2. The nature and/or description of the action being approved.

ATF-FO intends to award a sole source, firm-fixed-price contract to CyberNational, Inc. for the procurement of the Retriev-All ballistic recovery system. This action will establish a new contract to acquire equipment and associated supplies and shipment required to sustain ATF ballistic testing operations.

3. A description of the supplies and/or services required, including the delivery schedule and/or the period of performance (inclusive of all option periods), and the estimated dollar value of the acquisition.

This action is for the purchase of five (5) Portable Retrieve-All Systems, 10 replacement HEPA filters, 50 replacement ballistic rubber faces, five (5) crates, and five (5) shipments to be used to support ATF personnel in safely handling ballistic evidence.

The estimated cost for this purchase is with a Required Delivery Date (RDD) no later than 120-days after purchase award.

4. Identify statutory authority permitting other than full and open competition.

This acquisition is conducted under the authority of 41 U.S. Code § 3304 – Use of Non-Competitive Procedures and the exceptions listed under RFO 6.103 – Other than full and open competition..

5. Services: A statement demonstrating the unique qualifications of the proposed contractor or the nature of the action requiring use of the referenced authority.

CyberNational, Inc. is uniquely qualified to provide these products to ATF based on the following:

- Market research conducted by ATF did not identify any other suppliers capable of providing a ballistic recovery system with the required HEPA filtration capabilities or comparable performance characteristics. No alternative vendors were able to demonstrate the technical features necessary to meet the required specifications. As a result, CyberNational, Inc. remains the only source capable of fulfilling the agency’s operational and technical needs for this requirement.

Brand name products. A demonstration of any brand name product’s unique attributes: An explanation of the unique attributes of the proposed brand name item(s) and why no other similar item will suffice.

Retriev-All is uniquely qualified to meet the agency’s needs based on the following:

- The Retriev-All system is the only known brand-name ballistic recovery device that integrates a proprietary HEPA-filtration containment design specifically engineered for safe projectile recovery during ballistic testing operations. Its combination of containment capability and filtration performance is not available from any other commercial product. No similar item can meet ATF’s safety requirements.

6. A description of efforts made to ensure offers/quotes were solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by RFO 5.1 and, if not, which exception under RFO 5.201(b) applies.

Market research was conducted and it was determined that Cyber National Inc is the only vendor that can provide the Retriev-All system that will meet the ATF’s needs.
