About this file

This Request for Applications (RFA) is issued by the Madison Metropolitan School District (MMSD) in Wisconsin to establish a roster of qualified attorneys to serve as Independent Hearing Officers in student expulsion matters. The District seeks to expand its current roster beyond one private attorney by recruiting multiple eligible candidates who will serve on an as-needed, year-round basis as authorized by the Board of Education. Hearings are typically conducted in-person in Madison at the Doyle Administration Building before a certified court reporter. The RFA was issued on October 22, 2018, with a submission deadline of November 16, 2018 at 2:00 PM CST. Questions regarding the RFA were due by October 31, 2018 at 2:00 PM CST, with responses posted by November 2, 2018. Applicant interviews were scheduled for November 27, 2018, with Board of Education approval estimated for December 17, 2018. The initial contract term runs from the award date through June 30, 2019, with options for annual renewal subject to Board approval. During the most recent full academic year, approximately 96 students were recommended for expulsion, with approximately 12 participating in expulsion hearings.

Hearing Officers will be compensated at a rate of $115 per hour and must submit detailed invoices in increments of one-tenth of an hour within 30 days of hearing conclusion. Applicants must be admitted to the Wisconsin State Bar and maintain good standing throughout their appointment. Required qualifications include recent, responsible experience with state and federal education laws, preferably including student discipline matters; strong analytical, interpersonal, and organizational skills; excellent written and verbal communication abilities; proficiency with Microsoft Word or similar word-processing applications; demonstrated ability to issue timely decisions; and willingness to attend MMSD-administered training. Applicants must provide decisions within five business days of hearing conclusion and demonstrate anticipated availability throughout the academic year. The evaluation criteria weights 40 percent for qualifications, 30 percent for demonstrated competence based on a writing sample, 20 percent for references, and 10 percent for availability. All applicants must be certified as not debarred, suspended, or ineligible to do business with the federal government. The District currently operates with one contracted independent hearing officer selected through lottery for each expulsion matter.

General Information Introduction and background The purpose of this document is to provide interested parties with information to enable them to prepare and submit an application for Independent Hearing Officers. The District as represented by Legal Services, intends to use the results of this solicitation to establish a roster of attorneys that the Board of Education may authorize to serve as Independent Hearing Officers in student expulsion matters.

Approximately 27,000 students, about 50% of which are minority, are currently enrolled in the Madison Metropolitan School District, making it the second largest school district in the State of Wisconsin. The District employs over 2,780 teachers, 145 administrators and 1,300 support personnel, plus more than 2,500 part time staff (including substitute teachers and summer recreation workers). The MMSD includes 49 school buildings in a 72 square mile area that includes the City of Madison and all or parts of several surrounding municipalities, with 32 elementary schools (grades 4K through 5) 12 middle schools (grades 6 through 8) and 5 high schools, one of which is a small alternative high school (grades 9 through 12). Several of the schools at each level have been named National Schools of Excellence by the U.S. Department of Education. The District also operates early childhood programs and alternative programs for middle and high school students as well as maintaining additional sites such as the Administration Building, the Maintenance/Food Service Building, the Mansfield and Lussier Stadiums, the Hoyt School, and the Affiliated Alternatives.

MMSD believes every school should be a thriving school that prepares each student to graduate from high school ready for college, career and community. We strive to ensure that students are on-track to graduate, that every student has access to a challenging and well-rounded education, and that students, families and employees experience a positive school and district climate. The District’s strategic framework recognizes the following priorities in working toward the realization of our vision: 1) Coherent Instruction – every student should have well-rounded, culturally responsive and coherent instruction; 2) Personalized Pathways – students should be engaged in charting a personalized pathway to college, career and community readiness; 3) Family Engagement and Community Partnerships- we should engage families and community members as partners; 4) Thriving Workforce – we should cultivate a work environment to attract, develop and retain top talent; and 5) Accountability Systems – we need to ensure accountability at all levels. It is important for any applicant or organization working with the District share in this vision for our students.

(MMSD’s Strategic Framework can be found at: https://www.madison.k12.wi.us/framework) Because of the District’s sound financial management practices, Madison is one of only a few Wisconsin districts to have an “Aa1” bond rating.

Scope Project Description MMSD seeks to establish a roster of eligible and qualified attorneys who may be appointed annually by the Board of Education to serve as Independent Hearing Officers in student expulsion matters. Students in Wisconsin are entitled to due process, including the right to have an impartial hearing, prior to being expelled from school. The authority for the use of Independent Hearing Officers in student expulsion matters is found in Wisconsin Statutes, section 120.13(1). Hearings are typically in person and held in Madison, WI in the Doyle Administration Building, located at 545 West Dayton Street, before a certified court reporter. The District will be represented by an attorney or administrator. Students and their families may represent themselves, be accompanied by an advocate, or be represented by an attorney. Hearing Officers will serve on an as-needed year around basis, as authorized by the Board of Education.

Objectives

1.2.2.1Contracts will be issued annually for the period from July 1 through the following June 30, if authorized by the Board of Education (in this case, the start date would be January 1).
1.2.2.2Hearing Officers shall receive evidence presented in both oral and written form from District and student representatives, and may ask clarifying questions.
1.2.2.3Hearing Officers shall regulate the conduct of all participants during the proceedings and shall render a final decision and Order to expel or not expel the student based upon the preponderance of the evidence and the statutory basis set forth in Wisconsin Statutes section 120.13.
1.2.2.4Hearing Officers shall provide a copy of the decision to MMSD Legal Counsel within 5 business days from the date the hearing concludes. If the hearing transcript is not available to Hearing Officer, in hard copy or digitally, within 2 days of hearing, the Hearing Officer should contact the court reporter from the hearing and MMSD regarding same. If the written decision cannot be completed in 5 days, the Hearing Officer must provide written reason to MMSD prior to the 5th business day from the conclusion of the hearing and submit the decision as soon as possible thereafter – delay without cause may be grounds for dismissal as a Hearing Officer.
1.2.2.5Hearing Officers will be compensated at the rate of $115 per hour, and shall present detailed invoices, in increments of one-tenth of an hour, within 30 days of the conclusion of the hearing. Failure to provide timely invoices may be grounds for refusal to pay.

Qualifications

1.2.3.1Admission to the Wisconsin State Bar. (Incumbents must remain members of the Wisconsin State Bar in good standing for the duration of appointment.)
1.2.3.2Recent responsible, relevant experience with state and federal education laws subsequent to admission, preferably including student discipline matters.
1.2.3.3Strong analytical, interpersonal and organizational skills.
1.2.3.4Excellent written and verbal communication skills.
1.2.3.5Willingness to attend any training administered by MMSD.
1.2.3.6Demonstrated ability to issue decisions in a timely manner.
1.2.3.7Proficiency with Microsoft Word or other word-processing applications.
1.2.3.8Anticipated availability throughout the academic year. Extended periods of unavailability may be grounds for dismissal as a Hearing Officer.
1.2.3.9Ability to maintain confidentiality all matters related to the individual students and their alleged misconduct.

Current Operations The MMSD currently contracts with 1 private attorney to act as Independent Hearing Officer for expulsions. A lottery is held to assign a Hearing Officer to each recommended expulsion matter. During the most recent full academic year, approximately 96 students were recommended for expulsion. Of those, approximately 34 were diverted due to special educational needs, 50 were able to enroll in an alternative program in lieu of expulsion or were dismissed for other reasons and 12 participated in an expulsion hearing.

Request for application process This document is a Request for Application. It differs from a Request for Bid in that the District is seeking a solution as described herein, not a bid meeting firm specifications for the lowest price. As defined in the American Bar Association Model Procurement Code, Competitive Sealed Proposals will be evaluated based upon criteria formulated around the most important features of a product or service, of which quality, testing, references, and availability or capability, may be overriding factors, and price may not be determinative in the issuance of a contract or award. The application evaluation criteria should be viewed as standards which measure how well an applicant’s approach meets the desired requirements and needs of the District.

Procuring and contracting department/division This Request for Application (RFA) is issued by Madison Metropolitan School District, Purchasing Services, which is the sole point of contact for the District during the selection process. Withdrawal of applications Applications shall be irrevocable until contract award unless the application is withdrawn. Applicants may withdraw an application in writing at any time up to the actual application closing date if the application has already been received by Purchasing Services. To accomplish this, the written request must be signed by an authorized representative of the applicant and submitted to purchasing services. If a previously submitted application is withdrawn before the application due date and time, the applicant may submit another application at any time up to the original application closing date and time.

Application Selection and Award Process Preliminary evaluation The applications will first be reviewed to determine if requirements in Section 2.0 are met and if additional requirements are met (see all requirement sections). Failure to meet mandatory requirements will result in the application being rejected. In the event that all applicants do not meet one or more of the mandatory requirements, the District reserves the right to continue the evaluation of the applications and to select the application which most closely meets the requirements specified in this RFA.

Application scoring Accepted applications will be reviewed by an evaluation committee and scored against the stated criteria. The committee may review references, request interviews, and conduct an on-site visit and use the results in scoring the applications.

Right to reject applications and negotiate contract terms The District reserves the right to reject any and all applications and to waive minor irregularities and technicalities. The judgment of the District on such matters shall be FINAL. The District further retains the right to negotiate the terms of the contract, including the award amount, with the selected applicant prior to entering into a contract. If contract negotiations cannot be concluded successfully with the highest scoring applicant, the District may negotiate a contract with the next highest scoring applicant.

Evaluation criteria The applications will be scored using the following:

CRITERIA
Weight (%)
Qualifications of the Applicant
40
Demonstrated Competence in Relevant Experience (Writing Sample)
30
References
20
Availability
10
TOTAL
100%

Award and final offer(s) The District may recommend a contract be awarded to the applicant with the highest total score as outlined in section 3.4, or may recommend that contracts be awarded to multiple applicants to provide portions of the services or goods proposed. Alternatively, multiple applicants with the highest total scores may be requested to submit final and best offers. If final and best offers are requested, they will be evaluated against the stated criteria, scored and ranked in the same manner described above to determine the applicant with the highest total score.

Special Contract Terms and Conditions Hold harmless By submitting an application, contractor understands that the District and its representatives will determine which application is accepted. Applicant waives any right to claim damages of any nature, whatsoever, based on the selection process, and any communications associated with the selection of the successful contractor. All completed applications and supporting documentation submitted shall be the property of the Madison Metropolitan School District.

Liquidated damages The Applicant acknowledges that, if after being awarded a contract the contractor fails to deliver the goods or services in a timely manner, substantial economic and other damages will be incurred by the District, in an amount that is not easily ascertained, and that $150.00 per working day, not to exceed one-half of the total of the contract, for every day past the scheduled delivery date(s) is a fair and appropriate estimate of such damages. The contractor agrees that such amount is not intended to be a penalty but to represent actual damages incurred, and that the District shall have the right to assess such damages either through deducting the damages from the amount due under contractor’s invoices or by directly billing Contractor.

Prime contractor and minority business subcontractors The prime contractor will be responsible for contract performance when subcontractors are used. If subcontractors are to be used, the applicant must clearly explain their participation and they must abide by all terms and conditions of the contract.

Additional terms The District reasonably believes that sufficient funds are available or can be obtained to make payments due under any contract issued under this application; however, the contract will terminate immediately and absolutely if appropriated and otherwise unobligated funds are no longer available to satisfy the obligations of the District under this contract.

The District shall not be bound by any terms and conditions included in any applicant’s packaging, service catalog, brochure, technical data sheet or other document which attempts to impose any conditions at variance with or in addition to the terms and conditions contained in this solicitation, including the standard terms and conditions contained herein, or in the resultant contract. If an applicant objects to any term or condition that shall relate to a contract resulting from this solicitation, the objection shall be clearly stated on a separate page entitled “Objection to Term or Condition.”

If the objection is accepted by the District it will be stated in any resultant contract. If not stated in the contract, the terms and conditions shall remain as written in the RFA.

Termination of contract The District may terminate the resultant contract at any time at its sole discretion by delivering thirty (30) days written notice to the contractor. Upon termination, the District’s liability will be limited to the pro rata cost of the services performed as of the date of termination plus expenses incurred with the prior written approval of the District. Termination by the contractor shall require written notice to that effect to be delivered by the contractor to the agency not less than sixty (60) days prior to said termination. In the event that the contractor exercises its right to terminate the contract, for any reason whatsoever, it will refund to the District within fifteen (15) days of said termination, all payments made hereunder by the District to the contractor for work not completed or not accepted by the District.

Standard Terms and Conditions The District reserves the right to incorporate standard contract provisions into any contract negotiated with any application submitted responding to this RFA (Standard Terms and Conditions and Supplemental Standard Terms and Conditions for Procurements for Products and/or Services). Failure of the successful applicant to accept these obligations in a contractual agreement may result in cancellation of the award.

Required Forms The following forms must be completed and submitted with the application in accordance with the instructions given in Section 2.0. Blank forms are attached.
