(i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, FAR Subpart 13.5 and as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; offers are being requested and a written solicitation will not be issued.
(ii) This solicitation is issued as a Request for Quotation (RFQ).
(iii) The solicitation document and incorporated provisions and clauses are those in effect through
Federal Acquisition Circular 2021-04.
(iv) This procurement is set aside for total small business. The NAICS code is 332312 Fabricated
Structural Metal Manufacturing and the Small Business Size Standard is 500 employees.

(vi) Description of Requirement – Brand Name or Equal: The Government intends to award one firm fixed price purchase order for one (1) pre-engineered modular road bridge. The bridge shall be Brand Name or Equal to an ACROW 700XS modular bridge, conforming with the following general salient characteristics:
• 100-foot nominal, single span
• 13’6” minimum width between curbs/rails/trusses
• 18” minimum height curbs or bridge railing
• A wearing surface shall be included
• Capable of supporting AASHTO HL-93 Live Load in addition to structure dead load
• Non-Fracture Critical as defined by USDOT FHWA National Bridge Inspection Standards
• Capable of being erected without the aid of a crane
• Live Load deflection shall be limited to L/400 or less
• Modular characteristics - including: the ability to be shortened, or reconfigured, while maintaining all required structural characteristics
Design drawings bearing the stamp of a Professional Engineer licensed in the State of Alaska shall be provided by the bridge supplier. Erection drawings and instructions shall also be provided by the supplier.
Work includes delivery (including off-loading) of the bridge and all components at the Delivery Location stated in section (vii).
SPECIFICATIONS
The bridge shall be designed following all requirements of AASHTO LRFD Bridge Design Specifications, 8th Edition.
The bridge shall be designed to provide a minimum service life of 50-years in a permanent installation.
Submittals:
Draft design drawing drawings shall be submitted and approved by the Contracting Officer prior to manufacture of the bridge.

Final, stamped design drawings and erection instructions shall be provided prior to delivery of the bridge to the site.
QUALITY ASSURANCE
1. Quality Control is the responsibility of the Contractor. The Government intends to inspect the work to ensure the quality standards described herein.
2. Payment will be based upon 100% acceptable completion. Deductions for unacceptable performance are established in the form of replacement of the material at contractor expense or monetary deductions to the payment amount under the designated line item.
(vii) Date(s) and Place(s) of Delivery and Acceptance
Bridge shall be delivered to location 9-10 weeks after Date of Award.
Delivery/Acceptance Location The materials shall be delivered to the bridge crossing location, which is approximately 0.5 miles down a private road that begins at milepost 3.60 of the Resurrection Creek Road in Hope, Alaska. The delivery location is at 60°52'55.51" N Latitude, 149°38'0.62" W Longitude.
The delivery location is off a narrow, unimproved, single-lane, native-surfaced road. The delivery vehicle should be capable of navigating this type of road. A turn-around for a tractor-trailer exists just beyond the drop-off location. Access to the road is via a locked gate. Coordinate with the COR for gate access upon delivery.
(viii) 52.212-1 Instructions to Offerors – Commercial Items (JUN 2020) (Provision) Addenda to provision 52.212-1:
Addenda to paragraph (b) Submission of Offers:
1) Offerors must have an active entity registration in the System for Award Management in order to submit an offer. https://www.sam.gov/SAM/
2) Offers submitted in response to this solicitation shall include a technical proposal, a price proposal, and contractor representations and certifications.
a) Technical Proposal– The technical proposal shall address the evaluation factors in 52.212-2. At a minimum technical proposal shall include:
i) Past Performance – provide a list of three (3) similar projects completed by your firm over the past three years. Include a brief description of the project, dollar amount, year completed, and project owner contact information (name, phone, and email).

iii) Technical Capability – Provide a description of the product offered that meets the required salient characteristics listed in the Statement of Work. Include completed provision 452.211-71 if a brand name product is specified and you are offering an equal product. Design drawings bearing the stamp of a Professional Engineer licensed in the State of Alaska shall be provided by the bridge supplier. Erection drawings and instructions shall also be provided by the supplier.
b) Price Proposal – Include the following: 1) completed price schedule from section v of this solicitation, 2) Acknowledge any amendments issued on beta.sam.gov for this solicitation by completing and signing the posted SF-30.
c) Representations and Certifications – Fill in the check boxes for provisions 52.204-24, and 52.212-3 found in this solicitation. Copy and paste the completed provisions onto your company letterhead and include your DUNS number.
2) Submit offers by email to Della Koelling and Cynthia Horwitz so that they are delivered into this inbox by the due date and time. Emails should contain 3 separate attachments (Technical Proposal, Price Proposal, and Representations and Certifications) in Microsoft Word or Adobe PDF format. Be aware that large attachments may increase the time required to deliver an email.

(ix) 52.212-2 Evaluation – Commercial Items (OCT 2014) (Provision)
(1) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation represents the best value to the Government, price and other factors considered. The following factors shall be used to evaluate offers: Technical Proposal and Price.
(a) Technical Proposal, the Government will evaluate the Technical Proposal according to the following criteria:
i) Past Performance: When evaluating this factor, the Government will assess the specialized experience and skill of the firm, with a focus on the elements described in the submission requirements. The Government defines “past performance” as the measure of the degree to which the offeror (including major subcontracts) has satisfied previous customers and complied with Federal, State and Local laws and regulations. The Government may contact references to assess the quality of the contractor’s work, including:
1. Customer satisfaction
2. Timeliness of Performance
3. Problems encountered on the identified project and corrective actions taken
4. Cost control methods

The past performance evaluation will characterize the level of the Government’s confidence that the offeror will successfully complete the work, in compliance with all contract requirements, based on its record of successful performance on recent and relevant similar projects.
The offeror is advised that in conducting this assessment, the Government may obtain and evaluate Past Performance information obtained from sources other than those identified in the quote. The Forest Service will utilize existing databases of Contractor performance information and solicit additional information from the references provided by the Offeror and from other sources if, and when, the Contracting Officer finds the existing databases to be insufficient for evaluating a Offeror’s Past Performance. An Offeror’s Past Performance will not be evaluated favorably or unfavorably when:
1. The offeror lacks relevant performance history, or
2. Information on performance is not available.
(ii) Relevant Experience: When evaluating this factor, the Government defines “relevant” as work similar in nature to this requirement. The Government will assess your relevant experience on the basis of its breadth and its depth (how much and what type of work you and your firm have performed in response to the evaluation criteria).
(iii) Technical Capability: The Government will assess the degree to which the proposed supply meets the required salient characteristics specified in the Statement of Work. If your firm’s quote is submitted for other than brand name, the information provided for the proposed equal will be assessed to determine if it meets the minimum salient characteristics identified in the solicitation. It is the Offeror’s responsibility to provide sufficient information to show the product offered as an “equal” meets the minimum salient characteristics. The government is under no obligation to seek out additional information if the quote is incomplete or unclear. The Government will assess if your firm’s design drawings bear the stamp of a Professional Engineer licensed in the State of Alaska. The government will assess if your firm has provided erection drawings and instructions as required by 52.212-1.
2.) Price: The Government will evaluate the quoted prices, for the base and option items, for reasonableness in accordance with FAR 13.106-3(a).
(3) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.
(a) Definitions. (b) Prohibition. (1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. (2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract.
Nothing in the prohibition shall be construed to—
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services".
(d) Representation. The Offeror represents that—
(1) It ☐will, ☐will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds "will" in paragraph (d)(1) of this section; and
(2) After conducting a reasonable inquiry, for purposes of this representation, the Offeror represents that— It ☐ does, ☐ does not use covered telecommunications equipment or services, or use any equipment, system, or service that uses covered telecommunications equipment or services.
