About this file

This document is an Addendum No. 2 issued by the City of Atlanta Department of Procurement for RFP/PS/COURT/2305-1240125/Digital Recording Services. The addendum provides a response to one question related to site visits, stating that the City may require one or more onsite visits to the Bidder's site to ensure compliance with the City's requirements, and that the Bidder must reimburse the City for authorized travel and lodging expenses related to such visits. The addendum also clarifies that the City does not intend to modify the language in the Agreement included in the RFP, and that any proposed revisions to the terms or language must be submitted with the Bidder's response, otherwise it is assumed the Bidder fully agrees to the provisions.

The RFP is for digital recording services, and the City requires that Bidders comply with the City's Code of Ethics provisions regarding reimbursement of travel and lodging expenses related to site visits. The Agreement terms and conditions are standard and required by law, and any significant exceptions proposed could render the Bidder ineligible for award.

Questions and Responses

The following questions and /or clarifications were requested by various proponents:

1. Question

Section 5.4.1 states that the City of Atlanta may require one or more onsite visits to the Bidder’s site to assure Bidder’s compliance with the City’s Requirements and other applicable requirements. Suppliers must reimburse the City, in accordance with the City of Atlanta’s Code of Ethics provisions, for authorized travel and lodging expenses related to such onsite evaluations after the purchase order has been assigned and occur no later than 30 days after receipt of invoice.

Question/Comment: Customers are always welcomed to visit CourtSmart, but we do take exception to the reimbursement requirement stated in 5.4.1.

Response Please refer to #16 within Information and Instruction to Proponent of Solicitation Requirement Section.

16. Award of Agreement; Execution: If the City makes an award pursuant to this RFP, the City will prepare and forward to the successful Proponent an Agreement for execution substantially and materially in the form of Agreement included in this RFP. Execution of the Agreement within 5 business days after notification of award is a requirement of this RFP. Note that the City does not intend to modify any language contained in the Agreement as the terms and the conditions are standard, required by law and align with City practices. Any proposed revisions to the terms or language of the Agreement must be submitted in writing with the Proponent's response to the RFP. If no exceptions are submitted, it is assumed that the Proponent fully agrees to the provisions contained in the Agreement in its entirety. Any significant exception proposed could render the Proponent ineligible for award under this RFP.
