Introduction
(a) Political Subdivision Status.
The Lowell Housing Authority (the “LHA”) is an autonomous, public housing authority created in 1937 as a public body politic and corporate with the City of Lowell and a political subdivision of the Commonwealth of Massachusetts. Enabling legislation is Massachusetts
General Laws, chapter 121B, et seq. The LHA is governed by a five-member appointed Board of
Commissioners, which is the LHA awarding authority.
(b) Housing Units.
The LHA owns and/or manages 3,142 units of housing comprising of: (a) 1,698 units in federal family and elderly/disabled housing developments. The HUD-aided properties are managed under an Asset Management Project model (“AMP”). The LHA has four (4) AMPs and the state-aided portfolio; (b) 198 units in state housing developments and (c) 1,246 U.S. HUD
Section 8 Housing Choice Vouchers. Images of the LHA housing units may be viewed at its website (hyperlink), www.LHMA.org
(c) Staff.
The LHA currently employs approximately 98 full and part-time employees including its central administration/management, property managers for each of the five property development areas, facilities/maintenance staff.
(d) Funding.
The LHA receives both federal and state grants that supplement its operational expenditures and support capital improvements. Annual operational spend is approximately $30M with state and federal capital expenditures of approximately $2.5M.
Request for Proposal (RFP) Process Justification Statement (Real Property)
A competitive RFP solicitation process is an appropriate method of procurement for this service.
Massachusetts General Laws, chapter 30B, section 16 requires this RFP solicitation process for the disposition of real property or any interest therein, and defines that the rental of real property is a
“disposition.”
Proposals are evaluated by a selection committee and the contractor/lessee selection is based on the evaluation criteria and factors for award as stated in the RFP. Contract award is based on the best (“most advantageous”) proposal responsive to the requirements of the statement of work resulting in the greatest benefit and best value to the Lowell Housing Authority and where monthly lease rate/price is not the primary award criterion.
Public housing and managing an emergency shelter apartment is a specialized form of housing requiring agency attributes, certifications and knowledge of the affected and oftentimes vulnerable populations including individuals or families that are categorized by MA Department of Housing and Community Development and U.S. HUD requirements as low income , disabled, veteran and victims of domestic abuse. This service requires a multifaceted provider with experience in
1 “Low income” generally includes households that are under 80 percent of the area median income as defined by the MA
Dept. of Housing and Community Development (“MA DHCD”). Other guidance may be utilized, such as standards set by related statutes including M.G.L. c. 23B, §30, MA DHCD’s Emergency Housing Assistance Program and its regulations.
www.LHMA.org
6 RFP #2015-1 Temporary/Emergency Housing Unit | Lowell Housing Authority apartment management with these populations and experience in emergency housing requirements. A qualifications-based solicitation process with a fair market rent will be applied under Massachusetts General Laws, chapter 30B, §16 et seq. and the U.S. Regulations 2 CFR
200.317 (including former HUD Regulations of Title 24, Part 85, 24 CFR §85.36) and the Lowell
Housing Authority Procurement Policy as amended.
In order to determine the property rental value, the LHA adopts a fair market rent +10% (110%) rate policy that correlates with the final U.S. HUD Fair Market Rate Metro-Lowell for the current calendar year. The LHA current-year (2014-2015) rate for a 3 Bedroom apartment is
$1,519.00/month. (=$1,381 x 1.10). All rates may be viewed on its website:
