About this file
This document is a consolidated question set from a Reverse Industry Day addressing engineering and non-engineering considerations for a progressive design-build construction project.
Engineering Questions (11 total): The questions address Guaranteed Maximum Price (GMP) establishment during Phase 1, including optimal design maturity levels and design ownership/intellectual property rights if the Government exercises an off-ramp option. Additional topics include the impact of local materials and industry standards (International Building Code and Unified Facilities Criteria) on design and construction; mechanisms for incentivizing innovation through the selection process; internal controls for managing cost, schedule, and scope risk; willingness to share past performance data and lessons learned; implementation of open-book cost estimating and cost transparency; accessibility of the procurement process for host-nation and joint venture (Korean/U.S.) teams; requirements for establishing a non-adversarial, project-first culture with a 24–48 hour Issue Resolution Ladder; identification of current USACE pre- and post-award processes that may hinder shorter timeframes and cost control for non-ROK-FC (U.S. funded) facilities; and optimal scope definition levels for the Request for Qualifications, including whether concept designs are beneficial or restrictive.
Non-Engineering Questions (3 total): These questions seek information on contractor experience with innovative and non-traditional contracting methods; alignment of provided "OTA Progressive Design-Build Construction Articles" with current industry best practices and recommended revisions; and proposed payment structure approaches that ensure clarity and efficiency while reflecting standard billing practices for other customers and subcontractors.

Reverse Industry Day: Consolidated Question Set
Engineering Questions
1. Regarding the establishment of the Guaranteed Maximum Price (GMP) during Phase 1, how would your firm typically define and structure the GMP and what level of design maturity (e.g., 60% Design Development, 90% Construction Documents) do you consider optimal to establish a reliable and fair GMP that minimizes the need for excessive contractor contingency? How does this off-ramp affect your willingness to invest fully in Phase 1, and how should design ownership, licensing, and reuse rights be handled?
2. If the Government exercises its "Off-Ramp" at the end of Phase 1, the Government rights to the design to continue the project. What do you consider a commercially reasonable mechanism for the Government to acquire the Computer Aided Design/ Building Information Modeling (CAD/BIM) files and associated intellectual property in such a scenario?
3. If local materials and industry standards were to be used (e.g. International Building Code (IBC) codes) and Unified Facilities Criteria (UFC) codes were strategically implemented, how would that effect design and/or construction?
4. How can we best incentivize innovation from industry? How can we tailor the selection process to leverage and reward innovation? How can the selection be optimized to improve cost/time savings through innovative solutions to technical requirements (e.g. Intelligence Community Directive (ICD) 705)?
5. What internal controls do you have to manage cost, schedule, and scope risk?
6. Are you willing to share past performance data and lessons learned?
7. How do you implement open-book cost estimating and cost transparency in your current practice?
8. For host-nation firms unfamiliar with U.S. acquisition norms, is a qualifications-first, English-language pitch process accessible? What would help local and joint venture (Korean/U.S.) teams compete on equal footing rather than narrowing competition to a few U.S. primes?
9. Success depends on a non-adversarial, "project-first" culture and an Issue Resolution Ladder with 24–48 hour elevation timeframes. What behaviors, governance structures, or "rules of engagement" most determine whether collaborative delivery succeeds or breaks down?
10. For contractors that have past performance experience with the US Government, what are three pre- or post-award processes/requirements, currently employed by USACE, that, in your professional opinion, would hinder the stated goals of this new approach, namely delivering non-ROK-FC (i.e. US funded) facilities in shorter timeframes and with less cost growth?
11. What level of scope definition (e.g., DD Form 1391, planning charrette reports, concept designs, etc.) is optimal for defining project requirements in the Request for Qualifications (RFQ)? Are concept designs beneficial, or do they limit your innovation and creativity?
Non-Engineering Questions
1. What is your experience with innovative and non-traditional contracting methods?
2. Are there any articles in the provided "OTA Progressive Design-Build Construction Articles" that you believe are out of alignment with current industry best practices? If so, which articles and what revisions would you recommend?
3. How would you structure the payment details to ensure clarity and efficiency for both parties? Does this reflect your billing practice for other customers and subcontractors?
