About this file

This is Amendment 1 to a Request for Applications (RFA #202602025) issued by the State of Maine Department of Environmental Protection, Division of Environmental Assessment, Nonpoint Source Program, for grants supporting watershed-based plan development and nonpoint source pollution control projects. The amendment clarifies definitions and procedures for sub-grants and procurement of services within the grant program. Eligible applicants include regional planning commissions, councils of governments, conservation districts, counties, cities, towns, and interstate organizations serving as public planning agencies. The solicitation requires development of comprehensive watershed-based plans incorporating EPA's nine minimum elements, watershed assessments, nonpoint source surveys, water quality monitoring programs, and stakeholder outreach. Applicants must submit questions by April 15, 2026, at 4:00 p.m. local time, with complete applications due May 6, 2026, at 4:00 p.m. local time through the Vendor Self Service System. The anticipated contract period runs from October 1, 2026, through December 31, 2028.

The amendment specifically revises language governing two funding mechanisms: sub-grants, which pass-through funds directly to other eligible entities to accomplish significant project components (with sub-grantees required to meet eligibility criteria and alignment with their public purpose), and procurement of services, which covers acquisition of supplies, equipment, construction, or services on a competitive basis in accordance with federal law and the Department's NPS Grant Administrative Guidelines. Approximately $225,000 in Section 604(b) Clean Water Act funding is available for multiple awards subject to federal appropriations and State Procurement Review Committee approval. All applicants must satisfy a minimum 10% non-federal matching fund requirement, calculated at 0.112 times the grant amount requested, with eligible matching contributions including cash or in-kind services such as volunteer time valued at Maine's established hourly rate of $32.13 per hour. Eligible activities encompass watershed assessments, nonpoint source surveys, plan development, water quality monitoring, and outreach efforts, while implementation activities such as permitting, inspections, and construction are ineligible.

3. Page 9, Part II.E.2. Added an example of a procurement relationship after the second sentence.

Revised Language in Solicitation

1. Conducting Assessments or developing a Watershed-based Plan are complex undertakings. Eligible applicants, as defined in Part I.C, may not have the expertise to fulfill project goals. Eligible applicants may use grant funds to obtain assistance and expertise by issuing sub-grants to eligible entities as defined in Part I.C, or through the procurement of services.

2. Sub-grants – Sub-grants directly pass-through funds from the applicant (grantee) to another eligible entity (sub-grantee) defined in Part I.C. If the applicant plans to pass-through funds to an eligible sub-grantee to accomplish a significant part of the project, then the applicant should identify the proposed sub-grantee, their qualifications, and a brief description of the work to be conducted. For example, a municipality (applicant) may plan to issue a sub-grant to a soil and water conservation district (sub-grantee) to coordinate the project or perform certain tasks. Sub-grantees must meet the eligibility requirements described in Part I.C. The work to be performed needs to be aligned with the public purpose or mission of the sub-grantee.

3. Procurement of Services - In some projects, an applicant may need to purchase goods or services to complete project activities. Procurement means acquisition of supplies, equipment, construction, or services. For example, a municipality (applicant) may procure grant management services from a consultant or non-profit entity. Procurement with federal funds must be made on a competitive basis to ensure that fair and reasonable prices are obtained for goods and services. Grant recipients may use their own procurement procedures provided that the procedures conform to applicable federal law and standards and the Department’s NPS Grant Administrative Guidelines (https://acrobat.adobe.com/id/urn:aaid:sc:VA6C2:f7e5d544-4781-4072-96b5-4d46d1086b7b).
