JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

TITLE: Public Record Parcel Land Data

1. Contracting Activity:

2. Nature/Description of Action:

The United States Department of Agriculture (USDA), National Statistics Service (NASS) intends to award a firm-fixed price open market negotiated sole source contract with a base and one

(1) 12-month option year to CoreLogic Solutions, LLC to provide Public Record Parcel Land Data.

3. Description of Supplies/Services The USDA’s National Agricultural Statistics Service (NASS) seeks the acquisition of public record parcel land data from county property tax and deed records for all private residential, agricultural, and commercial properties in selected areas of the U.S. Specifically, information on the areas selected for the 2023 June Area Survey (JAS) and the effort to geo-reference NASS’s list frame as part of the Integrated Modeling and Geospatial Estimation System (IMAGES). JAS data are used to measure the incompleteness of the Census of Agriculture mailing list (CML), which allows the Census estimates to be adjusted for under coverage of the CML. Thus, the geo-referencing work and the JAS are instrumental in ensuring the quality of the Census estimates.

1. These data should be acquired in bulk or through an API. The bulk processing entails CoreLogic staff processing the data request. The API process entails NASS staff acquiring themselves and at will.

2. The extract through either process should include the following for each property in the selected areas in counties all over the United States:

• Tax roll information of the property, (including but not limited to):

o The physical location (address including zip code, latitude and longitude coordinates), o The mailing address of the property owner(s), o Current sale and historical sale information, o Lot/land information (square footage of lot or land), o Building information.

• Deed information, including (but not limited to):

o Address of the parcel o Owner information (address if different from property sale address) o Sales information (including sales data, sales price) o type of sale (such as new construction, interfamily, foreclosure), o land use type information (to indicate details ab01.t the type of residential, commercial, or agricultural property)

4. Statutory Authority 41 U.S.C § 1901 - Simplified Acquisition Procedures up to $7.5 million, as authorized by FAR 13.500(a) and implemented by FAR 13.501(a).

Pursuant to FAR 13.106-1(b)1(i), Contracting Officers may solicit from one source if it’s determined only one source is reasonably available to satisfy agency requirements.

5. Demonstration of Contractor’s Unique Qualifications and/or Product’s Unique Features CoreLogic provides a service that gathers local administrative records and other information on land ownership within counties across the US. CoreLogic is the only company that takes the additional step of cleaning, standardizing, and formatting this data across all states. Thus, the product they offer results in a clean and consistently formatted dataset, which allows NASS to ingest CoreLogic data into NASS databases in a highly efficient, timely, and accurate manner.

The justification for sole source is that CoreLogic is the only company that provides a dataset of sufficient quality and consistency for our project. Furthermore, no competitors currently meet our data and data quality requirements; all other ways to collect this data result in raw, “messy” data that would require thousands of hours to clean, standardize, and format for consistency and make it fit for use for this project. For these reasons, CoreLogic’s data represent the best value to the government.

6. Contract Opportunities Announcement/Potential Sources A Sources Sought Notice was posted on SAM.gov under Notice ID #1232SA24Q0038 was posted on January 6, 2023, with a Response Date of February 6, 2024.

7. Determination of Fair and Reasonable Cost.

A fair and reasonable cost will be determined based on published catalog prices, previous purchases of similar items and negotiation of price awarded.

8. Market Survey A Sources Sought Notice was posted on SAM.gov under Notice ID #1232SA24Q0038 was posted on February 6, 2024.

However, NASS has found accessing geospatial information using an API allows more rapid access, and an API requires a substantial amount of time to develop. If the approach of receiving the data in bulk was to be used, time would be required to develop the proper formats that would allow the data to be effectively used in NASS. To meet an impending April 1 production deadline, NASS cannot afford the time required to establish either the API or the processes for bulk delivery and perform the required work to meet this deadline, which is associated with a survey that is conducted every ten years.

To meet an impending April 1 production deadline, NASS cannot afford the time required to establish either the API or the processes for bulk delivery and perform the required work to meet this deadline, which is associated with a survey that is conducted every ten years. In the near future, NASS will evaluate whether ICE can meet NASS’s requirements and, if so, determine the associated costs, which could lead NASS to work with ICE instead of exercising the option year of the CoreLogic contract.

Recent market research conducted in FY23 determined that no mandatory sources of supply and vendors of any other government contract vehicles were capable of providing Public Record Parcel Land Data in the degree and quality required by the agency.

9. Additional Support There is only one source available that can meet the requirements for a land ownership tool that emphasizes agriculture. No other facts exist supporting the use of full and open competition.
