Purchase Request Number: HC1028-08-D-2017 Task Order 0006
JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY
Justification Number: JA12-076
Upon the basis of the following justification, I, as Procurement Activity Competition Advocate, hereby approve the use of other than full and open competition of the proposed contractual action pursuant to Federal Acquisition Regulation (FAR) Part 16.505(b)(2)(i)(C).
JUSTIFICATION
1. Requiring Agency and Contracting Office.
Requiring Agency: Defense Information Systems Agency (DISA) – Network Services (NS) Directorate – Operational Support Systems Division - NMS Integration & Sustainment Branch (NS83) Contracting Activity: Defense Information Systems Agency (DISA)/Defense Information Technology Contracting Organization (DITCO)SEE PGI 216.505-70.
2. Nature/Description of Action(s).
a. Task Order (TO) 0006 was competed and awarded to Computer Sciences Corporation (CSC) in 2008. It has a base and two option periods. The action at hand is to extend the current TO and add Option Period 3 for six months for the remainder of FY12 and Option Period 4 for six months of FY13. The proposed contract type is a continuation of the original which is Firm Fixed Price and Time and Materials.
b. Option Period 3 – Period of Performance (POP) (30 Mar 12 – 30 Sep 12) total dollar value is estimated at $1,525,712.12 with $500 of the amount for local travel to and from the base. DISA Network Services (NS) will fund $1,200,712.12 of the amount while DITCO will fund $325,000 for the Networx taskings. DITCO is the Program Manager for Networx. Networx is a contract under the General Services Administration (GSA) that offers a variety of telecommunications services. The Networx telecom service offerings are ordered using DISA Direct. The second option is for another six-months, with a POP of 01 Oct 12 – 30 Mar 13 with an IGCE of $1,538,937.31. The total request is for 12 months of performance with an IGCE of $3,064,649.43. All funding is Defense Working Capital Funds (DWCF).
c. Task Order 6 currently consists of a base and two option periods. On the 8th of September 2011, the task order was an extended six months IAW FAR clause 52.217-8 (Option to Extend Services). The total obligated amount is $9,742.291.18.
3. Description of Supplies/Services.
a. DISA Direct is a suite of applications, web services, and stored procedures that support the mandated telecommunications ordering system for DISA. It is currently the only ordering system for telecommunications. The Contractor will continue to provide DISA Direct technical assistance for programming, unit testing, systems administration for all DISA Direct platforms, database (Oracle), web services, DISANet administration, firewall administration, and other support as outlined in the Performance Work Statement (PWS) dated 27 February 2012. As outlined in the PWS, this includes DISA Direct support services for Networx as well as the Defense Research and Engineering Network (DREN). DREN is another telecom service offering by DITCO ordered using DISA Direct.
4. Identification of Statutory Authority and Demonstration of Contractor’s Unique Qualifications.
a. The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, and all ENCORE II awardees were given a fair opportunity to be considered for the original order. (FAR 16.505(b)(2)(i)(C)). The Computer Sciences Corporation (CSC) - Fairview Heights, Illinois facility has been provided the Authority to Operate (ATO) and Authority to Connect (ATC) under HC1028-08-D-2017, TO 0006. Last year the DISA Direct software for development, testing, and training was also re-certified for ATO until 2013. It would not be practical or feasible with the decommissioning of DISA Direct estimated in 2013 to compete the remaining service time required to support DISA Direct. The ATO and ATC along with a new NIPRNet connection would need to be requested if a new contractor is obtained. This takes anywhere from 6-8 months since it is sponsored by DoD but at a Contractor site.
NS8 is moving to a new Order Entry suite of tools which will replace DISA Direct. However until those tools are available, DISA Direct support is essential to support and maintain the only existing mandated software that support the War Fighters for telecommunication support from DISA.
With the transition from DISA Direct to a new Order Entry it is essential to have the Contractor that has years of experience in order to share functionality and other information that will assist in moving towards the new Order Entry.
b. This exception to fair opportunity is required to support the decommissioning of DISA Direct in FY13. In October 2011, the NS8 Chief, Operational Support Systems Division, announced that DISA Direct would be decommissioned and replaced by a new order entry system. In February 2012, the assistant to the Chief, stated that the decommissioning would take place during FY13. Since FY13 is less than a year away, it is not feasible to contract out the remaining time required for transitioning the system to NS8 at Ft Meade for the decommissioning processes to begin. CSC, the current contractor, has over twelve years of experience with DISA Direct, and to bring a new contractor on board for one year or less would cost the Government additional time and monies. It is estimated that if a task order were awarded to another contractor for a base period of six months with a six month option period, it would take the base period at minimum to bring the new contractor up to speed on the overall system. This would likely then extend the task order POP and effort from one year to one-and-a-half years; that would result in an additional cost of about $1.5 million. The dollars estimated were based upon averages and past knowledge of the labor categories and estimated hours for DISA Direct support in the past 12 years. In addition to the time/funds necessary to acclimate new contractor, thousands of dollars would be required to move the DISA Direct hardware that resides at the current site to a new location and have a NIPRNet circuit established for the remaining period requested. NS8 is planning to move the existing hardware from the current contractor site prior to September 2012 to Ft. Meade, Maryland. If a new contractor were awarded, this cost would double because the move and NIPRNet circuits would have to be done twice versus once. With DISA Direct scheduled to be decommissioned in FY13, it would take six months if not more to bring a new contractor up to even a basic level of understanding of the code, business rules, data base, web services, etc.
c. The current CSC staff consists of the same personnel that have coded and tested the applications for DISA Direct since 2008 and earlier. In addition to the programming staff, others such as the program management, engineering, data base and web services staffs are also made up of personnel that have been on task since 2008 and earlier. This staff has the knowledge of applications, stored procedures, web services, and business rules that make up DISA Direct. In addition, the System Administrators (SAs) that are responsible for not only the integration (development), test, training and production DISA Direct system infrastructures have been on the project since 2008 and earlier. As of March 2012, DISA Direct is in the middle of a tech refresh which consists of replacing the hardware and moving the applications and processes to a new set of application, web, and data base servers. The life cycle of the hardware is long overdue. The tech refresh was scheduled, funded, and estimated to be completed in 2011, however due to delays by DISA Computing Services Directorate (CSD) it went into to 2012. DISA Direct is not scheduled to be decommissioned until mid to late FY13. This tasking requires personnel that are familiar with the existing infrastructure as well as software in order to complete this tasking. It would take any other vendor at least six months to gain the necessary experience and expertise to complete the tasking. Although the unclassified tech refresh has been completed for DISA Direct, there are still modifications being requested by CSD which will not be completed until March 2012. The classified DISA Direct tech refresh is currently underway but is not projected to be completed until May or June of 2012. If a new contractor were awarded the task order, the tech refresh that is currently underway would be halted until the new contractor could gain the requisite knowledge and skills; again, a process that would likely take about six months.
d. If the J&A is not approved the current support for DISA Direct will come to a complete work stoppage until such time a new contract or task order could be utilized. A work stoppage would cause major issues globally since DISA Direct is a mandated MAC II level system.
5. Cost/Price Fair and Reasonable Determination.
ENCORE II composite rates were used to calculate the IGCE along with the estimated hours and categories based off the previous efforts. The ENCORE II contract has pricing that was approved via the ENCORE II contract for T&M and FFP order. The contracting officer will ensure that the rates utilized are at or below the previously justified rates. The Contracting Officer Representative (COR) will review the vendor hours and categories to ensure they are also appropriate. The ENCORE II contract labor categories and rate comparisons for skill sets on this task order support the best value.
6. Market Research.
Market research was conducted prior to the Task Order 0006 award in 2008 using the GSA Pricer and ENCORE II vendor and labor category comparisons. No current market research has been conducted because it is estimated that if a new contractor was awarded a new task order for a base period of six-months with an option of six-months that it would take the first six-months at minimum to bring that contractor up to speed on the overall system. Again, modification of the current contract to add the option periods is in the interest of economy and efficiency.
7. Any Other Supporting Facts.
DISA Direct allows customers to order over 30 plus telecommunication services/options. Each service has unique ordering requirements that are implemented by specific edits and business rules. The existing contract personnel have the in-depth knowledge and understanding along with the detailed technical knowledge of how those decision rules are embedded in the DISA Direct software. Their expertise is vital to ensure transition of the system to Ft. Meade, Maryland without any issues in order to prepare for the start of the decommissioning of DISA Direct. The proposed plan is in the interest of economy and efficiency because it is a logical follow-on to the order already issued.
8. Actions Taken to Remove Barriers to Competition.
DCA200-02-D-5006 TO 00065 ENCORE I - competed and awarded to Computer Sciences Corporation (CSC) 31JUL06-30SEP08 - $4.3 mil HC1028-08-D-2017 TO 0006 ENCORE II - completed and awarded to Computer Sciences Corporation (CSC) 30SEP08-31MAR12 - current task order
DISA Direct is scheduled to be decommissioned in FY13. If at the end of Option Period 4 DISA Direct is not decommissioned, NS8 will re-evaluate the decommissioning plan and any follow-on work.
