during the life of the contract. The Contractor will be responsible for the delivery of all equipment, containers, and any other necessary equipment at the start of the contract, as required during the term of the contract and for the removal of all equipment, containers, and any other necessary equipment at the end of the contract. Specific containers and other equipment will be coordinated through and with the approval of the COR. The Contractor must inspect the building locations in order to identify specific limitations and requirements of the material storage and loading dock areas. The Contractor will be responsible for the loading and unloading of storage containers, pallets, etc. The Contractor shall remove the recyclable materials within the prescribed time period listed in Exhibit 1 for each property and furnish all necessary labor, materials and transportation for loading and removal of the recyclable materials.
Normal Pickups: Removal of the recyclable materials will occur during the normal operating hours of the building from which the materials are being removed, unless otherwise defined in this specification.
There will be no pickups required on Saturdays, Sundays, or Federal Holidays
C.1.5. Container Maintenance The contractor shall inspect and if necessary, perform maintenance on all equipment. This shall include thorough mechanical inspections, replacing defective parts, lubricating, and necessary adjustments in alignment of defective wheels, latch, or other component parts, and the washing and deodorizing of all containers. Spare or replacement containers shall be provided for those containers out of service for repairs or beyond repair within 24 hours when requested by the Property Manager’s Office. The Government shall place all recyclables in containers. The contractor will be required to clean up and remove all spillage and/or littering caused by his operations.
C.1.6. Recyclable Materials Disposition The Contractor shall ensure that all recyclable materials are recycled and not placed in landfills and incinerators. The CO or their designee may direct the Contractor to participate in joint efforts with State, city, and local governments regarding recycling.
C.1.7. Pick-ups on Call Additional or special pickups of recyclables may be required on an irregular basis. Pickups shall be accomplished within 24 hours of notification by the CO or their designee. Payment for these pickups shall be based on a price per pickup. Additional pickups required to address overflow of trash resulting from normal building operations will not be reimbursed. The above standard service pricing in Section B applies only to additional trash pick-ups required due to an unusual event or circumstance.
C.1.8. Recycling Containers Storage Containers: The Contractor shall provide the necessary storage containers and other equipment, such as compactors, dumpsters, etc. for use in designated holding areas. Containers shall be in sufficient quantities for the collection and storage of recyclable materials in the holding area prior to removal from the premises by the recycling Contractor.
C.1.9. Restriction on Use Recyclable paper purchased under this Contract shall be used or sold as recyclable paper only, i.e., for processing at a pulp mill to be made into new paper products. The Contractor shall not use, allow access to, or offer for resale any papers, documents, or file record materials for the information contained therein.
C.1.10 Recycling Reports Monthly Recycling Report: The Contractor shall submit a monthly Recycling Report listing the types, weights, and costs or revenues. Included in the report are single stream recycling, commingled recycling, and composting (if applicable). Reports shall be submitted by the 15th of each month and upon request by the CO or their designee. A sample report can be found in Exhibit J4.
The recycling reports shall contain sufficient data to calculate waste diversion and waste removal costs. When actual weights are not known, the Contractor shall use EPA’s Standard Volume-to-Weight Conversion Factors. Deductions shall be made and reported for volumes that are not filled to capacity (i.e., half full, 3/4 full, etc.) and conversions adjusted accordingly.
