About this file
This is a Request for Information (RFI) issued by the Virginia Department of Behavioral Health and Developmental Services (DBHDS) regarding inpatient substance treatment beds. The RFI is not a solicitation for services but rather an information-gathering exercise to assist in future planning efforts. DBHDS explicitly clarifies that the RFI does not constitute an intent, commitment, or promise to solicit or procure a solution, and responses are not prerequisites for submitting proposals in any subsequent procurement. No specific response dates, due dates, site visits, bidder conferences, award dates, or contract terms are established, as this is an informational inquiry rather than a formal procurement action.
No pricing terms, set-asides, incumbents, or funding information is specified in this RFI, as the document serves only to gather market information and does not represent an active procurement. DBHDS has explicitly stated that unsolicited proposals will not be accepted at this time, and interested parties should await formal solicitation announcements should the agency proceed with procurement activities related to inpatient substance treatment bed services.

I. Introduction
The intent of this Request for Information (RFI) is to gather information; it is not a solicitation for services. The information received will be informative and may assist in planning. Nothing in this RFI should be construed as intent, commitment or promise to solicit or procure a solution. DBHDS is not at this time seeking proposals and will not accept unsolicited proposals. Any response to this RFI shall not be considered a pre-requisite to submitting a proposal for any subsequent procurement.
DBHDS will not be liable for any costs incurred by responding to this RFI. Respondents should not provide any confidential or proprietary information. Information submitted in response to this RFI will become the property of the DBHDS.
Respondent is asked to provide estimated cost within their response for such services described in their RFI response. However, such cost will in no way be used for evaluation or considered as a proposal of a solicitation. Following receipt of responses to this RFI, DBHDS may contact some respondents to schedule clarification meetings to gain additional understanding.
II. Purpose
To gather information to assist DBHDS in effectively analyzing the cost, procedures and challenges with providing residential and/or inpatient substance abuse treatment services for individuals determined by their court of jurisdiction to meet the criteria as Sexually Violent Predators (SVPs) pursuant to Va. Code Section 37.2-900 et. seq. and who have been released to the community on conditional release.
Specifically, the RFI should:
1. Determine a budget to assist in securing residential and/or inpatient substance abuse treatment services for an SVP individual residing in the community on as need basis.
2. Assist in determining or developing a treatment plan including length of stay, types of treatment provided, housing requirements and security plans for the facility.
III. Present Situation
While some SVP individuals require intensive sex offender treatment in a secure facility operated by DBHDS called the Virginia Center for Behavioral Rehabilitation (VCBR), others whose risk of reoffending can be managed in the community, are placed on conditional release on GPS and, through a contract between DBHDS and the DOC, are under the supervision of the Department of Corrections (DOC) supervising officers. SVP individuals on conditional release live and work in the community and comply with the requirements of the Virginia Sex Offender Registry. SVP individuals with substance abuse issues on conditional release are required to participate in treatment with outpatient DOC contracted providers. This treatment is provided in a group setting for 1-2 hours per week.
Some individuals with serious substance abuse issues who are placed on conditional release from either the DOC or VCBR have difficulty transitioning from a controlled living environment where treatment and support are more readily available. If these individuals relapse, DOC supervising officers attempt to work with them using sanction plans and other services that may be available such as Intensive Outpatient Programs and other support programs such as Alcoholics or Narcotics Anonymous. If the individual does not respond positively to these sanctions, there are no more intensive substance abuse treatment programs available to them and Emergency Custody Orders (ECOs) are eventually issued. When evaluated for return to the community, evaluators have often recommended that some of these individuals would be suitable for return to conditional release if they participate in residential or inpatient substance abuse treatment.
Access to residential and inpatient substance abuse treatment will allow for individuals in need of these levels of treatment to remain on conditional release and receive appropriate treatment interventions in the community as opposed to being civilly committed to VCBR, a facility that provides some substance abuse treatment but does not specialize in that area. Providing this treatment in the community also allows for individuals to remain on Medicare, Medicaid, or retain any other private insurance they may have.
Desired Criteria for Substance Abuse Treatment
1. Ability to provide treatment at the Clinically Managed Low-Intensity Residential, Clinically Managed High-Intensity Residential, Medically Managed Residential or Medically Managed Inpatient level or care (ASAM 3.1, 3.5, 3.7 or 4 respectively).
2. Employment of staff able to provide services that follow applicable state and federal statutes and regulations as established by the Virginia Department of Behavioral Health and Developmental Services (DBHDS) as well as providing a trauma informed, therapeutic milieu that is supportive of treatment and recovery.
3. Professional standards including, but not limited to, the requirements to be licensed to provide substance abuse treatment under and in compliance with the Rules and Regulations for Licensing Providers by the Department of Behavioral Health and Developmental Services, 12 VAC 35-105.
4. Compliance with the Regulations to Assure the Rights of Individuals Receiving Services from Providers Licensed, Funded, or Operated by the Department of Behavioral Health and Developmental Services, 12 VAC 35-115 or provide explanations in writing for any areas with which they are not able to comply.
5. Ability to work closely with DBHDS and DOC staff to ensure that the individual can adhere to the conditions of supervision and their SVP conditional release plan.
6. Ability to maintain a system of good data collection and management mechanisms for clear reporting to DBHDS.
