Page | 9

q) General: The term excavation used hereinafter refers to unclassified excavation. All types of excavation, regardless of the material encountered within the project’s grading limits, shall be carried out according to the lines and grades specified by the City. Excess material from the excavation not needed for fill or backfill shall be disposed of on the site at locations designated by the City and shall be spread, shaped, or graded as directed. Excavation and backfilling shall be done in a manner and sequence that always ensures proper drainage. Grading shall be performed as needed to prevent surface water from flowing into trenches or other excavations, and any water that collects shall be pumped out or removed by other approved methods. Sheeting and shoring shall be installed as necessary to prevent surface water from entering trenches or excavations, and any accumulated water shall be removed by pumping or other approved techniques.

r) Trench excavation shall be done by open cut, and trenches shall be of the necessary width for proper pipe placement. The trench banks shall be as nearly vertical as practical. Care shall be taken not to over-excavate. No more trench length in any location shall be left open, in advance of the completed work, than is authorized or directed.

s) During excavation, materials suitable for backfilling shall be piled in an organized manner at a sufficient distance from the trench banks to prevent overloading.

t) Except as otherwise specified for wet or unstable material, backfill over depths shall be with the materials designated for filling the lower part of trenches.

When wet or unstable material is found at the bottom of the trench, as determined by the City, such material shall be removed to the required depth, and the trench backfilled to the proper grade with coarse sand, fine gravel, or other approved suitable material. Specific requirements related to particular utilities are as follows:

u) The width of the trench one foot above the top of the pipe must be such that the clear space between the pipe's barrel and the trench wall does not exceed eight inches on either side of the pipe. The width of the trench above that level should be as wide as necessary for sheeting and bracing to ensure proper work performance.

v) The bottom of the trenches shall be accurately graded to ensure uniform bearing and support for each section of the pipe on undisturbed soil throughout its entire length, except for the areas where excavation is necessary for proper sealing of the pipe joints, as specified hereafter. Depressions for joints shall be dug after grading the trench bottom, and to ensure the pipe rests on the prepared bottom along as much of its length as feasible, these depressions shall be only as long, deep, and wide as required for correctly assembling the specific type of joint.

Page | 10

w) Shoring shall be recovered in a way that prevents damage or disturbance to the work, and the excavation shall be free of forms and debris. Approved soil material shall be placed in layers no thicker than six (6) inches, unless otherwise specified, and compacted to match the density of the surrounding material. Each layer shall be spread evenly, moistened or dried by aeration when needed, to achieve the proper moisture content, and compacted uniformly using hand or machine tampers or other suitable equipment. Backfill shall be brought to final grade unless otherwise specified. Care shall be taken to avoid wedging or eccentric forces on or against any structure, and to prevent any disturbance or damage to the work.

x) Lower portion of trenches: Backfill material shall be placed in layers no thicker than six (6) inches and compacted with suitable tampers to reach a density of 90% as per AASHTO T-99, until there is a minimum cover of one (1) foot over the crown of the pipe or conduit. The backfill material in this part of the trench shall be composed of approved materials free from stones larger than three (3) inches in any dimension. However, where the pipe is coated or wrapped for corrosion protection, the backfill shall be free from stones larger than one (1) inch in any dimension.

y) Upper Portion of Trenches: The rest of the trench shall be backfilled with City-approved material that is free of stones larger than six (6) inches in any dimension. Backfill material under turfed or seeded areas shall be placed in layers no thicker than twelve (12) inches, and each layer shall be compacted to match the density of the surrounding undisturbed soil.

z) All lines shall be constructed true to line and grade as indicated. Trenching, excavation, bedding, and backfill shall be performed as specified herein before.

All pipes found to be defective or improperly laid shall be removed from construction, and the affected portion of the line shall be repaired to the satisfaction of the City at the Contractor's expense.

aa) Each pipe must be carefully inspected before installation, and any defective or damaged pipe must not be used. Adequate facilities should be available for lowering pipe sections into trenches. Pipe laying should progress upward, starting at the lower end of the pipeline. Under no circumstances should pipe be laid in water, and pipe should not be installed when trench conditions or weather are unsuitable. All pipes should be laid with the tongue end in the direction of flow.

bb) Perforated plastic pipe shall be installed to collect seepage water from areas where spring water has been exposed to the surface due to grading operations.

Excavations for trenches to hold the pipe shall start at the visible source of seepage and extend to locations designated by the City. Trenches must be at least three (3) feet deep and twelve (12) inches wide. A six (6) inch layer of pea gravel, similar to that used in green construction, shall be placed at the bottom of the trench before installing the pipe. The upper ends of the pipe shall

Page | 11 be closed off, and the trench shall be backfilled with gravel up to six (6) inches below the ground surface. Topsoil shall then be added to level the trench with the surrounding ground level.

cc) Instead of headwalls, pipe shall have flared end sections on both ends, meeting the requirements of the pipe type specified on the plans. These sections must be installed following the manufacturer's recommendations. Not all culvert or pipe runs need flared end sections.

dd) The invert of the swales shall be graded to a smooth and even grade to ensure a consistent flow of drainage with a minimum slope of one (1) percent, unless noted otherwise on the drawings. Side slopes shall be blended into existing contours to allow for proper mowing operations without scalping ridges or depressions. Material excavated from the swales shall be used as fill in adjacent areas or as directed by the City.

ee) The City shall require the Contractor to build diversion swales to prevent surface runoff from damaging tees, greens, bunkers, fairways, or other areas.

When needed, these swales will be designated by the City in the field. A change order will be necessary if this occurs.

ff) The Contractor shall take all necessary precautions to prevent any damage to existing trees, foliage, plant materials, and property outside the work areas.

gg) If the Contractor encounters material beneath the ground surface that prevents proper installation of the work as specified, he shall immediately notify the City before proceeding.

hh) All pipes and drains, at the time of final acceptance, must be free of silt, debris, or any obstructions.

III. TECHNICAL SECTION – SODDING

a) Sod must be turf type blue/rye approved by the City in writing prior to purchase.

b) The installed sod shall be cut at a height of no more than 2 inches at the time of installation.

c) Sod shall include a maximum of the top 1 inch of well-established cultured sod, primarily made up of live Kentucky Bluegrass varieties grown on loam soil, unless the City approves a different option. The sod must be free of noxious weeds, mostly free of all other weeds, and free of roots, stones, and other objectionable materials. It should withstand normal handling without breaking or tearing excessively.

d) Before cutting the sod, it shall be raked clear of debris, and the top growth shall be trimmed to the height specified in the Schedule of Values.

e) When the sod is cut, it should be moist enough to endure exposure and handling during transplanting. If needed, water the sod before cutting.

f) Water should be appropriate for irrigation and free of substances that could harm plants. Water will be supplied by the City.

Page | 12

g) Stakes used to hold the sod on slopes should be laths or shingles, 6 inches long and pointed. If this length does not provide a secure hold, a longer stake that can ensure a firm grip should be used.

h) The Contractor should understand that the finish grading of golf course construction is the most artistic and creative part of the work, and the Contractor must coordinate, cooperate, and work closely with the City to achieve the desired results.

i) The Contractor shall take all necessary precautions to prevent damage to drainage pipes, irrigation pipes, wiring, sprinkler heads, controllers, and underground valve boxes that are already installed. Any culverts or other pipes near haul roads should be ramped with sufficient earth fill if needed to prevent damage. If any damage occurs, it will be the Contractor's responsibility to repair it at his own expense.

j) All grades and contours previously established during the rough grading process will be preserved and refined. Any damage or disturbance to these grades or contours will be repaired by the Contractor.

k) The finish grading operation shall commence after the irrigation and major drainage work are completed in a specific area. The City will be notified beforehand so they can inspect all work up to that point and assist the Contractor in scheduling the finish grading.

l) Any area that has been compacted by vehicle traffic or by storing materials or equipment must be ripped, plowed, disked, and dragged to restore it to a workable, crumble-ready condition. Ripping, tilling, or otherwise loosened soil should reach a depth of 6 inches. This should be performed in at least two different directions to effectively break up the material and prevent water retention pockets in the subgrade.

m) The fairways shall be smoothed and floated using a tractor-drawn board, pipe drag, steel mat, soil surgeon, or an equivalent tool. All clods shall be thoroughly broken up, and all areas blended to match existing grades. This ensures that there are no spots that will hold water and that the surface is level enough so that a gang mower set at 1/2 inch in height will not scalp any area.

n) The Contractor shall supply a six-inch (6") topsoil layer for the areas designated on the plans to be sodded and tie-in the entire site to the existing grade.

o) If the topsoil cover has been disturbed or is less than an acceptable depth before seeding, the Contractor shall add topsoil to deficient areas to reach the minimum acceptable depth.

p) Topsoil shall be free of turf, weeds, rocks larger than one (1) inch in diameter within the top four (4) inches, concrete, roots, lime, cement, ashes, or other harmful materials, which shall be hauled to a designated area on site. Topsoil shall be natural, friable, fertile loam with characteristics of representative topsoil in the local area.

Page | 13

q) All holes, depressions, and rivulets must be filled and smoothed out. Any sticks, branches, stones, or debris on the surface that could interfere with sodding should be picked up and removed from the site.

r) The areas to be sodded shall be prepared until the soil is fully fined, mellow, at least two inches deep, disked, shaped to finish grade, and smoothed with a tractor-drawn board, pipe drag, steel mat, soil surgeon, or similar equipment.

All clods shall be thoroughly pulverized, and the entire area blended to the existing grades. This process will ensure that no spots hold water and that the surface is such that a gang mower set at 1/2 inch height will not scalp any area.

s) Areas around irrigation heads, controllers, drainage lines, caps, restricted zones near bunkers, and greens that cannot be mechanically prepared shall be manually raked and smoothed.

t) Precautions must be taken to prevent sod from drying out and from heating.

Sod that shows visible signs of heating shall not be used in the project.

u) Strips should be placed tightly against each other so that no open joints are visible. Sod should be placed without stretching.

v) Sod shall be watered and compressed into the underlying soil by rolling. The initial watering and rolling shall ensure firm contact and bonding between the sod and the soil beneath. The rolling shall produce a smooth, even surface free of humps and depressions, but shall not cause excessive compaction.

w) At the top of slopes, sod will be laid to prevent water from nearby areas from flowing freely onto greens or into bunkers, reducing silt contamination.

x) Sod adjacent to greens shall be lowered so that its top is level with the finished surface of the green. Sod that extends above the green surface will be removed by the Contractor and properly re-laid.

y) Before the finish grade and sod preparation are completed and before any grassing, the City shall be notified for inspection and approval.

City of Englewood Construction Use Tax and Arapahoe County Open Space Use Tax

Contractors and subcontractors who “build, construct or improve any building, dwelling or other structure or improvements to realty whatsoever” (Englewood Municipal Code) within the city are required to pay City of Englewood use tax and Arapahoe County Open Space use tax on any construction materials built into, incorporated or used on such projects, including building, constructing, or improving public infrastructure such as roads, sidewalks and government-owned buildings and facilities. City construction use tax and Arapahoe County Open Space use tax is collected on permits for construction materials that become part of such improvements to realty. Construction materials can be purchased exempt from city and county sales tax by providing a copy of the city building permit to suppliers. Subcontractors on projects should purchase construction materials in the same manner.

Contractors who apply for city permits are required to pay city use tax of 3.8% and county open space use tax of .25% on 50% of the contract value/price for improvements to

Page | 16 structures, and on 40% of the contract value/price of improvements other than to structures (roads, sidewalks, right-of-way improvements, for example).

Materials and supplies other than construction materials are subject to both state-collected and locally-collected retail sales taxes in effect at the place of purchase.

Examples include temporary fencing, tools, equipment purchased or rented for the project, cleaning and crew supplies and any other items that would normally be subject to regular retail sales taxes and used consumed/used by contractors and subcontractors.

Materials and supplies other than construction materials cannot be purchased exempt with a city-issued building permit.

Contractors and sub-contractors may be exempt from state-collected taxes (for example, State and RTD tax) when the material becomes part of the structure for a tax-exempt entity. The contractor must obtain an exemption certificate from the Department of Revenue to purchase the materials exempt from state-collected sales and use taxes. See https://tax.colorado.gov/sites/tax/files/documents/DR0172_2022.pdf for more detail.

Important Note: The tax-exempt status of a contractor’s customer – including the City of Englewood – does not flow through to contractors and subcontractors with respect to the payment of city and county use tax on construction materials. Contractors and subcontractors are the end-users and consumers of construction materials, and the Englewood Municipal Code clarifies that construction materials are subject to city and county use tax at the time city building permits are issued, regardless of the tax-exempt status of contractors’ customers.

Contractors and sub-contractors are required to keep records sufficient to verify that the correct amount of City use tax and Arapahoe County Open Space use tax was paid on construction materials used and consumed on permitted projects in the City. Records for permitted projects are required to be maintained for three years after the issue date of the Certificate of Occupancy and shall be made available to the City of Englewood for examination upon request.

See Englewood Municipal Code – Sections 4-4-2; 4-4-4-3; 4-4-5-1; 4-4-5-2; 4-4-5-3.

Liquidated Damages: Contractor shall pay the City $1,600 - $2,300 (dependent on final pricing as defined in the General Terms and Conditions) for each day that expires after the time specified for substantial completion until the work is complete, and $1,600.00 - $2,300 (dependent on final pricing as defined in the General Terms and Conditions) for each day that expires after the time specified for final completion until the work is finally complete. Liquidated damages will be finalized in the contract with the awarded contractor based on the final pricing per the General Terms and Conditions.

Supplemental Services

The City has, to the best of its knowledge, defined the scope and tasks to complete the work. The Contractor may propose, at its discretion, additional services beyond those

Page | 17 listed in this RFP that it feels are necessary to complete the work or add value to the project. Those additional services shall be included in the scope and fee as a stand-alone task under “Supplemental Services.” The City Project Manager must approve Supplemental Services before performing the work.

Contract Renewal The initial contract term will be for one year from the date of execution.
