About this file

This document is a Request for Proposal (RFP) from the City of Cedar Park, Texas for Merchant Banking Services. The RFP seeks to replace the current credit card payment processing system with a new solution that functions with Tyler Incode versions 9 and 10 before December 31, 2024. The project requires a new payment processing partner capable of supporting 24 or more credit card readers across six city departments, including Utility Billing, Municipal Court, Library, Parks & Recreation, Fire Marshall, and Police Department. The proposal must support transactions via MasterCard, Visa, Discover, and other services, with the ability to authenticate cardholders, perform electronic check conversion, provide daily transaction reporting, and maintain PCI compliance.

The contract will be for one year, with the potential to automatically renew for up to nine additional one-year periods and no more than a 3% escalation factor per renewal. Proposals will be evaluated on three key criteria: 25% experience, 35% the City of Cedar Park's assessment of the vendor's performance capability, and 40% pricing. The new system must deposit gross payments daily, provide online reconciliation reports, offer a backup web solution, and be compatible with current and future credit card industry technologies. Proposers must submit comprehensive documentation, including conflict of interest forms, W-9, references, and detailed information about their company and proposed solution by the due date of March 29, 2024, at 2:00 PM.

3.5 Performance and Payment Bonds

Texas Local Government Code Chapter 252, as amended, provides that for any contract for the construction of public works, a proposer must execute a bond that is: (a) in the full amount of the contract price, and (b) conditioned that the contractor will faithfully perform the contract; and (c) executed, in accordance with Texas Government Code Ch. 2253, as amended, by a surety company authorized to do business in the state.

Texas Government Code Ch. 2253, as amended, provides that a payment bond is required if the public works construction contract is in excess of $25,000 and is to be made for the full amount of the contract. A performance bond is required if the contract is in excess of $100,000 and is to be made for the full amount of the contract.

4. SCOPE OF WORK

Replace Credit Card Payment Provider System (inc. PCI Compliance)

What's Happening Now?

Currently, the City of Cedar Park uses Elavon Payment Processing system as a PCI compliance partner for credit card transactions including point-of-sale transactions, phone and internet transactions, and electronic check conversion that interface with the City ERP Incode 9 & 10 by Tyler Technologies.

Recently, Cedar Park was notified that support from Elavon will end and Cedar Park will need to migrate to a partner/system that functions with Tyler Incode by 12/31/2024.

What needs to Happen?

In the future, before the end of fiscal year 2024, or September 30, 2024, Cedar Park must identify and implement a new solution and simultaneously become PCI compliant via the following requirements:

4.1 Replace current partner/system Elavon Merchant Services

4.2 New partner/system must function with Tyler Incode version 9 and version 10

4.3 New partner/system must be certified by Tyler

4.4 New partner/system must support twenty-four or more credit card readers across half a dozen or more Cedar Park departments. The City reserves the right to add/delete locations, as it deems necessary. No location changes shall be made without the consent of the City. Current locations are as follows:

a. Utility Billing (2 credit card readers for Citizen Utility Bill Payments)

b. Municipal Court (5 cc readers for Summons & Court Fees)

c. Library (3 cc readers past due payments & non-resident card fees)

d. Parks & Recreation (9 cc readers for member registration, pool entrance, & permits)

e. Fire Marshall (1 cc reader for fire inspections)

f. Police Department (2 cc readers for animal control charges & records fees)

4.5 New partner/system must accept at minimum MasterCard, Visa, Discover, and services.

4.6 New partner/system services provided must include, but are not limited to, the following:

a. The systems (or programs) proposed must be able to authenticate the cardholder and use the current compliance standards to authorize and capture the transaction and be compatible with any future technology required by the credit card industry.

b. The system proposed must be able to utilize electronic check conversion for internet payments.

c. New partner/system must provide payment, settlement, and refunding services.

d. New partner/system must be Cardholder Information Security Program (CISP), Payment

Card Industry (PCI), and Data Security Standard (DSS) compliant.

e. New partner/system must be able to post payments to multiple merchant ID’s.

f. New partner/system must be able to provide a backup web solution to take payments if the primary access is down.

g. New partner/system must deposit gross payments in the City’s bank account daily.

h. New partner/system must provide online daily transaction and account reconciliation reports with multiple sorting options.

450 Cypress Creek Rd. Bldg. 1 • Cedar Park, Texas 78613 • www.cedarparktexas.gov • (512) 401-5000 • Fax: (512) 258-6083

- 13 -

i. New partner/system must provide a software or internet-based point-of-sale. The system should allow the City to run transaction reports during the business day without interrupting the ability of the point-of-sale system to process transactions.

j. Monthly statements must be available for download via the internet and/or received by the City of Cedar Park, Utility Billing Dept., 450 Cypress Creek Road, Building 2, Cedar Park, TX 78613, by the 5th calendar day of the following month.

k. Each City department or area should have an individual statement of activity and charges, and a statement that summarizes all the departments.

l. The City reconciles credit card transactions daily. Transactions must be available to easily download into Microsoft Excel from the merchant bank on a daily basis. At a minimum, this should include the merchant ID, transaction date, amount, card number, and customer name.

Designated Merchant Card Personnel

a. Upon selection, the merchant card processor shall designate one account officer with authority and responsibility for the City’s entire account. The designee shall be responsible for training and communicating the terms of this contract to all of its employees.

b. This designated account officer shall also have responsibility for ongoing review and oversight of the City’s transactions. This manager should provide the City with timely reports of heightened transaction “downgrades” resulting in higher rates/fees, along with recommendations to City management for improving related City processes and methodology to positively impact the resultant electronic interchange reimbursement fee.

Notices

a. The successful firm shall notify the City in writing within ten (10) business days of any changes in Federal or State regulations that would thereafter affect the credit card services contract.

b. The merchant service provider shall also notify the City of new services that become available to the City throughout the contract period.

If an integrated solution for all software as mentioned above cannot be provided, please propose an alternate solution and the cost associated with the alternate solution.
