“EXCEPTION”
EXCEPTIONS
These specifications are based upon design and performance criteria which have been developed by the fire department as a result of extensive research, careful analysis, and experience. These specifications reflect the type of fire apparatus that is desired, and all specifications herein contained are considered as minimum.
If a product brand name is specified and is commercially available to all bidders, an exception to such item (s) is not merited and may be deemed unacceptable.
Exceptions may be considered if they are equal to or superior to that specified and provided, they are listed and fully explained on a separate sheet titled “Statement of Exceptions”. All deviations, no matter how slight, shall be clearly explained on the “Statement of Exceptions” sheet, in the bid sequence, citing the page, specification number, and paragraph number(s) of the specifications, how the proposed deviation is different, how the deviation meets or exceeds the specifications and why it is necessary. The customer reserves the right to require a bidder to provide proof in each case that a substituted item is equal to that specified. If proposing an approved equal or alternate product, it will be the proposers’ responsibility to provide adequate information on their response to enable the City to ensure that the response meets the required criteria. If adequate information is not submitted with the response, it may be rejected. Qualified City personnel shall make the final determination as to whether the product proposed qualifies as an approved equal.
Proposals that are found to have deviations without listing them or bids taking total exceptions to these advertised specifications “may be considered non-responsive”.
