Contractor Responsibility for Scheduling and Staffing Efficiency:
1. Overtime Minimization: The Contractor shall make every reasonable and diligent effort to design employee schedules, relief rotations, and shift assignments to completely eliminate the occurrence of billable overtime hours.
2. Standard Workweek: The Contractor is solely responsible for managing its personnel to ensure that individual security officers do not exceed forty (40) hours of work in a designated workweek on the ACCGov’s account, unless explicitly authorized in writing by ACCGov.
3. No Automatic Billing: ACCGov shall not be held liable for, nor will it pay, any automatic or unapproved overtime premiums resulting from the Contractor's internal scheduling deficiencies, chronic understaffing, shift-to-shift relief delays, or guard cross-utilization from other accounts.
Mandatory Prior Approval Process
1. Advance Request: In the event that a scheduling vacancy, specialized operation, or emergency requires an officer to work overtime hours that will be billed to ACCGov, the Contractor must seek and obtain written approval from ACCGov, in writing, prior to the commencement of the affected shift.
2. Approval Threshold: Verbal approvals shall only be permitted in immediate, unforeseen life-safety emergencies and must be followed by a formal written confirmation (via email) within twenty-four
(24) hours of the verbal authorization.
3. Unapproved Overtime Penalty: Any overtime hours billed to ACCGov that lack a verifiable, documented prior written approval from ACCGov will be strictly denied. ACCGov will alter the invoice to pay for those specific hours at the standard, straight-time base hourly bill rate outlined in the submitting pricing table.
Financial Calculation of Approved Overtime:
1. Compliance with FLSA: When overtime is explicitly authorized by ACCGov, it shall be billed at a rate of 1.5 times the standard hourly bill rate for the specific staff being utilized.
2. Blended Premium Rules (Shift Differentials): In compliance with the Fair Labor Standards Act
(FLSA), if an officer works approved overtime during the Designated Night Shift (7:00 PM – 7:00 AM), the 1.5x overtime multiplier shall be calculated using the Night Shift rate.
3. Pyramiding Prohibited: Billable hours shall not be "pyramided." Overtime premiums shall not be duplicated or combined for the same hours worked.
Call-Out Exception: If an emergency relief situation occurs, such as a no-call no-show, the Contractor may authorize up to two (2) hours of emergency overtime to maintain post-coverage while actively deploying a straight-time relief staff member, provided ACCGov is notified immediately upon occurrence.
G. ADDITIONAL TERMS & CONDITIONS:
1. The Contractor must not hire, for assignment at ACCGov sites, or allow work under this contract, people who have been convicted of a felony or misdemeanor violation involving theft or dishonesty. Violation of this provision may be considered cause for immediate termination of the contract.
2. Driver’s license: Contractor must ensure all employees assigned to ACCGov shall be the holder of a valid Class C driver’s license, which shall be in their possession throughout the term of this contract. A good color copy of this license shall be kept in the employee’s file.

5. Removal of employee from contract: in the event ACCGov disapproves any employee hired by the Contractor for assignment under the contract, the Contractor shall remove the employee immediately upon verbal confirmation of ACCGov. ACCGov will provide written confirmation of such notice to the Contractor within thirty-six (36) hours of receipt of a request from the Contractor.
6. The Contractor is required to supply personnel in sufficient number as required to provide the service type and coverage as indicated herein, to include relief for lunch and rest breaks, at no additional cost to ACCGov. Security officers’ assigned shift and assigned work site will not be changed without prior approval of ACCGov.
7. The Contractor must maintain a contingency of security staff on an “on-call” basis sufficient to cover all no-shows.
8. Contractor must endeavor to staff assignments so that security staff does not incur overtime hours.
9. A holiday premium will be allowed for New Year’s Day, Memorial Day, Independence Day, Labor
Day, Thanksgiving Day, and Christmas Day. No other holidays observed by ACCGov, state, or federal law shall be eligible for premium holiday billing. Holiday premium billing is strictly limited to the actual 24-hour calendar day of the holiday beginning at 12:00am (midnight) and concluding at 11:59pm on the specified date.
