OVERVIEW
As provided in PL 89-72, Reclamation may enter into multi-year agreements for development programs for the design and construction of new Recreation facilities at Lake Casitas and the upgrade and rehabilitation of existing facilities within the Reservoir Area. At Reclamation’s discretion, Reclamation may cost share with the District on any activities under the development program, no more than the maximum allowed by Federal law. This cooperative agreement proposes a 50/50 cost share with the District on recreation improvements within the Reservoir Area. The District has continuously performed its obligations to administer, operate, maintain mailto:mcastaneda@usbr.gov and develop recreational facilities within the Reservoir Area to the present. This proposed agreement will allow for improvements to the existing facilities and for new projects required to enhance and continue the public use of the area.
RECIPIENT INVOLVEMENT
Recipient will be responsible to participate on a cost share basis with Reclamation and provide an annual schedule of tasks to be implemented.
The proposed tasks to be included in this agreement may include picnic area improvements, roadway upgrades, Quagga Mussel cleaning stations, vendor site improvements, boat launching and dock improvements, recreational vehicle parking and other improvements necessary for the Reservoir Area. Conduct an annual evaluation process whereby Reclamation and its managing partner can review a schedule of potential tasks in view of current needs, priorities, and budget availability. To evaluate proposals together with cost-sharing requirements of a particular task, to select those tasks from the schedule, and implement with the funding available in the current year. Reclamation and its managing partner will also identify on an annual basis a specific schedule of tasks for the following year and incorporate those tasks into this agreement by formal modification.
Recipient Objectives are as follows:
Road Paving: All roads within the park are surveyed yearly for areas that have been damaged by water, vehicles, or heavy equipment. Absent any actual damage, roadways are scheduled for re-paving every five years. Slurry seals may be applied every three years to areas that have more wear than others, this is done to keep integrity of the roads in place. Road base is sloped for water drainage damage. Tree roots around the park are a problem and those areas are dealt with on an individual basis. Paving has been done within the Park for the 50 years it has been in existence. Assistance form Reclamation just began in 2011 and the funding will help immensely in providing good roads for public use. Paving is scheduled for October or March of every year to avoid as little interruption of Park activities as possible. Generally, 2-3 miles are paved each year.
Main Entrance Upgrade: This project has already begun. The District is holding several on-site meetings with prospective contractors. Structure has to be increased in height, more traffic lanes need to be installed, security lights and traffic lights will be required and spike strips installed for security will be needed in each vehicle lane. An outside lane for larger vehicles will be part of the final design. Currently, large motor homes cannot enter through the existing vehicle lanes. Entry kiosk for Park Rangers to check in visitors will be enlarged and moved back to allow for more vehicles in each lane. Boat traffic will be funneled into a specific lane for inspection requirements of Quagga Mussel program. Construction is scheduled to start in December of 2012, project completion by May of 2013, with final project in early 2014.
Campground B: Electrical re-vamp is required due to the condition of existing power lines and visitor hookups not being code approved. Several road crossings will need to b excavated to support underground line placement and culverts will be required at two locations to divert rain waters from entering the main campground. Local vendor will be used for the changeover, with the area power company, Southern California Edison, doing a large part of the project hookup and splicing for underground line work. Picnic tables within the campground will all be replaced with ADA compliant benches and each camp will have a pedestal type barbecue pit installed, ones that are safe to operate and where hot coals will not be in reach of children. ADA compliant restrooms will be added to two locations within the campground. Existing portable units will be removed. Garbage cans will be placed at convenient locations throughout the campground, serviced daily and all refuse placed in a commercial dumpster for weekly removal to landfills in the area. Start date is November of 2012, completion by April 1, 2013.
RECLAMATION INVOLVEMENT
Reclamation shall meet annually or more often as needed to review and inspect the Administration, Operation, Maintenance and Development of the Recreation Area at Lake Casitas. The purpose of these reviews and inspection is to ensure the all procedures are adequate, to identify and correct deficiencies and problems, and to ensure the administration of the Recreation Area is in accordance with the Management Agreement.
Reclamation shall review and approve all development plans, including, but not limited to, replacement and alterations to facilities and Reclamation will approve any construction activity related to facilities prior to construction. The District shall coordinate with Reclamation, in advance, of the need for any clearance and permits.
It is expected that Reclamation will visit this site at least one time per month, no less than Quarterly, to properly administer this cooperative Agreement.
SINGLE-SOURCE JUSTIFICATION
DEPARTMENT OF THE INTERIOR
SINGLE SOURCE POLICY REQUIREMENTS
Department of the Interior Policy (505 DM 2) requires a written justification which explains why competition is not practicable for each single-source award. The justification must address one or more of the following criteria as well as discussion of the program legislative history, unique capabilities of the proposed recipient, and cost-sharing contribution offered by the proposed recipient, as applicable.
In order for an assistance award to be made without competition, the award must satisfy one or more of the following criteria:
(1) Unsolicited Proposal – The proposed award is the result of an unsolicited assistance application which represents a unique or innovative idea, method, or approach which is not the subject of a current or planned contract or assistance award, but which is deemed advantageous to the program objectives;
(2) Continuation – The activity to be funded is necessary to the satisfactory completion of, or is a continuation of an activity presently being funded, and for which competition would have a significant adverse effect on the continuity or completion of the activity;
(3) Legislative intent – The language in the applicable authorizing legislation or legislative history clearly indicates Congress’ intent to restrict the award to a particular recipient of purpose;
(4) Unique Qualifications – The applicant is uniquely qualified to perform the activity based upon a variety of demonstrable factors such as location, property ownership, voluntary support capacity, cost-sharing ability if applicable, technical expertise, or other such unique qualifications;
(5) Emergencies – Program/award where there is insufficient time available (due to a compelling and unusual urgency, or substantial danger to health or safety) for adequate competitive procedures to be followed.
Reclamation did not solicit full and open competition for this award based the following criteria:
(4) UNIQUE QUALIFICATIONS
Single Source Justification Description:
1. District has a Management Agreement in place with Reclamation, which includes references for cost share in the construction of recreation facilities and improvements.
2. District staff currently performs most of the facility improvements required on an “as needed” basis, resulting in cost savings in labor and maintenance that would be associated with this agreement.
3. By Agreement and Public Law 89-72, Reclamation may enter into multi-year development agreements with the managing partner of federal lands (applicant) for the design and construction of new recreation facilities and the upgrade and rehabilitation of the existing recreation facilities.
4. All land at Lake Casitas is owned by Reclamation, managed by Agreement, by Casitas Municipal Water District. All maintenance and construction activities within the Area must be reviewed and approved by Reclamation. This unique contract agreement precludes others from entering into other contracts for this specific area.
