SECTION 3 - INTRODUCTION

3.0 INTENT

The State of Florida Department of Education (hereinafter referred to as the "Department") is soliciting written Proposals from qualified Proposers to establish a term contract of which the term is anticipated to begin upon execution of the contract and be effective for thirty-six (36) months thereafter, with the option to negotiate up to a 5% increase annually based on the consumer price index published by United States Department of Labor, Bureau of Labor Statistics with a maximum total increase to not exceed 10%. The increase will start after the first 12 months of the contract. Award may be made to the responsible and responsive vendor(s) that the Commissioner of Education determines will provide what is most advantageous to the state, taking into consideration price and other criteria set forth in this document.

The resulting contract may be renewed for up to three (3) one-year terms, see Form PUR 1000 for renewal requirements

3.1 PURPOSE

The purpose of this Request for Proposal (RFP) is to provide the specified vending machines and accessory vending machine equipment that can be used in facilities operated by blind and legally blind individuals. The Contractor(s) will be required to provide Florida statewide uniform purchase, replacement parts, warranty service, terms of service, and repair service. Further, the Contractor(s) will be required to deliver, install, and provide on-site training of each vending machine and/or accessory equipment awarded for the Department’s Randolph- Sheppard Program.

3.2 BACKGROUND

The Division of Blind Services (DBS) is responsible for administering the Randolph-Sheppard Program enacted in 1936, 20 USC 107 et. seq., and as amended. The 1936 Act was passed to provide legally blind persons with remunerative employment, enlarge their economic opportunities and encourage self-sufficiency through the operation of vending facilities. The DBS developed a program based on federal law requirements that mandated the blind and legally blind be provided with effective tools, materials, and vocational training in all aspects of vending facility operation. The DBS selected equipment that could be standardized statewide in order to provide ease of operation, have interchangeable parts and enable operators’ upward mobility, and relocation opportunities with no retraining. Pre-pandemic 2018-19 State Fiscal Year, DBS purchased a total of 63 new vending machines for facilities operated by blind and legally blind individuals. The DBS is unique in the responsibility of training and preparing legally blind individuals for employment. The need for consistent training procedures and uniform business tools is critical to successful employment.

3.3 DEFINITIONS

After the award, said Proposer will be referred to as the "Contractor". For the purpose of this document, the term "Proposer" means a potential Contractor acting on its own behalf and on behalf of those individuals, partnerships, firms, or corporations comprising the Proposer’s team. The term "Proposal" means the complete response of the Proposer to the RFP, including properly completed forms and supporting documentation. The term “contract” refers to the agreement between the Department and the Contractor resulting from this RFP. A “responsive bid” is a Proposal submitted by a responsive and responsible vendor which conforms in all material respects to the solicitation. However, for purposes of determining what is material, please refer to Section 1 of this RFP. Use of the terms “shall,” “will,” “should” and “must,” or the designation of items as “requirements,” does not mandate that such items are material. The Department reserves the right to waive deviations, in its discretion. “Deliverable” means a tangible, specific, quantifiable and measurable event or item that must be produced to complete a project or part of a project directly related to the scope of services.

Any person who is adversely affected by the agency decision or intended decision shall file with the agency a notice of protest in writing within 72 hours after the posting of the notice of decision or intended decision. With respect to a protest of the terms, conditions, and specifications contained in a solicitation, including any provisions governing the methods for ranking bids, proposals, or Proposals, awarding contracts, reserving rights of further negotiation, or modifying or amending any contract, the notice of protest shall be filed in writing within 72 hours after the posting of the solicitation.
