The contract is awarded to MillerKnoll, Inc. for $430,040.00, with the primary objective of matching existing furniture style and finishes from a previously procured 3rd floor installation. The justification is based on the logical follow-on exception under FAR 8.405-6(a)(1)(i), with MillerKnoll selected due to their extensive experience with the USDC and ability to ensure seamless integration of new furniture with existing configurations. (ii) Nature and/or description of the action being approved.

The United States District Court (USDC) has a requirement for office furniture at the Diana E.

Murphy U.S. Courthouse, 300 S 4th St., Minneapolis MN 55415. Agency request is to match existing furniture style and finishes in contiguous space previously procured by GSA.

(iii) A description of the supplies or services required to meet the agency’s needs

(including the estimated value).

Furniture including but not limited to workstations and ancillary office furniture to match office furniture on the 3rd Floor. The estimated value is $430,040.00.

(iv) The authority and supporting rationale (see 8.405-6(a)(1)(i) and (b)(1)) and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

This procurement is authorized under the logical follow-on exception, as outlined in FAR 8.405-

6(a)(1)(i). The new work is a continuation of a previous Federal Supply Schedule order, placed in accordance with applicable ordering procedures. MillerKnoll, through its vendor Parameters, has extensive experience with the USDC in Minneapolis, MN, having successfully completed two projects with the court over the past five years. Their familiarity with the existing furniture configuration and design makes them uniquely qualified to provide the required products, ensuring seamless integration with the previously procured furniture. In the interest of economy and efficiency, MillerKnoll is the only vendor capable of meeting the requirement without disrupting continuity or incurring additional costs for design and product adjustments.

(v) A determination by the ordering activity contracting officer that the order represents the best value consistent with 8.404(d).

GSA has determined the prices of supplies and fixed-price services, and rates for services offered at hourly rates, under schedule contracts to be fair and reasonable. Therefore, ordering activities are not required to make a separate determination of fair and reasonable pricing, except for a price evaluation as required by 8.405-2(d). By placing an order against a schedule contract using the procedures in 8.405, the ordering activity has concluded that the order represents the best value (as defined in FAR 2.101) and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the

Government’s needs. Although GSA has already negotiated fair and reasonable pricing, ordering activities may seek additional discounts before placing an order (see 8.405-4).

(vi) A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

Market research was not conducted beyond the MAS/FSS schedules, as the requirement was for MillerKnoll products to match the existing furniture configuration on the 2nd floor. MillerKnoll in Minneapolis, offers these products, ensuring consistency with the previously procured furniture to complete the full furniture renovation.

(vii) Any other facts supporting the justification.

This procurement is a logical follow-on to an original Federal Supply Schedule order, previously awarded and administered by GSA in coordination with the USDC. The new requirement is for additional furniture that must integrate seamlessly with the existing products, maintaining consistency in the space's design and functionality.

(viii) A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

To remove barriers to restricted consideration in future acquisitions, the agency will explore alternative vendors and products through broader market research, where feasible. However, for this acquisition, the restricted consideration is necessary to ensure product consistency and integration with the existing furniture in a contiguous space.

(ix) The ordering activity contracting officer’s certification that the justification is accurate and complete to the best of the contracting officer’s knowledge and belief.

As evidenced by my signature below, I have determined this document to be both accurate and complete to the best of my knowledge and belief.

(x) Evidence that any supporting data that is the responsibility of technical or requirements personnel (e.g., verifying the Government’s minimum needs or requirements or other rationale for limited sources) and which form a basis for the justification have been certified as complete and accurate by the technical or requirements personnel.

As evidenced by the technical point of contact(s) signature(s) below, I (we) certify that any supporting data contained herein, which is my (our) responsibility, is both accurate and complete.

(xi) For justifications under 8.405-6(a)(1), a written determination by the approving official identifying the circumstance that applies.

As approving official, I have determined the following circumstances outlined above demonstrate the following reason(s) for limiting sources in accordance with FAR 8.405-6(a)(1):

(A) An urgent and compelling need exists, and following the procedures would result in unacceptable delays;

(B) Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; or

(C) In the interest of economy and efficiency, the new work is a logical follow-on to an original

Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order or BPA must not have been previously issued under sole-source or limited-sources procedures.
