This acquisition is being conducted under FAR 13.5 Simplified Procedures for Certain Commercial Items. Only FAR Part 13 procedures will be used to solicit and evaluate offerors. Per FAR 52.216-1, the Government contemplates award of a firm-fixed-price contract resulting from this solicitation.
PM4 Service Support Ships Project Office requests proposals for vessel(s) capable of meeting the transportation requirements described below. The paragraph numbers below apply to the box layout of references (a) and (b), which are incorporated herein by reference (available on the MSC web site at https://www.msc.navy/mil, under “Contracts,” then “Proforma” or upon request), and shall be the charter form of any contract resulting from this solicitation. By submission of a proposal, the offeror confirms agreement with all terms and conditions of this solicitation and the charter form, unless otherwise identified therein.

A. PART I – TANK TIME BOXES:
1. Vessel Required:
a. General: The U.S. Indo-Pacific Command (USINDOPACOM) requires one, U.S. or foreign flagged Tanker vessel to be used during Exercise SEACAT 2023 as part of a boarding exercises from 15 August 2023 to 26 August 2023. Exercise workshop will be conducted in Singapore from 15-17 August, and then during the underway phase from 17 August 2023 to 26 August 2023. The vessels will serve as training platform to facilitate boarding exercises in the Southeast Asia. The place/range of delivery will be Singapore or a designated anchorage in the vicinity of Singapore. The place/range of redelivery will be Manila, Philippines or a designated anchorage in the vicinity of Manila. The layday commences 15 August 2023, 0800 local and cancels 15 August 2023, 1600 local; and the period of performance will be 12 days.
On 15 August 2022, the second vessel will be available in Singapore to support a VBSS training workshop taking place in Singapore from 15-17 August. On 17 August a small US Coast Detachment of six (6) passengers will embark in Singapore. The vessel will then depart Singapore on 18 or 19 August to proceed northeast IVO Brunei in the South China Sea, then continue northeast towards Kota Kinabalu, then continue up north to Palawan and finally to Manila, Philippines, by 26 August where the Coast Guard detachment (USCG det.) will disembark on or around 26 Aug with vessel off. Following is a notional schedule:

On 15 August at 1200 hrs (Local) or upon completion of the on vessel on-hire process, a meeting will be conducted, either in person in Singapore or a teleconference via CISCO WEBEX, to review the concept of operations with the vessel’s crew. On 17 Aug at 1600 hrs (Local), the USCG det. will embark the vessel.
During the duration of the exercise, the vessel will receive instructions to reach waypoints at set times. Communication will primarily be conducted via email, with Satellite Phone. All vessels will be equipped with a satellite phone in the event that all other available communication methods fail. The vessel will have onboard as a member of the crew at least one proficient English speaker. Vessels will be required to report via email their current position, course, and speed every two hours.
Communication will be facilitated onboard by the presence of US government representatives in the form of the USCG det.
Security forces from partner nations participating in the exercise will conduct compliant boarding at sea for training purposes in the Visit, Board, Search, & Seizure (VBSS) training scenario at designated locations during the transit. These scenarios will be provided in advance to the ship’s Master. These boarding exercises will be facilitated by U.S. Coast Guard detachment of up to six (6) members who will be onboard the chartered vessel for the duration of the exercise. The detachment will supervise partner nation security forces conducting the boarding, providing feedback and training during the exercises. The USCG det. will require messing and berthing onboard the vessel during their stay. These costs shall be included in the charter rate.
During the boarding operations, vessels will respond to queries and comply with directions from the USCG det. and partner nation security forces. Safety is paramount and no vessel will be expected to conduct a maneuver considered unsafe by its Master.
Boardings by these partner nation security forces on the vessel are expected to occur in operational areas off the coasts of Brunei and the Philippines. Exact operation areas will be identified prior to the start of the exercise and may be adjusted to obtain improved sea states or less maritime traffic. Boarding scenarios may include security personnel “fast-roping” from a helicopter if the vessel characteristics & safety considerations permit, and the Master is in concurrence. The ultimate decision to conduct fast roping would lie with the vessel Master.
b. The Government will consider vessels with the following specifics:

MESSING & BERTHING Messing and berthing for up to six personnel from the USCG det.
c. There is a classified requirement in this solicitation.
1. Owners/Offerors or their representative, with appropriate security clearances in place, must submit to the Contracting Officer a request to review the classified requirement within one business day of the issuance of this solicitation and then must make the necessary arrangements at their expense to view the classified requirement at the appointed place and time provided, which must be prior to the solicitation response date and time. The opportunity to review the classified requirement will be lost if the Contracting Officer does not receive a request on time or if the Owner/Offeror misses the appointment.
2. Offers will be considered against this requirement before any other evaluation. An offer found not acceptable with this requirement will not be further evaluated. Owners/Offerors will be notified if their offers were excluded because of this requirement.
3. There is no requirement to review the classified requirement prior to submitting an offer. Not reviewing the requirement prior to submitting an offer will not in and of itself render an offer ineligible for award.
d. Health and Safety Requirements:
1. Owner/Offeror shall provide the MSC Area Commander with any report required under U.S. Coast Guard Marine Safety Information Bulletin 02-20 (Change 7) (requiring hazardous conditions be reported), prior to entering the port.
2. Owner/Offeror shall provide in its proposal its company’s health and safety plans for its crew, related to the novel coronavirus for this mission. The plan will become part of the contract.
3. Owner / Offeror is advised that due to the time-sensitive and critical nature of the mission, including environmental factors, the Excusable Delay provision shall not apply if delay was caused by a breach of Owner’s Health and Safety Plan cited above, or was otherwise reasonably preventable by following U.S. Coast Guard or Center for Disease Control COVID-19 guidelines in publication at the time of breach.
4. Owner / Offeror agrees that crew and other embarked personnel may be ordered by the charterer to stay aboard the vessel during port visits under this charter as deemed necessary by the charterer or local government authorities. Further, the Owner / Offeror agrees that the charterer may limit access to the vessel by any shore-side personnel upon the vessel’s port calls during this charter.
e. Vessel must meet all MSC requirements for reporting. Vessel shall provide position/status reports in-port and at-sea every six hours daily at 0000, 0600, 1200, and 1800 hours local Washington, DC time (GMT-5 EST/GMT-4 EDT) and 72/48/24/12 hr pre-arrival notifications for all ports to Area Command. (d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

CHARTER
a. The Offeror’s price proposal will be evaluated based on the value of the charter hire rate(s) offered for the entire charter period of (a) 12 days, price for fuel, and any other pricing elements set forth in the offer. For evaluation purposes the period of performance will consist of (b) 12 days. Fuel calculations will be based upon (c) 00 days underway laden at the speed specified in the individual solicitation, using fuel consumptions provided in TANKTIME Boxes 89 and 91),
(d) 09 days underway ballast at the speed specified in the individual solicitation, using fuel consumptions provided in TANKTIME Boxes 90 and 91, (e) 03 days in port idle/loading, using the fuel consumption provided in TANKTIME Box 92a, and (e) 00 days in port discharging, using the fuel consumption provided in TANKTIME Box 92b). This will represent the overall price to the Government. The proposed price(s) must be determined to be fair and reasonable.
